1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation and supervision necessary to perform Laboratory Services for the International Boundary and Water Commission, United States Section (USIBWC) as defined in this Performance Work Statement. The contractor shall perform to the standards in this contract.
1.2 Background: The Tijuana River Valley Monitoring Program (TRVMP) (Attachment 3) is a required monitoring program as defined in the National pollutant Discharge Elimination System (NPDES) permit issued to the USIBWC for the South Bay International Wastewater Treatment Plant (SBIWTP) by the San Diego regional office of the California Regional Water Quality Control Board (the Board) as order no R9-2021-0001as amended by order no. R9-2023-0009, NPDES no. CA0108928
The project is located in the Tijuana River and adjacent canyons along the U.S. – Mexico border in San Diego County, California. (see attachment 3 for site locations and map of sites).
The data quality objectives and criteria for analysis of data, sampling methods requirements, and laboratory parameters for these programs are listed in the TRVMP Quality Assurance Project Plan (TRVMP QAPP) (Attachment 4).
Laboratories must meet the Method Detection Limit (MDL), as specified in Table 1 of the TRVMP QAPP. (Note: the laboratory’s Limit of Quantitation (LOQ), sometimes referred to as the minimum quantitation limit (MQL), must be at or below the AWRL.) MDLs not listed in Table A7 shall be consistent with the MDL provided in the method approved under 40 CFR part 136.
All field work and sample collection will be conducted by USIBWC personnel or a USIBWC contractor. However, laboratory can propose as an option to provide the collection services if they have a subcontractor who is local to San Diego and experienced in water and sediment sampling procedures as approved in the TRVMP QAPP. This line of the proposal will be separate from the laboratory services.
This contract will not include the laboratory services for samples collected under separate contracts or cooperative agreements with federal and state agencies.
1.3 Objectives:
1.3.1 The laboratory services shall include, but are not limited to, analysis for the parameters listed in Schedule of Services/Supplies as required by the USIBWC.
1.4 Scope:
1.4.1 Under the USIBWC TRVMP, the Contractor must meet the program requirements listed in the TRVMP QAPP (Attachment 4) to conduct water and sediment laboratory analyses for monitoring purposes as well as any parameters listed in the request for proposal that are not listed in the QAPP. Laboratory quality assurance/quality control (QA/QC) (standards, duplicates, spikes, blanks, matrix spikes, and matrix spike duplicates) reports shall be included with all laboratory final reports. The Contractor shall submit a copy of its laboratory quality assurance manual with procurement. To ensure acceptance and adherence to the TRVMP QAPP, a copy of the TRVMP QAPP shall be signed by the Contractor prior to any sample analysis. The current TRVMP QAPP will be updated upon award of the contract to reflect the new laboratory and may have minor changes throughout the term of the contract, such as adding/ removing monitoring stations or parameters. The Contractor laboratory Program Manager and Quality Assurance Officer shall sign all renewals and revisions to the TRVMP QAPP within a timely manner (less than thirty (30) days) to accept and adhere to the document. If changes to the TRVMP QAPP pose economic burdens to the Contractor, the Contractor must discuss with the Contract Officer to issue a contract modification.
1.4.2 The Contractor shall use analytical methods for the various parameters approved by the United States Environmental Protection Agency (EPA) under 40 CFR Part 136 or the 22nd edition of "Standard Methods for the Examination of Water and Wastewater" (SM) that are listed in the TRVMP QAPP (Attachment 4). Any EPA or SM analytical methods are acceptable as long as the laboratory holds California ELAP accreditation in the method and can meet the MDL.
1.4.3 The Contractor shall be responsible for compliance with Federal, State, and local regulations governing: 1) the analysis and proper disposal of contaminated or potentially contaminated surface water, sediment, and associated materials; 2) the appropriate record keeping, documentation, notification, and reporting requirements associated with laboratory procedures and data generated from the analyses; and 3) safety and health to protect its workers, the public, and the property of others.
1.4.4 Neither the Contractor nor its representatives (including but not limited to subcontractors), direct or indirect, will release or publish any laboratory results or other information derived from the work performed under this contract without specific written approval of the Contracting Officer (CO).
1.4.5 The Contractor, and all subcontractors, shall have California Environmental Laboratory Accreditation Program (ELAP) certification by the time of contract award. The Contractor is required to maintain accreditation throughout the course of the contract with the USIBWC. Data produced and reports submitted shall be generated by a laboratory accredited by the State of California ELAP. The laboratory must hold a valid certificate of accreditation for the analytical test method specified in 40 CFR part 136 as listed in Table 1 of the TRVMP QAPP (Attachment 4).
Contractor shall submit a copy of its California ELAP Laboratory Fields of Accreditation (FOA) to the CO. Contractor shall also submit copies of its most recent accreditation audit (on-site laboratory assessment).
1.4.6 The Contractor 's laboratory shall be accessible for the Contracting Officer’s Representative to submit samples collected and to ensure the processing is performed to meet the specified sample holding time(s) on samples collected and submitted. The laboratory must be within a distance that will ensure that shipment of samples will reach the lab from the sample location by the next morning.
1.5 Period of Performance: The period of performance shall be for one (1) Base Year of 12 months and four (4) 12-month option years. The Period of Performance reads as follows:
Base Year – October 1, 2025 – September 30, 2026 Option Year I – October 1, 2026 – September 30, 2027 Option Year II – October 1, 2027 – September 30, 2028 Option Year III – October 1, 2028 – September 30, 2029 Option Year IV – October 1, 2029 – September 30, 2030
1.6 General Information
1.6.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. The quality control plan shall be delivered within 30 after contract award. After acceptance of the quality control plan the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system.
1.6.2 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.6.3 The Contractor must meet the program requirements listed in the TRVMP QAPP (Attachment 4) to conduct water and sediment laboratory analyses for monitoring purposes as well as any parameters listed in the request for proposal that are not listed in the QAPP. 1.6.4 In the event that an error has been made in the analysis or sample results are questionable, a re-test will be required without additional charge to the Government. If the holding time of the existing sample has not expired, that sample will be re-tested. If the holding time has expired, another sample will be collected and transported for re-testing at the discretion of the Government if needed. If re-testing is no longer possible, the analysis will not be run and the Government will not be charged.
1.6.5 The Contractor shall provide a narrative for any deviations from the QAPP with every lab report and will be available to answer any questions the Government may have pertaining to the lab report results or analysis process.
1.6.6 The Contractor shall use analytical methods for the various parameters approved by the United States Environmental Protection Agency (EPA) under 40 CFR Part 136 or the 22nd edition of "Standard Methods for the Examination of Water and Wastewater" (SM) that are listed in the TRVMP QAPP (Attachment 4). Any EPA or SM analytical methods are acceptable as long as the laboratory holds accreditation in the method and can meet the MDL.
1.6.7 Recognized Holidays: The services shall not be performed on the following Federally recognized holidays:

