About this file
This is an Addendum #1 document containing responses to bidder questions for Franklin County's RFB# 26-0727-2 regarding the procurement of Tarana Fixed Wireless and Microwave Equipment, Accessories, Licenses, and FCC Licensing Services for the Franklin County MIP3 Project in New York. The project requires delivery of equipment including 12 Tarana Base Nodes with 11 mounting kits, 50 Remote Nodes with first-year subscriptions, 10 active Aviat microwave radio terminals (with 4 spares), 10 microwave antennas (with 2 spares), and associated FCC coordination services across five working microwave links connecting Trout River, Stebbins, Burns Holden, Fort Covington, Little Briggs, and Mohawk Tower. All equipment must be delivered by September 1, 2026, with the County anticipating contract award within 30 days of sealed bid opening. The designated delivery location has a loading dock and will accept shipments directly from original equipment manufacturers provided each shipment is properly labeled and documented.
Bid guarantees and bid bonds are not required for this procurement. Unit pricing must remain fixed under contract unless justified by extenuating circumstances, though bidders are encouraged to disclose documented OEM lead times or allocation constraints for items unavailable by the September 1 deadline. Bidders should provide corrections to bill of materials inconsistencies and identify currently orderable OEM SKUs when part numbers conflict with written descriptions. The County will withhold 10 percent retainage from each invoice, with retainage released only upon delivery and acceptance of all bill of materials line items, issuance and validation of all licenses, and vendor delivery of closeout documentation. The Net 60 payment term begins upon receipt and acceptance of each individual shipment. Equipment must adhere to the Secure Networks Act requirements, with formal certificates of origin not required but manufacturer declarations acceptable. Standard OEM warranty and RMA procedures are acceptable, provided suppliers guarantee operational condition of shipped equipment and cover out-of-box failures or shipping damage.

Franklin County MIP3 RFB# 26-0727-2 Addendum #1 Reponses to Questions. 07/22/26
Bid Submission and Contract Timing
1. Please confirm whether a bid guarantee equal to 5% of the total bid price is required. Section 3.30 is marked “N/A,” while the Bid Submission Requirements and Bidder’s Checklist identify a 5% bid guarantee as a required submission. If required, please identify the acceptable forms of security and confirm whether a bid bond issued by an authorized surety is acceptable.
Response: Bid bond is not required for this RFB.
2. What is the County’s anticipated contract-award date and purchase-order issuance date?
Response: Expected award within 30 days of opening sealed bids.
3. Will a bid remain responsive if certain items cannot be delivered by September 1, 2026, because of documented OEM lead times or allocation constraints that are clearly disclosed in the bid?
Response: The ability to deliver materials within the allocated time frame will be weighed as part of the bid award determination. Bidders are encouraged to respond if some materials are on back log beyond your control.
4. Section 5(D) indicates that justified price increases may be presented to the County for approval, while Section 3.29 states that unit prices may not be increased. Please clarify whether any price-adjustment mechanism exists during the contract term and, if so, under what circumstances.
Response: Unit price needs to be maintained under contract unless justifiable under extenuating circumstances.
BOM Pricing, Part Numbers and Quantity Discrepancies
5. Please confirm whether bidders should price the BOM exactly as issued when quantities, descriptions or part numbers appear inconsistent, or whether bidders should identify proposed corrections in the Exceptions/Deviations section.
Response: Bidder should provide corrections as needed.
6. Where a manufacturer part number conflicts with the written product description, Section 3.27 states that the written description governs. Should bidders provide the currently orderable OEM SKU that meets the written description, even when that SKU differs from the part number listed in the BOM?
Response: Yes, identify original part number(s).
Tarana Equipment, Power and Licenses
7. Please confirm whether the correct quantity of Tarana Base Node mounting kits is 11 or 12, given that the BOM includes 12 Base Nodes but only 11 mounting kits.
Response: Typo should be twelve (12) for both.
8. Please provide or confirm the required Tarana Base Node subscription SKU, quantity and term for all 12 Base Nodes. The RFB requires a three-year BN management subscription, but a corresponding BN subscription does not appear to be clearly identified in the BOM.
Response: Base Node does not require a management subscription
9. Please confirm whether the intended Remote Node subscription term is 10 years per RN, requiring a quantity of 100 five-year subscriptions for the 50 Remote Nodes listed in the BOM.
Response: First year required for base bid, provide separate pricing per additional year
Microwave Equipment, Licenses, Antennas and FCC Services
11. Please reconcile the microwave equipment and FCC licensing quantities in the BOM with the written RFB. The BOM appears to include 14 microwave radio terminals and six FCC coordination-service line items, while portions of the RFB describe eight terminals across four paths. Please confirm the final number of microwave terminals, paths and FCC coordination/license applications that bidders should price.
