Bid Solicitation

Section Reference Question (Bolded) and Answer

1
Section 4.4.5.2

State-Supplied Price Sheet Instructions The RFP lists ten categories for a price to be filled in for each. On most clothing items there are various sizes S- 3 XL (sometimes higher). With just one price submitted the state could have higher pricing for normal sized items so that a vendor does not lose money on the larger sizes. Will the state allow a vendor to submit a pricing spreadsheet based on each size?

Answer: No. The Vendor {Bidder} shall not submit fixed pricing for individual items (individual item pricing), including pricing based on size, on the State-Supplied Price Sheet.

As per Section 4.4.5.2 of the Bid Solicitation, which states in pertinent part, “Step 3 - The Vendor {Bidder} shall insert a firm, fixed percentage (%) discount or markup from the product catalog/price list, by entering the percentage discount or markup bid in the "Percentage (%) Discount (-) or Markup (+)” field on the price line on the State-Supplied Price Sheet. A Vendor’s {Bidder's} entry in the "Percentage (%) Discount (-) or Markup (+)” field shall be considered a percentage (%). For example, entry of "50" shall be considered "50%" and that of "0.50" shall be considered "0.50%".

If a Vendor {Bidder} leaves the "Percentage (%) Discount (-) or Markup (+)” field blank on the price line, it shall be considered that the Vendor {Bidder} provided no Quote for the price line item.

A series or a range of discounts/markups or fixed prices (firm dollar amount) on the price line shall not be acceptable and shall result in rejection of the Quote for that price line only.

If a Vendor {Bidder} is offering its pricing at the same pricing listed on the pre-printed catalog/price list, the Vendor {Bidder} should provide 0% in the “Percentage (%) Discount (-) or Markup (+)” field on the State-Supplied Price Sheet”.

In addition, as per Bid Solicitation Section 4.4.3.3, which states in pertinent part, “The Vendor {Bidder} shall submit with its Quote the brand’s latest preprinted price list or catalog with list prices, as of the Quote opening date, for each brand/price line item bid”.

The latest preprinted price list or catalog with list prices submitted with the Vendors {Bidders} Quote for the brands bid shall contain all available sizes, fabrics, and package configurations.

For example, a Vendor {Bidder} may offer the Gildan brand at 5% discount, as indicated on the State Supplied price sheet, under Category 1 Men’s Sweats and Shorts.

The Vendor {Bidder} shall submit the Gildan brand product catalog/price list showing the various Gildan items (including various sizes) and pricing to which the 5% discount is applied.

2
Section 4.4.5 and 4.4.5.2

and Attachments Tab: State-Supplied Price Sheet In all past RFP’s for Clothing and Footwear the NJDOC would provide a spreadsheet for Vendors to submit and fill in pricing. Will there be a spreadsheet provided for vendors for submitting pricing for all price lines in this RFP?

Answer: The State has provided a price sheet for Vendor {Bidder} use in responding to this Bid Solicitation. As per Section 4.4.5 of the Bid Solicitation, which states in pertinent part: “The Vendor {Bidder} must submit its pricing using the State-Supplied Price Sheet accompanying this Bid Solicitation and located on the “Attachments” Tab.”

In addition, please refer to the answer provided in Question 1 above for additional information.

3
Section 3.0 Scope of Work
Will the State allow a Vendor to bid on items with a different Case Packing from the bid specs? For example, if the Vendor meets all of the items specifications, with the EXCEPTION that the Vendor's Selling Unit of Measure/Case Packaging differs from that specified for each item, will the State allow Case Packaging Exceptions?

Answer: Specific packaging configurations are NOT included in the technical specifications. Vendors {Bidders} may offer any packaging configuration in response to this Bid Solicitation. All packaging configuration should be indicated on the latest preprinted price list or catalog with list prices submitted with the Vendors {Bidders} Quote for the brands bid.

The packaging configurations referenced in Section 3.0 are examples of previous expenditure and current packaging under the existing Blanket P.O.s and are informational only.

Vendors {Bidders} do not need to offer these same packaging configurations on the brand’s product catalog/price list to be responsive. The Vendor {Bidder} should list all packaging configurations on the prepreprinted price list or catalog for each brand/price line item bid.

Please see revisions to the Bid Solicitation titled “T1781 Revised Bid Solicitation 5.13.2021”

4
Section 3.0 Scope of Work
Question: If the State will allow items to be packaged differently than specified, how is the Vendor to make note of the case pack exceptions and also complete the Specification Conformance Certification, given that completing this form indicates that the Bidder is not taking any Exceptions?

Answer: The packaging configurations referenced in Section 3.0 are examples of previous expenditure and current packaging under the existing Blanket P.O.s and are informational only.

5
Section 4.4.3 Submittals
Is my firm required to submit the Specification Conformance certification and Price Lists with the Quote?

Yes, these documents are mandatory submissions and must be submitted as part of your Quote as per Section 4.4.3 Submittals.

What if the Specification Conformance certification and Price Lists are NOT submitted with the Quote?

If these documents are not submitted with your Quote, your Quote will be deemed non-responsive and you will not be eligible for an award.

6
Section 4.4.1.4 Small Business Set-Aside Blanket P.O.
For the partial small business set aside, Categories 5 and 8, what if I submit a Quote but my firm’s small business status is listed as Expired or Revoked with the Division of Revenue and Enterprise Services, Small Business Registration and MWBE Certification Services Unit by the date the Quote is received and opened? Does this mean that my Quote will not be considered responsive?

Answer: If your firm’s small business status is listed as Expired or Revoked by the DORES Small Business Registration and MWBE Certification Services Unit at the date the Quote is received and opened, the Quote submitted by your firm will be considered nonresponsive and will not be evaluated and considered for a Blanket P.O. award.

7
