Bid Solicitation #20DPP00492 T2890 Residential Re-Entry Programming & Services - NJSPB
Answers to Questions
Where applicable, each question references the appropriate Bid Solicitation section.
#
Bid Solicitation
Section Reference Question (Bolded) and Answer
1.1 Purpose and Intent
A) In an effort to submit the most cost-conscious and accurate Quote, please provide the current budget for the services requested in this Bid Solicitation?
This information is not available at this time.
B) Please identify any budget constraints the NJSPB is facing this current fiscal year and any anticipated constraints for the contract term.
The State cannot comment with respect to the funding for each Fiscal Year, as it is contingent upon funding provided via the Annual Appropriations Act.
C) Please provide the total budget for the beds requested in this Bid Solicitation for the fiscal years of the ensuing contract term.
This information is not available at this time.

1.1.1 Geographical Regions & 1.1.2 Bed Quantities
Camden County is identified as a Southern County, however Cape May County is not in 1.1.2 Bed Quantities, Cape May County is included as part of the Southern region for PROMISE but Camden County is not. Can the provider assume that this is a typographical error and that Cape May is included in the Southern region in 1.1.1 Geographical Regions and that Camden County is also included as part of the Southern Region assigned to PROMISE bed quantity in 1.1.2 Bed Quantities?
These Sections have been revised. Please refer to section 1.1.1 and 1.1.2 of the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 020320”.
3
1.1.2 Bed Quantities
A) Please provide the most recent daily census figures for each of the three Programs, broken down by geographic region and gender.
Please see the attached Program Census January-October 2019, entitled “T2890 Attachment #2 020320”, and
B) Please provide the current and average census over the preceding 12 months for each program in each region broken down by gender.
Please refer to the answer provided above for part A of this question.
C) The statewide average daily census of the RESAP and STEPS programs have declined for each of the past 3 years. Today the census is less than 50% of the beds that the NJSPB is seeking. Also, despite the continued low bed utilization rates, this Bid Solicitation requests 100+ more beds than are contracted today. Since vendors rely on the estimated number of beds for each program to reflect the agency’s needs, when the agency’s utilization of beds is substantially lower than anticipated it can cause programs to not be operationally and financially sustainable. Please consider reducing the number of beds for the RESAP and STEPS program so that they are more in line with the NJSPBs needs.
The estimated number of beds provided in Bid Solicitation Section 1.1.2 represent the State’s current needs, and do not represent a minimum or maximum quantity of beds that will be awarded for any of the Programs. Please refer to Section 1.1.2 of the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 020320” for updated information.
4
1.1.2 Bed Quantities
A) This section states, However, the State will not be bound by any minimum or maximum quantities, as these numbers may change depending upon Offender participation. This section also provides estimates of 448 RESAP beds, 326 STEPS beds and 50 PROMISE beds statewide. Can the Parole Board provide the most recent daily census figures for each of the three Programs, broken down by geographic region?
As of the December 2, 2019 residential program census, there were 209 Offenders housed in the Northern Region, 70 Offenders housed in the Central Region and 123 Offenders housed in the Southern Region.
B) While the RFP says that the State makes no guarantee of any minimum or maximum population level at any vendor facility, will the State consider lowering the requested number of beds to reflect current bed usage by the NJSPB? This will provide the vendor with the opportunity to submit a more accurate and competitive bid.
Please refer to the response provided for Part C of question #3.
C) Based on the statement by the State that the number of beds may change during the contract period, will the State be willing to accept an alternate pricing method instead of using per diems?
The State does not accept this proposed modification.
D) Alternate pricing methods could include: A tiered pricing system whereby per diems would vary according census levels in the facilities; A combination of per diems and fixed fees; that is, where the vendor would receive a set fee for a certain number of beds and a per diem for beds over and above that number (The NJ Parole Board uses a similar method to fund the Community Resource Centers (CRCs)
The State does not accept this proposed modification.