Response: The intent is to have 5 working links: Trout River to Stebbins, Trout River to Burns Holden, Tout River to Fort Covington, Burns Holden to Little Briggs and Fort Covington to the Mohawk tower with (1) 80Ghz/11Ghz H, (1) 80Ghz/11Ghz L,
(1) 80Ghz/18Ghz H and (1) 80Ghz/18Ghz L spare radios.
12. The BOM lists 10 Aviat base and feature licenses despite listing 14 microwave radio terminals. Please confirm the correct license quantities and identify which terminals require each base, capacity or feature license.
Response: (4) Aviat radios will be spares. Provide necessary license (unless the licensing is transferable)
13. The BOM lists 12 microwave antennas despite listing 14 microwave radio terminals. Please confirm whether 12 antennas is the intended quantity and identify any terminals that do not require a separately supplied antenna.
Response: There will be 10 active Aviat radios with corresponding antennas: (3) Trout River, (1) Stebbins, (2) Burns Holden, (1) Little Briggs, (2) Fort Covington and
(1) Mohawk Tower. There will be (1) spare 80Ghz/11Ghz antenna and (1) spare 80Ghz/18Ghz antenna.
Delivery, Inspection and Invoicing
15. Please confirm whether the County’s 30-day inspection and acceptance period begins separately for each individual shipment or only after all equipment under the contract has been delivered.
Response: Per section 3.34 of the RFB# 26-0727-2, Airosmith and Hudson Valley Wireless shall have thirty (30) days from date of each delivery. Acceptance of a delivery shall not waive any of the County's rights with respect to defects or non-conformance discovered later, including during installation, turn-up, or warranty inspection.
16. At what point is an invoice considered received for purposes of the Net 60 payment term: upon equipment delivery, upon County acceptance, or upon the County’s receipt of an invoice submitted after acceptance?
Response: Upon receipt and acceptance of each individual shipment.
17. Please clarify whether the 10% retainage applies to software licenses, FCC filing fees, completed FCC coordination services and separately accepted partial shipments. Please also confirm whether retainage may be released by completed shipment, project portion or contract lot rather than only after completion of the entire contract.
Response: Per section 3.29 g. The County shall withhold ten percent (10%) retainage from each invoice; retainage shall be released upon (i) delivery and County acceptance of all line items on the Bill of Materials, (ii) issuance and County validation of all licenses, and (iii) Vendor's delivery of close-out documentation under Section 3.36.
18. May equipment be shipped directly from multiple OEMs to the County’s designated delivery point, provided that each shipment is properly labeled, documented and coordinated in accordance with the RFB?
Response: Franklin County will accept shipments directly from the OEMs. The responding bidder will be responsible for quantities and condition of parts shipped.
19. Please confirm whether the designated delivery location has a loading dock, forklift or other equipment capable of unloading standard pallets. If not, please identify the unloading equipment the vendor will be expected to provide.
Response: Yes there is a loading dock, we will work with the supplier on deliveries.
Country of Origin, Certificates and Sourcing Compliance
20. Will a manufacturer-issued country-of-origin declaration or a country-of-origin statement on a commercial invoice satisfy the documentation requirement, or is a formal certificate of origin required for each individual BOM line item?
Response: Formal certificate of origin is not required, manufacture declaration is acceptable.
21. Are manufacturer certificates of conformity required for every accessory, cable and consumable, or only for active electronic equipment and other products for which manufacturers customarily issue such certificates?
Response: Certificate only for active electronic equipment and other products for which certificates are normally issued.
22. Please clarify the prohibition against equipment or services sourced from entities “owned or controlled” by the government of the People’s Republic of China.
Specifically, please identify the applicable standard, list or certification bidders should use to determine compliance.
Response: The project is not subject to BABA, however precautions will be made to ensure equipment supplied will adhere to the Secure Networks Act See https://www.fcc.gov/supplychain/coveredlist. Example: Huawei Technologies Company and ZTE.
23. If a standard commercial product contains incidental components manufactured in China but the finished product is not manufactured, supplied or branded by a prohibited entity, will that product be acceptable under the RFB?
Response: See response to question 22.
Warranty and RMA Requirements
24. Will the County accept standard OEM warranty and RMA procedures, including the OEM’s determination of whether a product will be repaired or replaced and replacement timelines that are subject to product availability? Alternatively, must the vendor independently guarantee replacement or refund within 15 business days regardless of the OEM’s standard procedures or available inventory?
Response: The supplier must guarantee the equipment shipped will be operational.
Suppliers will guarantee out-of-box failures or damage caused by shipping. Failures during warranty period will be covered by OEM warranty.
