About this file
This is a certification form issued by the U.S. Department of the Interior, Office of Surface Mining Reclamation and Enforcement, applicable to the Russian Stotts Abandoned Mine Land (AML) Project in Crawford County, Kansas, administered by the Kansas Department of Health and Environment. The form consolidates multiple certification requirements that prospective contractors must complete and submit as a prerequisite for contract award. Primary covered transaction participants must certify they are not debarred, suspended, or otherwise ineligible from federal transactions; have not been convicted of fraud or criminal offenses related to public contracts within the preceding three years; and are not presently indicted or criminally charged. Contractors must also agree to include lower-tier covered transaction clauses in all subcontracts and solicitations without modification.
The certification form additionally requires grantees and contractors to establish and maintain a drug-free workplace by publishing anti-drug policies, implementing drug awareness programs, requiring employee notification of the policy, and establishing procedures for responding to employee drug convictions, with violations subject to personnel action up to and including termination. For awards exceeding $100,000, the form requires certification that no federal appropriated funds have been or will be used for lobbying activities, with the undersigned agreeing to submit disclosure forms if non-federal funds are used for lobbying purposes. Failure to file required certifications subjects violators to civil penalties ranging from $10,000 to $100,000 for each failure. The certification must be signed by an authorized certifying official and is treated as a material representation of fact upon which the government relies in awarding the contract.