5
1.2.4.1 Target Population & Program Size
RFP indicates that the NJSPB is interested in expanding PROMISE to central and northern counties. Does this mean that the NJSPB will consider expanding the current 50-bed allocation of PROMISE to accommodate the proposed PROMISE beds in Central and Northern New Jersey counties, or will the existing 50-bed allocation just be spread all across the state within the collective three regions?
The existing bed count for PROMISE has been revised to reflect 100 beds. If feasible, the 100-bed allocation will be spread across the three (3) collective regions. However, pursuant to Section 1.1 of the Bid Solicitation, the State reserves the right to award fewer than the quantity of beds identified in Section 1.1.2 of the Bid Solicitation. Please refer to the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 020320” for additional information.
6
1.4.4 Contents of Quote
If a vendor deems sections of the Quote proprietary or confidential, please confirm the vendor may deliver one redacted hardcopy and digital copy along with their original submission if the vendor elects not to submit the Quote through NJSTART.
Yes, if a Vendor {Bidder} deems sections of its Quote proprietary or confidential, a redacted hardcopy and digital copy may be submitted along with the original Quote submission, even if the Vendor {Bidder} elects not to submit the Quote through NJSTART.
7
1.4.5 Announcement of Quote Information
Please identify the location, address, and time where the announcement of vendor names and addresses will occur.
The location and address is as follows: 33 West State Street, 9th Floor Bid Room, Trenton, NJ. The time will be 2:00 p.m. on the day the Quotes are due. Please refer to the cover page of the Bid Solicitation and Section 1.4.5 for additional information.

Section 3.3
Vendor {Contractor} Requirements For All Programs #4:
Please clarify if the STEPS and RESAP residents are permitted to comingle with each other during programming modules.
The STEPS and RESAP residents are permitted to comingle with each other only with respect to non-clinical groups.
9
Section 3.4.2 Licenses, Also sections 3.23.4.1, 3.24.2, 3.25.1
A) The requirement to obtain an Outpatient Substance Use Disorder Treatment License for each facility presents several issues and is quite costly. In addition to the fact that these are residential programs, not outpatient programs, the requirements for licensure set forth in N.J.A.C. 10:161B in many cases conflict with the requirements set forth in the RFP. Staffing requirements, group counseling ratios, admissions policies, clinical records, etc. differ from the requirements of the RFP. Can you confirm that an DMHAS Outpatient License will be required for the Parole Residential Programs that are the subject of this RFP?
An Outpatient Substance Use Disorder Treatment License issued by the New Jersey Department of Health, Office of Certificate of Need and Licensing, will be required for the RESAP and PROMISE Programs, only when the licensure requirements become available and are fully approved by the New Jersey Department of Health (NJDOH). The NJSPB, with advisement from the NJDOH, will notify Vendors {Contractors} when licensure becomes available. A license is not required for the STEPS Program. Please refer to Section 3.4.2 of the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 020320”, for additional information regarding the Outpatient Substance Use Disorder Treatment License.
B) If so, can the Parole Board provide guidance to bidders as to how the differences in the requirements of the RFP and the Outpatient regulations will be resolved? (It should be noted that the Department of Health, Office of Licensing offers conditional Outpatient licenses, which eliminate many of the requirements of 161B, to NJDOC community release residential facilities under the terms of N.J.A.C 10:161B-2.7 when the purposes and intent of the proposed facility are outside the scope of a regular license and if OOL determines that it is in the best interest of the clients benefiting from the treatment facility in question and in order to preserve and/or improve the proper functioning of the facility.)
The NJSPB and the NJDOH, Office of Certificate of Need and Licensing are collaborating regarding licensure standards for Outpatient Substance Use Disorder Treatment. Please refer to Section 3.4.2 of the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 020320”
10
3.4.2 Licenses
A) Since Residential Re-Entry Programing & Services are residential in nature, not outpatient programs, the requirements for licensure set forth in N.J.A.C. 10:161B do not align with the requirements set forth in the Bid Solicitation. Please consider removing the DMHAS Outpatient License requirement.
