Bid Amendment 6 Summary
This is Bid Amendment 6 to Bid Solicitation #26DPP01201 issued by the State of New Jersey Department of the Treasury, Division of Purchase and Property, for defined contribution retirement program administration services for the New Jersey State Employees Deferred Compensation Plan (NJSEDCP), a 457(b) governmental plan, and the New Jersey Defined Contribution Retirement Program (NJDCRP), a 401(a) plan. The amendment extends the quote submission due date from May 6, 2026, to May 13, 2026, at 2:00 p.m. Eastern Time. The amendment includes comprehensive responses to 75 bidder questions, additions of two exhibits (Exhibit 5—Asset Summary By Investment Option and Exhibit 6—Location And Participant Data), and revisions to multiple sections of the original solicitation including Purpose and Intent, Background, Pre-Quote Document Review, State-Supplied Price Sheet Instructions, Participant Educational Services, Participant Support Services, Investment Management Services, Security Plan, and Insurance requirements. An optional pre-quote conference was held on December 23, 2025, with Empower and Alight Solutions, LLC confirmed in attendance.
The amendment addresses critical operational and administrative details for the plans serving 163,987 total participants across both plans, with NJSEDCP containing 57,573 accounts with balances totaling $6.277 billion and NJDCRP containing 122,941 accounts with balances totaling $612.9 million as of June 30, 2025. Key requirements include provision of one dedicated on-site service representative and a minimum of ten field service representatives, daily accounting records, support for Spanish-language participants, and implementation of parallel testing for at least one month during conversion from the incumbent provider. The State anticipates a January 1, 2027, contract effective date for a single contractor serving both plans, with a base five-year contract term and options for two additional years. The amendment clarifies that all data must remain within the United States, all participant-facing support must be provided domestically, no self-directed brokerage options are permitted, and the current investment fund lineup will be maintained. Insurance requirements include professional liability and cyber liability coverage of at least $2,000,000 per claim, and the State rejected numerous bidder requests for modifications to standard terms and conditions while accepting limited changes to insurance notice provisions and worker's compensation language.

Quote Submission
Should I check that I have properly completed and attached all of the required documents with my submitted Quote?
Yes. Prior to the Quote Opening Deadline, a Bidder should review the documents comprising the submitted Quote to ensure that all of the required documents have been completed and attached. Oftentimes a Quote is deemed non-responsive because a Bidder fails to attach a required form or attaches a blank form. To review a submitted Quote, a Bidder should log into NJSTART and review each document attached to the Quote submission. Instructions on how to review a submitted Quote can be found in the Quick Reference Guide entitled How to Review a Submitted Quote, which is available on the NJSTART Vendor Support Page under Vendor Reference Guides.
3
Quote Submission
Please confirm a Bidder may deliver a hardcopy quote instead of submitting a response electronically.
Please be advised that all Quotes shall be submitted electronically through NJSTART.
4
Exceptions
Will the State allow Bidders to take exception to any of the Standard Terms and Conditions?
As stated in Bid Solicitation Section 2.2, Exceptions to the State of NJ Standard Terms and Conditions (SSTC): “Questions regarding the State of New Jersey Standard Terms and Conditions and exceptions to mandatory requirements MUST be posed during the Electronic Question and Answer period and shall contain the Bidder’s suggested changes and the reason(s) for the suggested change(s).” Moreover, as stated in Bid Solicitation Section 3.11, Bidder proposed terms or conditions that conflict with those contained in the State of New Jersey Standard Terms and Conditions may render a Quote non-responsive.

General
What is your fiscal year-end?
The State’s fiscal year ends on June 30th.
6
General
In addition to the information in the RFP, are there any areas of focus that may be of particular concern for you, or that have prompted the request for proposal, that would assist us in customizing our RFP response?
The State declines to identify or comment on any specific areas of concern or provide subjective feedback regarding the incumbent Contractor or prior performance.
The Bid Solicitation (RFP) was developed to meet the State’s current and anticipated business needs, and the Bidder is expected to rely solely on the criteria set forth in the Bid Solicitation when preparing its Quote.
The Bidder should provide the level of detail they determine necessary to assist the Evaluation Committee in its review of the Bidder's Quote.

2.2 Ownership Disclosure - To fulfill the alternative of an ownership disclosure form: The Bidder is the sole entity for which we report financial results. The Bidder is organized as a limited liability company under the laws of Illinois, is an indirect subsidiary of the Bidder. We confirm that at this time we are not aware of any person owning more than 10% of the Company.
This is not a question and cannot be answered as posed. However, the State does not accept any revision to the identified section of the Bid Solicitation.
A Bidder’s failure to submit the information required by N.J.S.A. 52:25-24.2 will result in the rejection of the Quote as non-responsive and preclude the award of a Contract to said Bidder.
Please refer to Revised Bid Solicitation Section 3.12.2, Ownership Disclosure Form, for additional information related to ownership disclosure requirements.

2.5 Affirmative Action - We currently don't have the Federal Letter of Approval, though we have used the federal program in the past. Unfortunately, there isn’t a federal program anymore as Executive Order 14173 (2025) rescinded previous mandates for race/sex-based AAPs, directing the Office of Federal Contract Compliance Programs (OFCCP) to stop related enforcement. Please confirm that still we need to complete the Affirmative Action Employee Information Report.
Yes, the intended Contractor and its named Subcontractor(s) must submit a copy of a New Jersey Certificate of Employee Information Report, or a copy of Federal Letter of Approval verifying it is operating under a federally approved or sanctioned Affirmative Action program. If the Contractor and/or its named Subcontractor(s) are not in possession of either a New Jersey Certificate of Employee Information Report or a Federal Letter of Approval, it/they must complete and submit the Affirmative Action Employee Information Report (AA-302). Information, instruction and the application are available at https://www.state.nj.us/treasury/contract_compliance/index.shtml.

Attachment 1 - Combined State of New Jersey Standard Terms and Conditions (06.03.2025)
6.1 Price Fluctuation During Contract - As a services provider, the Bidder does not believe a price protection provision is appropriate and is not acceptable. The Bidder’s policy is that every client deal should be independent of each other and are priced according to client's needs and preferences and so requiring some form of price protection is not aligned with the Bidder’s business model or services strategy.
This is not a question and cannot be answered as posed. However, the State does not accept any revision to the identified section. Every Bidder submitting a Quote agrees to the terms and conditions of the Bid Solicitation and any accompanying documents, however, not all Bid Solicitation terms and SSTCs are applicable to all Contracts. To the extent that Section 6.1 of the SSTCs is not currently applicable, it shall remain in case the Bid Solicitation is modified in the future pursuant to the process permitted under the Bid Solicitation.

This is not a question that can be answered as posed. The State of New Jersey Combined State Standard Terms and Conditions Section 9.2 does not contain a “4.3(B)” section. The State declines to limit any liability requirements, limits, or caps set forth in the Bid Solicitation, which shall remain in effect when applicable.

The State will retain ownership of its own data and information (participant data, plan provisions, trademarks, etc.) and will be granted a license to use the Bidder’s intellectual property (including any software licensed to the Bidder from third parties) for the term of the agreement. |

| 9.1(6) Background Checks - The Bidder proposes the following provision as a replacement: The Bidder’s background check varies globally, but in the US includes an SSN trace, a check of education credentials, a check of employment history (7 years), a credit check (where required for role), a criminal history check (10 years), a government watch/global sanctions and enforcement check, and a drug test. The requirements of SSTC Section 9 – Additions to the Standard Terms and Conditions for All Information Technology Contracts Which Includes Software as a Service (SAAS)/Cloud Solutions shall be in effect whenever applicable.
30
