Questions and Responses

1. Q&A #10 indicates a restriction on subcontracting to 49% or less. This is normally only the case on a small business set-aside. Please verify the 49% cap and whether or not this is a small business set-aside.

Response: This requirement is not set-aside for small business, however, please see the following amendment to page 40, Evaluation Factors / Basis For Award in the attachment labeled "TFSACDFCI0001 (Amd 2)" and the amended response to question 10 below.

Amendment: Furthermore, preference will be given to a small business if technical and price are equal to that of a proposal submitted by an other than small business.

10) While a primary contractor would respond, would multiple CDEs be able to partner with the prime contractor as subcontractors?

Amended Response: A prime contractor may sub-contract a portion (49% or less) of the work with one or more parties in order to meet the requirements in Section 7.0 “Contractor and Key Personnel Qualifications” of the Performance Work Statement (PWS). Yes. A sub-contractor may be a CDE. Sub-contractors must also comply with Section 11 “Conflict of Interest” and Section 12 “Non-Disclosure “of the PWS.

2. Q&A #13 indicates that a large non-profit would not be precluded from bidding. Can you confirm that all qualified large businesses may participate?

Response: Yes, large businesses participate.