The State does not accept this proposed modification.
B) If the Outpatient License requirement remains in force, which may be costly to implement, please confirm vendors may secure a conditional Outpatient license.
The Vendor {Contractor} shall be expected to comply with Section 3.4.2 of the revised Bid Solicitation. Please refer to the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 020320” for licensing requirements.
11
3.4.1 Accreditation
Please confirm that a vendor is only required to obtain a certification of accreditation from either ACA or CARF, not both.
Either ACA or CARF accreditation is required, not both. Please refer to Section 3.4.1 of the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 020320.
12
Section 3.5 Housing And Facility Requirements
Please clarify if STEPS and RESAP residents are permitted to be housed with each other.
Yes, STEPS and RESAP residents may be housed with each other, provided that male and female Offenders are housed separately. Please refer to Section 3.5 of the Bid Solicitation for Housing and Facility Requirements.
13
3.5 Housing and Facility Requirements
If an agreement with another supervising agency was made for the co-location of female residents within an acceptable sight and sound separate living arrangement, please confirm the NJSPB allow a vendor to house female NJSPB, AOC, or JJC offenders in the same housing unit with female offenders from a different referring agency.
The State is not able to answer this question without knowing the specific details of the proposed agreement with another supervising agency.
14
Section 3.14.1, Non-Emergency Medical Services
The vendor shall provide non-emergency medical procedures. Please define what is meant by non-emergency medical services and can you provide examples of such?
Non-emergency medical services do not pose an immediate risk to an Offender’s physical or mental health. Please refer to Section 2.3 and 3.14.2(3) of the revised Bid Solicitation, entitled “T2890 Revised Bid Solicitation 020320” for examples of emergency and non-emergency medical services.
15
3.14.1 Non-Emergency Medical Services
Physicians are licensed to prescribe and dispense MAT medications to the residents through properly trained medical staff. Physician licenses have a capacity to prescribe MAT treatment to only 30 patients within the first year, with an option to appeal to increase the ability to treat 100 patients for the ensuing years. Since there is no guarantee related to the appeal process and in an effort to avoid pricing the high cost of additional doctor expenses, please confirm a vendor can propose a cap of 30 MAT residents per facility.
This is a business decision to be made by the Vendor {Bidder}, not the State. Pursuant to Section 1.1 of the Bid Solicitation, the Vendor {Bidder} is not required to submit a Quote for all of the requested beds, a Vendor {Bidder} may submit a Quote for any quantity of beds it has available.
16
3.14.1 Non-Emergency Medical Services
A) Please define non-emergency medical services and provide examples of the services a vendor is expected to provide.
Please refer to the answer provided for question #14.
B) Please specify who is financially responsible for the costs of the medications, including buprenorphine, naltrexone, and methadone, as these medications are expensive and could substantially increase a vendors per diem if held financially responsible.
Pursuant to Bid Solicitation Section 3.17 Healthcare Enrollment, which has been revised for clarity, the Vendor {Contractor} shall assist the Offender with enrollment in Medicaid or affordable healthcare. The Offender is responsible for the cost of medication only if they have Medicaid, Medicare or private health insurance and the medications are reimbursable via their health insurance plan. If not, the Vendor {Contractor} is responsible for the costs of all prescribed medication. Please refer to Section 3.2 of the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 020320”.
C) By law, methadone can only be dispensed through an opioid treatment program (OTP) certified by Substance Abuse and Mental Health Service Administration (SAMHSA). Please confirm a vendor may transport and refer offenders to a community-based resource for the provision of methadone.
This is confirmed.
D) Please confirm a vendor can propose a cap on the number of methadone resident referrals based on the capabilities of the local clinics.
This is confirmed.
