About this file

This document is a Bid Amendment (Addendum) #1 issued by the New Jersey Department of the Treasury, Division of Purchase and Property, for Bid Solicitation (RFP) #17DPP00114 for T-2760 OEM Automotive Parts for Light Duty Vehicles (Class 4 or Lower, 15,000 lb. GVWR or Less). The Bid Solicitation is open to all interested vendors, with a quote (proposal) submission due date of April 21, 2017 at 2:00 p.m. ET. The contract will serve the State of New Jersey as well as Mercer County and Trenton City.

The Bid Amendment addresses questions received and provides clarification on pricing terms. Specifically, it states that the State will not revise the specification to require only cost plus pricing, and will allow both cost plus and retail minus pricing to be submitted. The Amendment also provides guidance on how the State will evaluate and compare pricing submissions from vendors using different manufacturer price lists. Additionally, it addresses how the State will accept pricing information from manufacturers that do not provide pre-printed price lists, allowing for electronic or letter-based submissions.

4.4.5.2 and 6.6
I applaud the decision to offer cost plus pricing. I feel this simplifies and benefits all parties involved. However I do believe also allowing retail minus pricing adds confusion where there doesn't need to be any. When the state analyzes one party offering cost plus against another party offering retail minus it's not an apples to apples comparison. Too much gray area. It needs to be one or the other. Cost plus is the most logical solution. It keeps the playing field level and there cannot be any dispute when the contracts are awarded.

The specification will not be revised.

Sections 4.4.5.2 and 6.6 of the Bid Solicitation {RFP} state: “In a situation where different Vendors {Bidders} have quoted based upon different types of manufacturer’s price lists for the same brand (for example, retail, wholesale, jobber and invoice) the State will evaluate each of the Vendors’ {Bidders’} submissions by conducting a comparison, which will consist of choosing a market basket of the same ten (10) items from each Vendor’s {Bidder’s} price list submission and applying the % discount or markup bid. The Quotes {Proposals} will be ranked based on the lowest combined pricing for the items selected. The method for selecting the market basket will be set prior to Quote {Proposal} opening and will not be revealed to Vendors {Bidders} until time of award.”

General motors currently does not have a complete price schedule on their parts as their pricing now goes through a third party web based pricing system to receive list pricing. Their price tape have zero pricing what would be needed for this situation.

As stated in Section 4.4.3.2.1, “The State will accept a Quote {Proposal}, as a valid Quote {Proposal} for the brand bid, from dealers of all those manufacturers that only supply all pricing information electronically to their dealers’ computer system, provided that a Quote {Proposal} includes a manufacturer’ certification that it does not make available its price lists in pre-printed, CD or downloadable/printable format. In addition, the manufacturer must certify the authenticity of the information submitted.”

Section 4.4.3.2.1 further states, “The Vendor {Bidder} can upload the price list as an attachment through NJSTART. If submitting a hard copy Quote {Proposal}, the price list can be submitted as a hard copy attachment or in the form of a CD or thumb drive in MS Excel, PDF or text format. If the manufacturer only offers its price list on CD, or in Excel file, or through e-mail, or published at a web site or computer-generated (electronically sent to its dealers’ computer system), the State will accept a CD or Excel file, provided that the Vendor {Bidder} submits the manufacturer’s certification that it does not make available any pre-printed price list and that it is only available in the format submitted.”

Further, Section 4.4.3.2.4 states: “If a manufacturer's price list is not published, then the manufacturer's prices listed on its letterhead, dated and with authorized signature are acceptable. The letter should include the Bid Solicitation {RFP} number and price line number.”
