Wylie VA Ambulatory Care Center at 420 North James Road, Columbus, OH 43219. The project will allow Urology, Orthopedics, and Surgery to consolidate to one location on campus.

The project will add one operating room, PACU, exam, and office spaces for the above mentioned departments.

This project will include Existing Conditions, Concrete, Metals, Wood/Plastics/Composites, Thermal & Moisture Protection, Openings, Finishes, Specialties, Furnishings, Special Construction, Fire Suppression, Plumbing, HVAC, Electrical, Communications, Electronic Safety & Security, Earthwork, Exterior, Improvements, and Utilities divisions.

BID ITEM 1 (BASE BID): Work includes general construction, alterations, roads, walks, grading, drainage, mechanical, electrical, necessary removal of existing structures and construction and certain other items shown on the drawings and within the specifications. All phases of work shall be complete within 425 calendar days after the receipt of Notice to Proceed.

BID ITEM 2 (Alternate 1): All work in Bid Item 1, except remove overhead hung sliding doors and associated door hardware and replace with swing doors and hardware as indicated on the drawings and within the specifications. All phases of work shall be complete within 425 calendar days after the receipt of Notice to Proceed.

BID ITEM 3, (Alternate 2): All work in Bid Item 1, except for the work removed in Bid Item 2 and remove the exterior structure shell. Also, remove the build-out and all related mechanical and electrical work to the extent indicated on the drawings. All phases of work shall be complete within 395 calendar days after the receipt of Notice to Proceed.

BID ITEM 4, (Alternate 3): All work in Bid Item 1, except for the work removed in Bid Item 2 and, Bid Item 3, and remove the interior build-out where indicated on the drawings. Refer to the drawings for architectural, mechanical, and electrical modifications to this space. All phases of work shall be complete within 395 calendar days after the receipt of Notice to Proceed.

BID ITEM 5, (Alternate 4): All work in Bid Item 1, except for the work removed in Bid Item 2, Bid Item 3, and Bid Item 4, and remove the interior build-out where indicated on the drawings. Refer to the drawings for architectural, mechanical, and electrical modifications to this space. All phases of work shall be complete within 395 calendar days after the receipt of Notice to Proceed.

**The first 45 calendar days after contractor receipt of the Notice to Proceed are designated for the contractor to get employees badged, get VA schedule approval, submittal of the schedule of values, project drawings, safety plan, mobilization plan, Waste Disposal plan, Storm Water Pollution Prevention (SWPP) plan and all other submittals. The contractor will not be permitted to mobilize on the construction site before 45 calendar days, without the Contracting Officer’s approval.

HOURS OF OPERATION:

Normal business hours for the VAACC are currently 8:00 am – 5:00 pm, Mondays through Sundays, excluding federal holidays. The Urgent Care Center and Pharmacy hours are 7:00 am – 7:00 pm Mondays through Fridays, and 7:00 am - 4:30 pm on Saturdays, Sundays and federal holidays.

Work may be performed at the designated place of performance for this project outside of normal business hours as specified in the drawings/specifications or upon written approval by the Contracting Officer.

INFORMATION REGARDING BIDDING MATERIAL, BID GUARANTEE AND BONDS

(a) Bidding materials consisting of drawings, specifications and contract forms may be obtained by qualified General (Prime) Contractors interested in submitting bids direct to the Department of Veterans Affairs directly from the website at www.fbo.gov.

(b) One set of drawings and specifications will be available for review at the contracting office. To view, contact Shelton Beasley at phone number 614-257-5829.

(c) A bid guarantee is required in an amount not less than 20 percent of the bid price but shall not exceed $3,000,000.00. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for opening of bids, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.

(d) If the contract will exceed $150,000.00 (see FAR 28.102-1 for lesser amount), the bidder to whom award is made will be required to furnish two bonds, a Payment Bond, SF 25A, and a Performance Bond, SF 25, each in the penal sum as noted in the General Conditions of the Specification. Copies of SFs 25 and 25A may be obtained upon application to the issuing office.

Offices of CBLH Design, as Architect-Engineers, will render certain technical services during construction. Such services shall be considered as advisory to the Government and shall not be construed as expressing or implying a contractual act of the Government without affirmations by Contracting Officer or his duly authorized representative.

NOTICE-SAFETY COMPLIANCE REQUIREMENT

Safety or Environmental Violations and Experience Modification Rate “All Bidders/Offerors shall submit the following information pertaining to their past Safety and Environmental record: (The information as outlined below shall be submitted at the time the bid or request for proposal is submitted. For sealed bids, information shall be submitted in a separate sealed envelope identified by the solicitation number, company name, and identified as “Safety Compliance Information”.)

1. VIOLATION INFORMATION: The information shall contain, at a minimum, a certification that the bidder/offeror has no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any EPA violation(s) in the past three years.

2. EXPERIENCE MODIFICATION RATE: All Bidders/Offerors shall submit information regarding their current Experience Modification Rate (EMR) equal to or less than 1.0. This information shall be obtained from the bidder’s/offeror’s insurance company and be furnished on the insurance carrier’s letterhead.

Self insured contractors or other contractors that cannot provide their EMR rating on insurance letterhead must obtain a rating from the National Council on Compensation Insurance, Inc. (NCCI) by completing/submitting form ERM-6 and providing the rating on letterhead from NCCI. Note: Self insured contractors or other contractors that cannot provide EMR rating on insurance letterhead from the states or territories of CA, DE, MI, NJ, ND, OH, PA, WA, WY, and PR shall obtain their EMR rating from their state run worker’s compensation insurance rating bureau.