17
3.14.2 Emergency and/or Offsite Medical Services
A) In the event an offender is transported from a vendor’s facility by ambulance, please specify the financially responsible party for handling ambulance transportation expense.
The Offender is financially responsible for ambulance transportation expenses.
B) Please confirm that the vendor is not financially responsible for the cost of emergency and offsite medical services.
The Vendor {Contractor} is not responsible for bearing the cost of emergency and offsite medical services.
18
3.14.2 Emergency and/or Offsite Medical Services
A) Please specify who is financially responsible for offender medical, mental health, and dental services that are provided outside of a vendor’s facility.
Each Offender is financially responsible for any medical, mental health and dental services that are provided outside of the Vendor’s {Contractor’s} facility.
B) Please confirm NJSPB will assume the cost for residents once hospitalized at a local community hospital.
If an Offender is hospitalized, then the financial responsibility for these costs lies with the Offender, not the State.
19
3.14.2 Emergency and/or Offsite Medical Services
Please confirm NJSPB will assume supervision and financial responsibility for the offender after the 5th hour of hospitalization.
The NJSPB will assume supervision; however, as stated in the response provided for part A and B of question #18, financial responsibility lies with the Offender, not the State.
20
3.19 Cellular Phones
A) Please confirm that a vendor is expected to include the cost of the cellular phone, GPS tracking technology, and network service provider agreement within the per diem rates listed on the Price Sheet/Schedule.
The determination of whether or not to include any costs in the Firm-Fixed Per Diem Rate is a business decision made by the Vendor {Bidder}. However, no additional charges will be paid or permitted, unless there is a change in the Scope of Work, that has been approved by the Director. Please refer to Bid Solicitation Sections 2.3, 3.2 and 3.19, of the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 020320” for additional information.
B) Please expand on the expectations of GPS tracking that vendors are to provide. For instance, please identify what NJSPB will do with the location point and how often the phone is expected to relay a GPS location.
To obtain confirmation of the Offender’s compliance with an approved off-site pass, including any Offender deviations of approved paths. The GPS location relay shall be in accordance with the length and location of the destination of the approved pass.
C) Please confirm parolees will only be issued a cellular phone upon exiting the facility for employment, court appearances, medical appointment, etc., and returned to vendor on arrival.
The Vendor {Contractor} shall issue a cellular telephone to every Offender permitted to conduct unescorted or permissible activities outside of the Facility. Please refer to Section 3.19 of the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation” for additional information.
D) Please confirm cellular phones are only to be provided to STEPS, RESAP, and PROMISE residents who leave the facility for approved activities.
Please refer to the response provided above for part C of this question.
E) Please confirm cellular phones would not be issued to residents who the vendor drives to and from their place of employment.
Please refer to the response provided above for part C of this question.
F) Please confirm cellular phones which allow video-conferencing and automated check-ins will be permitted by NJSPB.
This is not confirmed nor is it permitted. Please refer to Section 3.19 of the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 012020”.
G) Please provide an estimate of how many pre-determined phone numbers would be allowed on a single phone.
There are no estimated pre-determined phone numbers that would be permitted. Pursuant to Bid Solicitation Section 3.19, the NJSPB and the Vendor {Contractor} establish pre-determined programmed phone numbers. Please refer to Section 3.19 of the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 012020” for additional information.
H) Please confirm the NJSPB is seeking a solution that:
I. promotes offender accountability;
II. enhances Parole Officer and Reentry Personnel supervision activities; and III. improves public safety by issuing cellular phones to offenders where their location is continuously monitored, direct communication with authorized contacts is facilitated, and compliance with appointments or work schedules is verified.
This is confirmed.
I) Please confirm a vendor can satisfy this requirement by offering a phone that biometrically verifies offender identity, collects GPS points, and prompts offenders to report any interruptions related to their terms of supervision.
No, this is not confirmed. Please refer to Section 3.19 of the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 020320 for Cellular Phone requirements.
