About this file
This is a Questions and Answers document issued by the Delaware Department of Transportation regarding the Open End - Structure Maintenance contract for the Central District covering fiscal years 2027-2029 (Contract No. T202707502). The project encompasses furnishing all labor and materials for bridge repairs and maintenance across Kent County, including structure backfilling, guardrail replacement, crack sealing, drainage work, concrete repairs, and pavement markings. Work must be completed within 1,095 calendar days from a Notice to Proceed anticipated for approximately December 2, 2026. The primary itemized work under Item Number 801500 includes four typical traffic applications with specified quantities: 30 units of Application 10, 10 units of Application 3, 10 units of Application 3A, and 10 units of Application 33. Bidders must submit unit prices for each application type and a lump sum bid price for overall maintenance of traffic rehabilitation work. Bids were due September 29, 2026, with no pre-bid meeting scheduled.
Payment for work will be based on the quantity and price of each traffic application actually used during construction as listed on the breakout sheet at the unit prices bid for each application. The contract is state-funded, therefore Disadvantaged Business Enterprise (DBE) requirements do not apply. No price increases will be negotiated after each calendar year, contrary to historical practice. Prevailing wages under Delaware Department of Labor determinations apply, with flaggers bid at a minimum equal to the Laborer wage rate. A surety bond or security deposit equal to at least 10% of the bid amount is required. No retainage will be withheld unless triggered by the Performance-Based Rating System.

Q # Question Answer 4 Are there any DBE requirement goals in place for this project?
This is a State-funded contract; therefore, DBE requirements do not apply.
Monday, September 14, 2026 3 The contract duration is 1,095 days. The Department has historically included a provision to negotiate price increases after each calendar year. Will this be the case this time?
No.
2 The special provisions for Item 801500; Maintenance of Traffic, Rehabilitation indicate that temporary signs, drums, cones, arrow panels, and TMA's are to be included in the lump sum price. The proposal also contains separate pay items for these same devices.
Please confirm that payment for the devices will be made under the individual contract items (802003, 803001, 805001, 808002, and 810001) and not be considered incidental to the lump sum under Item 801500. If not, please advise what the individual items are to be used for since there are no plans or locations.
The TA's called out in the breakout sheets are the ones anticipated to be used. Any other TA's required will be covered by the individual contract items.
Q # Question Answer 1 Item 801500; Maintenance of Traffic, Rehabilitation is a LS item with a Breakout Sheet. The project is open-ended with no predetermined locations. The Breakout Sheet lists estimated quantities for four (4) different traffic applications that could be used.
Please confirm that payment will be based on the quantity/price of each TA actually used during construction as listed on the breakout sheet. If not, the breakout sheet quantities will not be related to the actual work and we will need the Department to advise what we are to base our pricing on since there are no plans or locations for us to determine
The price bid on breakout sheets for the TA's listed for each day are the prices that will be paid.
