The equipment shall be manufactured in compliance with the Technical Manuals, TM, for the specified piece of equipment. The Contractor shall deliver the equipment to the CMS Warehouse, provide final dealer check-up after delivery and training to ensure proper functionality. The performance period starts on the day specified in the contract. The Contractor shall pick up the equipment at the same place where they were delivered after completion of the period of performance. CMS does not intend to purchase any of the required equipment. The contractor shall lease the equipment to CMS.
2. Condition of Leased Equipment. Equipment furnished under this contract shall be of good quality and in safe operating condition as well as comply with the safety guidelines applicable to the equipment. The Government shall accept or reject the equipment promptly after receipt. If the Contracting Officer (CO) or Contracting Officer’s Representative (COR) determines that any equipment furnished is not in compliance with this contract, the CO shall promptly inform the Contractor in writing. If the Contractor fails to replace the equipment or correct the defects as required by the CO or COR, the Government may –
(a) By contract or otherwise, correct the defect or arrange for the lease of a similar equipment and shall charge or set off against the Contractor any excess costs occasioned.
3. Maintenance. The leased equipment will be maintained properly and maintain operational conditions during the leasing period. The Contractor will submit a written inspection schedule prior to the commencement of work. The Contractor will pick up/return the equipment from/to the designated location (CMS) if outside maintenance is required. The Contractor will provide loaner/replacement equipment at no cost to the Government at the same time of that day as the leased equipment is picked up/turned in for maintenance/repair when a piece of equipment requires maintenance/repair resulting in an absence of more than two (2) workdays and/or when it is requested by the Government. The loaner equipment does not have to be the same model being leased but shall be a similar type. The maintenance cost shall be included in the monthly leasing charge. No separate payment incurred for maintenance will be made to the Contractor. The Contractor will repair any defects and damages caused by normal fair wear and tear and replace items to include but are not limited to consumed oils, parts, batteries, and components identified in the periodical inspection or an on-call repair request at no cost to the Government.
4. Preventive Maintenance. The Contractor will inspect the leased equipment quarterly at the Contractor designated maintenance shop or at CMS. “Periodic Maintenance” is intended for “Compulsory Inspection” in accordance with the equipment’s TM. The Contractor shall perform equipment inspections every 6-months or as often as necessary to ensure they are secure and in safe functional operation. When annual inspection and 6-month inspection take place at the same time, annual inspection serves the 6-month inspection as well. Upon completion of each periodic maintenance/inspection, the Contractor shall prepare and submit a written report to the Government within fifteen (15) business days. The report shall include the date and time of the maintenance/inspection, description of the equipment and its location, description of repairs, and the name of the personnel performing the maintenance/inspection.