21
3.19 Cellular Phones
In addition to periodically knowing the location of a resident, there are technologies that have been developed specifically for populations similar to parolees that the agency may want to consider requiring as part of this RFP. Listed below are some examples of enhancements that NJSPB may want to consider adding as a requirement: (1) Biometric facial recognition that captures GPS Points during check-ins at a predetermined location. (2)Push notifications for appointments and other meetings as reminders to residents. (3)Ability for residents to share documents and to text message with the vendor. (4) Communication via video-conferencing between the offender and supervisory personnel.
These items are not required by the Bid Solicitation.
22
Section 3.20 Transportation Services
Please confirm that transportation services related to the employment of work release Offenders are not the responsibility of the Vendor.
The Vendor {Contractor} shall provide Offenders with transportation to employment assignments until such time that the Offender is able to contribute towards the cost of transportation. Please refer to Section 3.20 of the revised Bid Solicitation entitled, “T2890 Revised Bid Solicitation 020320”.
23
3.20 Transportation Services
A) Please confirm that vendors are not required to provide transportation services for offenders on work release.
Please refer to the answer provided for question #22.
B) Please consider revising this requirement to allow a vendor to provide bus passes in lieu of transportation.
Bus passes are not permitted and shall not to be issued in lieu of transportation. Please refer to the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 020320”.
C) Please specify if a vendor would be permitted to utilize a ride-share service, such as Uber or Lyft, to provide private transportation for offenders to non-emergency medical treatment, medical appointments, recreational activities, etc.
No this is not permissible. Please refer to the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 020320.
24
3.22.2 Program Orientation
The RFP states in numeric #1 that it shall not permit any off-site passes, with the exception of emergent medical needs, without the prior written approval of the NJSPB during the 14-calendar day program orientation. Existing practice includes staff escorted off-site passes during orientation to either the local FQHC or Board of Social Services to effectuate immediate registration with medical insurance for the client to ensure coverage for healthcare and medication, including MAT medication. Are providers approved to include staff escorted passes during orientation to effectuate client health insurance for clients, or would this weekly trip need weekly NJSPB approval?
No off-site passes are permitted, except in emergent medical needs, without the prior written approval of the NJSPB during the 14-day calendar day program orientation.
25
3.23.3 Individual, Group and Family Interventions
Please specify if parenting is required for offenders that are not parents and if domestic violence education is required for those without a history of domestic violence.
Yes, parenting is required for all Offenders, even those that are not parents. Domestic violence education is required for all Supervised Offenders.
26
3.23.4 Substance Use Disorder Prevention, Education, Counseling and Supportive Services
A)Please consider allowing a vendor to hold group counseling sessions that are limited to 25 offenders per session so Case Managers can hold groups with their entire caseload.
The State does not accept this proposed modification.
B) As the CADC, LADC, LPC, BSW, MSW, and LCSW credentials are a new service requirement and will increase expenses associated with staffing, please consider revising to allow vendor staff to conduct groups without such credentials, as long as they are supervised by and report to licensed or certified personnel.
The State does not accept this proposed modification.
27
3.23.7 Computer Supported Educational and Vocational Programs
If a vendor provides distance learning to offenders, please specify wo will be responsible for paying the school that offers the curriculum or virtual classroom.
This cost is the responsibility of the Vendor {Contractor}. Please refer to Section 3.23.7 of the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 020320”.
28
Section 3.23.4.1
Please confirm that the Contractor/Vendor must obtain an Outpatient Substance Use Disorder License for the STEPS program.
Please refer to the response provided for part A of question #9.
29
3.23.9 Work Release
A) Please define at all times
In the context of work release, at all times means a Vendor {Contractor} has a firm understanding of the location of each Supervised Offender from the moment the Supervised Offender departs from the Vendor’s {Contractor’s} facility until they return to the Vendor’s {Contractor’s} facility.
B) GPS ankle monitors would be required for vendors to continuously and reliably know where offenders are at all times (vs on an as needed/checked basis). Does the State expect vendors to equip each offender on Work Release with a GPS ankle monitor during their time in the community?
