About this file

This is a Questions and Answers document issued by the Delaware Department of Transportation regarding Project T202707502, an open-end structure maintenance contract for the Central District covering fiscal years 2027-2029. The project encompasses furnishing all labor and materials for comprehensive bridge repairs and maintenance across Kent County, including structure backfilling, guardrail and fencing work, sealant applications, drainage improvements, structural repairs, and pavement markings. The primary work under Item Number 801500 involves four typical traffic applications with specified quantities: 30 units of Application 10, 10 units of Application 3, 10 units of Application 3A, and 10 units of Application 33. Bids were due September 29, 2026 at 2:00 p.m. Local Time. The work must be completed within 1,095 calendar days from a Notice to Proceed anticipated for approximately December 2, 2026, with no provision for annual price increase negotiations included in the contract.

The Questions and Answers document clarifies critical pricing and payment terms for bidders. Payment for temporary traffic control devices—including signs, drums, cones, arrow panels, and traffic management devices—will be made under individual contract items based on actual quantities used during construction, rather than being incidental to the lump sum Item 801500 price. Bidders must submit unit prices for each of the four specified traffic applications listed on the required breakout sheets, with payment calculated based on the actual quantity of each application type used. Any additional traffic management applications beyond those anticipated on the breakout sheets will be covered by the individual contract items. Prevailing wages under Delaware Department of Labor determinations apply, and bidders must register through SimpliGov and submit breakout sheets to avoid rejection as non-responsive. A surety bond or security deposit equal to at least 10% of the bid amount is required.

Project Title: OPEN END - STRUCTURE MAINTENANCE, CENTRAL DISTRICT, FY27 - 29

Q # Question Answer 3 The contract duration is 1,095 days. The Department has historically included a provision to negotiate price increases after each calendar year. Will this be the case this time?

No.

2 The special provisions for Item 801500; Maintenance of Traffic, Rehabilitation indicate that temporary signs, drums, cones, arrow panels, and TMA's are to be included in the lump sum price. The proposal also contains separate pay items for these same devices.

Please confirm that payment for the devices will be made under the individual contract items (802003, 803001, 805001, 808002, and 810001) and not be considered incidental to the lump sum under Item 801500. If not, please advise what the individual items are to be used for since there are no plans or locations.

The TA's called out in the breakout sheets are the ones anticipated to be used. Any other TA's required will be covered by the individual contract items.

1 Item 801500; Maintenance of Traffic, Rehabilitation is a LS item with a Breakout Sheet. The project is open-ended with no predetermined locations. The Breakout Sheet lists estimated quantities for four (4) different traffic applications that could be used.

(Question continues on next page)

The price bid on breakout sheets for the TA's listed for each day are the prices that will be paid.

Please confirm that payment will be based on the quantity/price of each TA actually used during construction as listed on the breakout sheet. If not, the breakout sheet quantities will not be related to the actual work and we will need the Department to advise what we are to base our pricing on since there are no plans or locations for us to determine