1.6.8 Hours of Operation: The contractor shall complete the laboratory samples during the hours of 8:00 AM and 5:00 PM Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.
1.6.7 Place of Performance: Laboratory samples shall be taken at the locations listed in Table 1 and shown in Figure 1 in the Tijuana River and adjacent canyons in San Diego County, California.
1.6.8 Type of Contract: The government will award a Firm Fixed Price contract.
1.6.9 Special Qualifications: The Contractor, and all subcontractors, shall have California Environmental Laboratory Accreditation Program (ELAP) certification by the time of contract award and maintain accreditation throughout the course of the contract with the USIBWC. ELAP certification is required for all parameters listed in Table 1 of the TRVMP QAPP (Attachment 4). Contractor shall submit a copy of its Accreditation to the CO. Contractor shall also submit copies of its most recent accreditation audit (on-site laboratory assessment).
1.6.10 Post Award Conference/Periodic Progress Meetings: The Contractor shall attend a post award conference convened by the contracting activity in accordance with Federal Acquisition Regulation Subpart 42.5. The Contracting Officer, Contracting Officer’s Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues.
These meetings shall be at no additional cost to the government. Meetings with the contractor will either be held at the contractor’s facility or the government’s facility and will be mutually agreed upon in advance.
1.6.11 Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; letter of designation issued to the COR, a copy of which is sent to the
Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
1.6.12 Key Personnel: The follow personnel are considered key personnel by the government: Contract/Project Manager, Quality Assurance Officer or equivalent, Laboratory Manager/Director. The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer.
The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contractor shall provide a Quality Assurance Chemist/Officer who shall be responsible for the quality assurance of the work performed. The contractor will provide the necessary laboratory personnel for the analyses required by this contract.
PART 2
DEFINITIONS & ACRONYMS
2. DEFINITIONS AND ACRONYMS:
2.1. DEFINITIONS:
2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.
2.1.5. DELIVERABLE. Anything that can be physically delivered but may include non-manufactured things such as meeting minutes or reports.
2.1.6. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.1.7. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.8. QUALITY ASSURANCE Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.1.9. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
2.1.10. SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

PART 3
CONTRACTOR FURNISHED ITEMS AND SERVICES
3. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:
3.1 General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract.
3.2. Materials: The Contractor shall furnish all labor, material, supplies, equipment, and personnel to perform laboratory services for the samples provided by the USIBWC, or USIBWC contractors, to the Contractor's designated laboratory(s). Samples will be collected and shipped to the laboratory by USIBWC personnel or USIBWC contractors, and shipments of coolers back to the laboratory will be paid for by USIBWC. The laboratory will ship the appropriate coolers and bottles, including preservation, to the USIBWC San Diego Field Office according to the monitoring schedule (Attachment 1) by the 3rd day of the month for the scheduled samples. An additional set of coolers and bottles will be shipped to the USIBWC FO for collection of dry weather transboundary flow events to be on standby.
Unless the laboratory proposed a subcontractor for sample collection and was accepted by the USIBWC, at which point the lab will provide the materials to their subcontractor. Sampling schedule will be reviewed annually.
PART 4
SPECIFIC TASKS
4. Specific Tasks:
4.1. Basic Services. The contractor shall provide services for the analysis of water and sediment samples collected by the USIBWC.
4.2. Tasks
4.2.1 Under this contract, the Contractor shall furnish all labor, material, supplies, equipment, and personnel to perform laboratory services for the samples provided by the USIBWC, or USIBWC contractors, to the Contractor's designated laboratory(s). Samples will be collected and shipped to the laboratory by USIBWC personnel, USIBWC contractors, or contractors’ collection subcontractor if proposed and accepted by the USIBWC. Shipments of coolers back to the laboratory will be paid for by USIBWC unless collected by the laboratory subcontractor. The laboratory will ship the appropriate coolers and bottles, including preservation, to the San Diego Field Office as provided in 4.2.2 or to the contractors’ collection subcontractor by the 3rd day of the month for that month’s scheduled samples. An additional set of coolers and bottles will also be shipped to the USIBWC to have on standby in the event of a dry weather transboundary event. This set of coolers will be refreshed immediately after an event or as needed when an unused kit expires due to expiration of preservatives. The schedules will be renewed each option year according to the yearly monitoring provided by the USIBWC.
4.2.2. Weekly bacteria samples will require a separate set of coolers and sample bottles and contractor should provide at least a month’s (four kits) worth of supplies.
4.2.3 Samples contain untreated wastewater and should therefore be tested using a dilution series for Coliform and Enterococcus strains to ensure quantification of the bacteria values.
4.2.4 The Contractor shall provide the appropriate coolers, sample containers required, preservatives (excluding ice), QA/QC samples as required, chain-of-custody forms (COCs) and labels for all samples. The Contractor will be responsible for shipping the appropriate sample containers and coolers to the USIBWC San Diego Field Office located at:

4.2.5 The Contractor shall only charge the USIBWC for the number of acceptable samples received and analyzed. The Contractor shall not analyze parameters out of holding time without the Contracting Officer’s Representative of Contracting Officer’s authorization. For those samples examined but not analyzed for reasons beyond the control of the laboratory or the USIBWC, actual costs incurred and not recovered in the unit pricing of samples shall be submitted in a request for equitable adjustment.
4.2.6 The Contractor may use subcontractors as long as subcontractors meet the requirements in this scope of work and that the subcontractor signs the TRVMP QAPP.
4.2.7 The Contractor (including any subcontract laboratories) shall sign the TRVMP QAPP (Attachment 4) prior to sampling to demonstrate conformance to the standards for performance of this contract as detailed in the TRVMP QAPP. Minor changes may be required to the TRVMP QAPP over the performance period of the contract.
4.2.8 Changes to testing methods or laboratory procedures shall be provided in writing to the CO for approval.
4.2.9 The Contractor may be reimbursed by the USIBWC for unforeseen circumstances that require additional efforts not included elsewhere in this contract, are time sensitive, and are necessary to meet the requirements of the contract.
Such circumstances may include, but not limited to, retrieving coolers from the airport or shipping locations due to broken or leaking coolers. The Contractor shall contact the Contracting Officer’s Representative or Contracting Officer immediately upon becoming aware of the issue, and costs shall not exceed $100 per occurrence.
4.2.10 All samples, once under the control of the Contractor, must be handled and analyzed in such a way as to ensure the integrity of the sample/analysis and such that all hold time/preservative requirements are met. In the event of an error concerning the sample, analysis, or hold time, the Contractor shall contact the Contracting Officer’s Representative or Contracting Officer immediately in order to resolve the issue.
4.2.11 The Contractor shall be responsible for proper disposal of any waste generated from analyses or left over from sampling, after the applicable holding time.
4.2.12 Chain of Custody Forms. The Contractor shall submit original, hardcopies or electronic scans of Chain of Custody forms to the USIBWC COR (4191 N. Mesa, Attn: COR (to be named after award of contract), El Paso, Texas 79902) within 45 days of receipt of the samples for analysis by the Contractor.
4.2.13 Electronic Deliverables. the Contractor shall submit the following electronic deliverables to the COR within 45 days of receipt of the samples for analysis by the Contractor:
1. Pursuant to FAR 52.212-4(g)(1), invoices shall be submitted in .pdf format via the IPP invoicing system.
a. Invoices shall be dated the date sent to the USIBWC.
b. Invoices shall be for one month’s services.
c. Invoices shall be sent after all lab reports for that month have been sent to the COR.
2. Electronic reports in pdf, Word, or similar format must include:
a. Signed laboratory results with analyte/parameter, result, units, MDL, dilution factor, date/time analyzed, analytical method, sample location/station ID, date sampled and date received, any data qualifiers, and collecting entity/Field Office (from Chain of Custody form).
b. Analytical Summary/Quality Assurance sheets with standards, duplicates, spikes, blanks, matrix spikes, matrix spike duplicates, and limits of quantitation.
c. Scanned Chain of Custody forms.
d. Case Narratives, Casualty Reports, and Corrective Actions as needed.
3. Electronic Data Deliverables. Laboratory results as an Electronic Data Deliverable (EDD) in Microsoft Excel format, pipe-delimited text format, or other database-compatible electronic format agreed upon by the contractor and the Contracting Officer and Contracting Officer’s Representative. EDDs should include all information on laboratory results sheets in item 2a above.
4.2.14 Should the need arise; the Government may request for rush analyses and the additional costs incurred by the contractor must be approved in advance by the Contracting Officer prior to Laboratory performance of analysis.
4.2.15 Quality Control Requirements: In the event that an error has been made in the analysis or sample results are questionable, a re-test will be required without additional charge to the Government. If the holding time of the existing sample has not expired, that sample will be re-tested. If the holding time has expired, the Contractor will notify the Contracting Officer and the Contracting Officer’s Representative via email for approval to analyze and report or cancel analysis. The Contractor shall not analyze a sample past holding time or out of temperature compliance without approval from the Contracting Officer and Contracting Officer’s Representative.
4.2.16 Contractor shall provide a copy of the Laboratory Quality Control Procedures when submitting a proposal.
Laboratory Quality Control Procedures must also be submitted for all subcontract labs.
4.2.17 Contractor shall provide a cost proposal broken out by tasks within the TRVMP as follows:
Task Notes Task 1: Testing Parameters for Quarterly River Water Samples
TRV-1 and TRV 7 quarterly for water
Task 2: Testing Parameters for biennial Sediment TRV-1 through TRV-6 in year 2 and 4 for sediment Task 3: Testing Parameters for wet weather TRV-1 through TRV-1 once per year with 2 samples at

TECHNICAL EXHIBIT 1
The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.

The Contractor shall provide all analysis for the parameters listed in the schedule of services/supplies and shall use analytical methods for the various parameters approved by the United States Environmental Protection Agency (EPA) under 40 CFR Part 136 or the 22nd edition of "Standard Methods for the Examination of Water and Wastewater" (SM)

The Contractor shall not be paid for any analysis that does not follow the specifications in the TRVMP QAPP Table A7.

Notes for water parameters:
[1 Visual observations of the surface water conditions at the designated receiving water monitoring locations shall be conducted in such a manner as to enable the observer to describe and report the presence, if any, of floatables of sewage origin and trash. Observations of weather (cloudy, sunny, or rainy), tidal conditions (high or low; at applicable monitoring locations), water color, oil and grease, turbidity, and odor shall also be recorded. For canyon collector monitoring locations, observations will made as to if sediment is accumulating in the canyon collector system. These observations shall be taken whenever a sample is collected.
[2] E. coli is required at freshwater monitoring locations (i.e., monitoring locations TRV-1 through TRV-6).
[3] Enterococci is required at saline monitoring locations (i.e., monitoring location TRV-7).
[4] Mass emission rate (MER) of the constituent for each sample taken shall be calculated in accordance with section
7.12 of Order No R9-2023-0009.