GPS ankle monitors are not permitted.
30
Section 3.23.14 Discharge Planning
This section requires that the vendor address the following (#12) Prescription medication to insure that at the time of program discharge or transfer to another contracted program, each Offender on prescription medication has sufficient medication to last a minimum of 30 calendar days and has an appointment scheduled with an identified medical professional, to include contact phone number for additional prescriptions. Is the Parole Board requiring the vendor to bear the cost of 30-day supplies of medications for discharged Offenders? This may significantly increase the per diems due to the increasing, unpredictable cost of medications.
Pursuant to Section 3.17 of the Bid Solicitation, which has been revised for clarity, the Vendor’s {Contractor’s} duties include assisting the Offender in obtaining Health Benefits or verifying existing Health Benefits If an Offender has no health insurance, at the time of discharge or transfer, the Vendor {Contractor} shall bear the cost of the 30-day supply of medication. Please refer to the revised Bid Solicitation entitled T2890 Revised Bid Solicitation 020320” for additional information.
3.23.14 Discharge Planning
A) Please confirm NJSPB requires the vendor to bear the cost of 30-day supplies of medications for discharged offenders.
Please refer to the answer provided for Question #30.
B) If yes, please advise if vendors may purchase medications through New Jersey’s pharmacy program, which may provide better pricing due to bulk purchasing pricing that NJSPB may be receiving.
The State is unable to answer this question as posed.
C) If so, please provide medication pricing information for Suboxone, Metformin, NovoLog, etc.
The State is unable to answer this question as posed.

3.24.1 Symptomatic Support Unit
Medical monitoring during withdraw is synonymous with detoxification which is a level of care we are not licensed to provide, and would bring legal liability issues for programs not licensed to provide detoxification services in the State of New Jersey. Can the funder clarify that the provision of a symptomatic support unit is not a mandatory contract requirement, and note that applicants will not be penalized if their plan does not include a symptomatic support unit?
The provision of a Symptomatic Support Unit is not a mandatory requirement. Please refer to Section 3.24.1 of the Bid Solicitation.

Symptomatic Support Unit also Section 4.4.3.2
If a vendor proposes an SSU as part of its RESAP proposal, can the vendor propose a separate per diem for the provision of these services, which are more intensive and significantly more expensive than normal RESAP services Otherwise, the high cost of providing SSU beds could result in inflating the cost of regular RESAP beds?

3.24.2 Out-Patient Substance Use Disorder Treatment License
A)The RFP requires providers to obtain a DMHAS license for out-patient level of care services. Is it expected that all substance use services are provided by the staff on the DMHAS-license and for all clients.
The Bid Solicitation has been revised to reflect that only RESAP and PROMISE residents are required to participate in licensed substance use treatment services provided by the Vendor {Contractor}. Please refer to the revised Bid Solicitation entitled “T2890 Revised Bid Solicitation 020320”.

59
4.4.5.2 State-Supplied Price Sheet Instructions
The statewide average daily census of the RESAP and STEPS programs have declined for each of the past 3 years, and today the census is less than 50% of the estimated beds that the State is seeking in the current Bid Solicitation. Service providers rely on the estimated number of beds for each program to reflect the States needs and when the agency’s utilization of beds is substantially lower, it can cause programs to not be sustainable operationally or financially. Given that the estimated beds do not appear to be reflective of the State’s needs, it can have the impact of higher Vendor prices to account for the likelihood and risk of many beds being vacant and the operational costs associated with vacant beds. Aligning the estimated beds more closely with the States needs may result in much lower per diem pricing for the State. To provide vendors with more certainty that the awarded beds are aligned with anticipated utilization, please consider adjusting the estimated beds downwards so that vendors can provide NJSPB with the most cost-effective pricing.
60
4.4.5.2 State-Supplied Price Sheet Instructions
