About this file

This is a Questions and Answers document issued by the Delaware Department of Transportation regarding Project T202703201, an Open End Central Transportation Fund (CTF) Projects contract for central Delaware covering fiscal years 2026 through 2029. The contract encompasses road improvements in Kent County, including clearing and grubbing, ditching, tree removal, bituminous pavement, fog seal, speed humps, reinforced concrete pipe drainage, drainage inlets, Portland cement concrete curb and sidewalk, pedestrian connections, riprap, and pavement markings. As an open-end contract, the specific number and locations of projects are unknown at the time of bidding, as project locations are dictated by requests from legislators and may occur in subdivisions or on major highways such as Route 13. All work must be completed within 1,095 calendar days from the Notice to Proceed anticipated for November 9, 2026, with bids due September 1, 2026 at 2:00 p.m. local time.

Key clarifications addressed in the Questions and Answers include confirmation that prevailing wage requirements and flagger rates do not apply to this contract, despite references in the General Description Section J that will be removed via addendum. For items with unknown depths due to the open-end nature of the contract (including items 601011, 601012, 602001, 602002, 602003, 602005, 602011, and 602031), bidders are advised to use standard depths based on industry practice. Lump sum Item 801500 will not be adjusted if actual quantities increase or decrease from estimated amounts shown on the breakout sheet. Bidders must submit breakout sheets with their proposals; failure to do so results in rejection as non-responsive. A surety bond or security deposit equal to at least 10 percent of the bid amount is required, and contractors with a performance rating below 85 percent must execute an Agreement to Accept Retainage as a condition of bid acceptance.

Questions and Answers

Project Number: T202703201

Project Title: OPEN END - CTF PROJECTS, CENTRAL, FY 26 - 29

Posted to Web Site: Wednesday, August 19, 2026

Q # Question Answer 5 Are these projects happening in subdivisions or out on Route 13 on major highways?

The locations are dictated by requests from Legislators. While they are primarily in subdivisions, they could be in any public use area.

4 How may locations will there be?

This is an Open End Contract. The amount of locations is unknown at this time.

3 Item 801500 is a lump sum item; however, the Breakout Sheet includes estimated quantities for specific Typical Applications. If the actual quantities increase or decrease from those shown, will the lump sum price be adjusted?

No.

2 How deep are the following item numbers:

601011 601012 602001 602002 602003 602005 602011 602031

This is an Open End Contract. There are no known locations at this time.

Therefore, verification of depths is unattainable. In the past, it is believed that contractors bidding in similar situations used a standard depth for each item in question.

Q # Question Answer 1 General Description Section J states that prevailing wages apply and establishes minimum and maximum bid amounts for flagger items. However, Section K.10 and the General Notices state that prevailing wages do not apply to this contract. Please confirm that Section J, including the flagger minimum and maximum bid requirements, does not apply to this contract.

Flagger Rates do not apply to this contract. General Description J Flagger will be removed via an Addendum.
