PORTS Contract

• Requiring activity: Military Surface Deployment and Distribution Command (MSDDC);

potential for On-Ramp capability to support Other Government Agencies (OGA’s).

• Current requirement: Enable MSDDC to fulfill its global mission by providing strategic seaport services encompassing five area Combatant Commands (COCOM) (i.e., Africa Command (AFRICOM), Central Command (CENTCOM), European Command (EUCOM), Indo-Pacific Command (INDOPACOM), & Southern Command (SOUTHCOM)). Secure full scale commercially contracted seaport operations and support (i.e., Stevedoring and Related Terminal Services (S&RTS)) within 30 calendar days’ notice at any designated seaport using primary and/or subcontracted stevedore services or related port tariff services common throughout the world.

QAULIFYING AS A SMALL BUSINESS

• North American Classification Industry System (NAICS) Codes

– U.S. Census Bureau

– Assigned by the Contracting Officer for the individual acquisition

– Classifying the product or service being acquired by one industry

– The NAICS code should best describe the principal purpose of the product or service being acquired

• Business Size Standard

– Assigned by the Small Business Administration (SBA)

– Criteria is either the company’s annual revenue (gross income) or by number of employees

• Designated criteria is listed on the SBA’s Table of Small Business Size Standards

– Office of Management and Budget

• Updated every five years

MARKET RESEARCH

• Federal Acquisition Regulation (FAR) Part 10, Market Research

• Applicability

– Before developing new requirements

– Before soliciting for offers when acquisitions have an estimated value in excess of the simplified acquisition threshold (SAT) or less than the SAT when adequate of information is not on hand

– If consolidation or bundling of requirements are involved (this is a particular concern for Small

Business concerns)

– Before awarding a task order under an Indefinite Delivery Indefinite Quantity (IDIQ) for other than commercial services in excess of the SAT

– An ongoing basis: for items such as checking commercial availability; identifying small business capabilities; and locating new entrants in Federal contracting

CERTIFICATES OF COMPETENCY AND DETERMINATION OF RESPONSIBILITY

• FAR Subpart 19.6, Certificates of Competency and Determinations of Responsibility

– If the Contracting Officer determines the apparent successful small business offeror is non-responsible

• Withhold contract award

• Refer the matter to the Small Business Administration’s (SBA) Area Director Office serving the offeror’s

Headquarter location

– The COC process applies to all acquisitions, full and open or set-asides, where performance is

CONUS or OCONUS

– SBA has 15 days to research, review, and formulate a determination. If 15 days is not sufficient time, SBA may make a request for an extension from the Contracting Officer

• What happens during the process

– SBA will contact the apparent successful small business offeror and advise the Contracting

Officer has determined the firm non-responsible

• Offer the firm the opportunity to apply for a COC

– After receipt of complete and acceptable application, SBA may elect to visit the facility

– SBA may review areas of responsibility not included as part of the Contracting Officer’s non-responsibility decision

– SBA has the authority to deny a COC for reasons other than what was originally determined by the

Contracting Officer

– If the Area Director determines a COC is warranted the Contracting Officer will be notified

• What happens during the process (contd)

– The Contracting Officer accepts the determination. SBA will issue the COC and documentation that substantiates the decision

– The Contracting Officer does not accept the determination and requests SBA to suspend the case

• The Contracting Officer is allowed time to review the documentation

• Allows the Contracting Officer to meet with the Area Director and resolve any issue the Contracting Officer may have about the determination

• Allows the Contracting Officer to submit information SBA may not have considered

• Allows the Contracting Officer to appeal the determination to SBA Headquarters

– If the COC is denied by SBA, then the Contracting Officer will award to the next offeror in line as the apparently successful offeror