DETERMINATION OF NON-RESPONSIVE--

All bids/offers in response to this solicitation will be reviewed for responsiveness to the solicitation. Failure to provide documentation as outlined above, at date and time set for bid opening or receipt of proposal, may deem the bid/proposal Non-Responsive. Potential bidders are further advised to consult FAR 14.301 Responsiveness of Bids for a full understanding of what makes a bid responsive.

Post award, this requirement is applicable to all subcontracting tiers, and prospective prime contractors will be responsible for determining the suitability of their prospective subcontractors. Information concerning any subcontractors will be provided to the Contracting Officer, in the same form and format as outlined above, prior to the prospective subcontractors commencing work under any resulting contract.

NOTICE OF REQUIRED REGISTRATION WITH CONTRACTOR PERFORMANCE ASSESSMENT SYSTEM (CPARS)

1. as prescribed in Federal Acquisition Regulation (FAR) Part 42.15, the Department of Veterans Affairs (VA) evaluates contractor past performance on all contracts that exceed $150,000, and shares those evaluations with other Federal Government contract specialists and procurement officials. The FAR requires that the contractor be provided an opportunity to comment on past performance evaluations prior to each report closing. To fulfill this requirement VA uses an online database, CPARS, which is maintained by the Naval Seal Logistics Center in Portsmouth, Virginia. CPARS has connectivity with the Past Performance Information Retrieval System (PPIRS) database, which is available to all Federal agencies. PPIRS is the system used to collect and retrieve performance assessment reports used in source selection determinations and completed CPARS report cards transferred to PPIRS. CPARS also includes access to the federal awardee performance and integrity information system (FAPIIS). FAPIIS is a web-enabled application accessed via CPARS for contractor responsibility determination information.

1. Each contractor whose contract award is estimated to exceed $150,000 is required to register with CPARS database at the following web address: www.cpars.csd.disa.mil. Help in registering can be obtained by contacting Customer Support Desk @ DSN: 684-1690 or COMM:

207-438-1690. Registration should occur no later than thirty days after contract award, and must be kept current should there be any change to the contractor’s registered representative.

1. For contracts with a period of one year or less, the contracting officer will perform a single evaluation when the contract is complete. For contracts exceeding one year, the contracting officer will evaluate the contractor’s performance annually. Interim reports will be filed each year until the last year of the contract, when the final report will be completed. The report shall be assigned in CPARS to the contractor’s designated representative for comment. The contractor representative will have thirty days to submit any comments and re-assign the report to the VA contracting officer.

1. Failure to have a current registration in the CPARS database, or to re-assign the report to the VA contracting officer within those thirty days, will result in the Government’s evaluation being placed on file in the database with a statement that the contractor failed to respond.”

CONTRACTOR SECURITY (SECURITY LANGUAGE REQUIREMENTS) AND PRIVACY TRAINING REQUIREMENTS

1. GENERAL

Contractors, Contractor personnel, Subcontractors, and Subcontractor personnel shall be subject to the same Federal laws, regulations, standards, and VA Directives and Handbooks as VA and VA personnel regarding information and information system security.

2. ACCESS TO VA INFORMATION AND VA INFORMATION SYSTEMS

a. A Contractor/Subcontractor shall request logical (technical) or physical access to VA information and VA information systems for their employees, subcontractors, and affiliates only to the extent necessary to perform the services specified in the contract, agreement, or task order.

b. All Contractors, Subcontractors, and Third-Party Servicers and associates working with VA information are subject to the same investigative requirements as those of VA appointees or employees who have access to the same types of information. The level and process of background security investigations for Contractors must be in accordance with VA Directive and Handbook 0710, Personnel Suitability and Security Program. The Office for Operations, Security, and Preparedness is responsible for these policies and procedures.

3. VA INFORMATION CUSTODIAL LANGUAGE

a. Information made available to the Contractor or Subcontractor by VA for the performance or administration of this contract or information developed by the Contractor/Subcontractor in performance or administration of the contract shall be used only for those purposes and shall not be used in any other way without the prior written agreement of the VA. This clause expressly limits the contractor/subcontractor's rights to use data as described in Rights in Data - General, FAR 52.227-14(d) (1).

b. The Contractor/Subcontractor shall not make copies of VA information except as authorized and necessary to perform the terms of the agreement or to preserve electronic information stored on Contractor/Subcontractor electronic storage media for restoration in case any electronic equipment or data used by the contractor/subcontractor needs to be restored to an operating state. If copies are made for restoration purposes, after the restoration is complete, the copies must be appropriately destroyed.

4. VA PRIVACY TRAINING FOR PERSONNEL WITHOUT ACCESS TO VA COMPUTER SYSTEM OR DIRECT ACCESS OR USE TO VA SENSITIVE INFORMATION The Department of Veterans Affairs (VA) must comply with all applicable privacy and confidentiality statutes and regulations. This will necessitate that all contractor personnel be trained annually on privacy requirements. For contractor and subcontractor personnel that do not require access to VA computer system or direct access or use to VA “sensitive information” this requirement shall be met by one-on-one training coordinated by the Contracting Officer’s Representative. The training should take a maximum of 30 minutes to review and will require each individual to sign the documentation of training. 2.6 FAR 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 425 calendar days (or less based upon the bid item selected by the VA). (ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/content/table-small-business-size-standards.

(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.

(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.

(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.

(g) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:
