About this file
This document is a Bid Amendment #4 issued by the New Jersey Department of the Treasury, Division of Purchase and Property for Bid Solicitation #25DPP01070 regarding Data Access Services: Web-based Investigative and Locator Data. The amendment extends the quote submission due date from April 23, 2025, to April 29, 2025, at 2:00 p.m. Eastern Time, and provides answers to electronic bidder questions submitted during the second Electronic Question and Answer period. The amendment introduces a revised Bid Solicitation and modifies sections including the cover page, Section 3.28, and Section 4.1, with the primary goal of clarifying service requirements and pricing structures for web-based investigative and locator data services.
The amendment addresses key vendor concerns about pricing flexibility, specifically allowing Using Agencies to request access to specific search requirements post-award. Bidders are required to provide monthly flat fee pricing for user access to investigative research databases, with costs for required licenses included in the monthly fee. The State maintains a consistent approach to terms and conditions, declining vendor-specific modifications to sections related to ownership of materials, intellectual property, and data management. The procurement seeks to establish multiple contracts across different service categories, with an emphasis on providing comprehensive data access capabilities for state agencies while maintaining standardized evaluation criteria and vendor participation requirements.

Section Reference Question (Bolded) and Answer
1
Bid Solicitation Section 1.1- Purpose and Intent
Q: Current Using Agencies: In Amendment 3 item 10, the State clarifies that the intent is to award multiple contracts per category 1, 2 and 3. Please provide a list of agencies now using services in each category pursuant to the State's current T1616 contract, or at least the total number of agencies using each category.
A: The requested information is not available at this time.

Bid Solicitation, Section 4.1.1 - Search Requirements.
Q: : Follow-up question for Addendum 3, Q21: The search requirements that are considered premium content are very much needed and add value for some customers (typically only a subset of their users) but are not needed, and in some cases, not allowable for other customers and their users. In order to provide pricing that is advantageous to many customers, it is typical to offer such content as an add-on to the core plan. In that way, customers who critically need the data can purchase it and customers who either don’t need it or prohibit access to it, are not penalized by having the content included in a base rate. Our current T1616 Data Access Services contract reflects this approach and includes Category 4: Optional Services, i.e., content that is considered premium content and needed by fewer users. Will the State please reconsider allowing vendors to include Optional Services (add-on content) with corresponding pricing (separate from the Price Sheet) in their proposals? Alternatively, if it will alleviate complications during the evaluation of proposals, will the State allow vendors who are awarded contracts to modify their contracts post-award with their respective Optional Services content?
A: The State has revised the Bid Solicitation Section 3.28 State Supplied Price Sheet Instructions and Bid Solicitation Section 4.1 Required Services to state:
After award, a Using Agency may request access to all or any portion / subset of the search requirements as described in Section 4.1.1. The Contractor shall submit a responsive proposal to the Using Agency for use and access to any such subset or combination of the search requirements as described in Section 4.1.1.
For Bid Solicitation Section 4.1 Category 1 – Tiered Based Pricing - the Bidders shall provide a quote for Monthly Flat Fee User Access: The Bidder shall provide monthly flat fee pricing in the designated yellow cells for Price Lines 1-11 for access to all of its investigative research databases including the requirements defined in Section 4.1.1a through 4.1.1ii. Costs for any required licenses shall be included in the monthly flat fee.

Bid Solicitation Section 4.1.1 - Search Requirements
Q: Follow-up question re Addendum 3, Q21: The search requirements that are considered premium content are very much needed and add value for some customers (typically only a subset of their users) but are not needed, and in some cases, not allowable for other customers and their users. In order to provide pricing that is advantageous to many customers, it is typical to offer such content as an add-on to the core plan. Our current T1616 Data Access Services contract reflects this approach and includes Category 4: Optional Services, i.e., content that is considered premium content and needed by fewer users. The Category 4, Optional Services content is being used by several accounts. Will the State please reconsider allowing vendors to include Optional Services (add-on content) with corresponding pricing (separate from the Price Sheet) in their proposals, so that Using Agencies do not lose the content they’re currently using? Alternatively, if it will alleviate complications during the evaluation of proposals, will the State allow vendors who are awarded contracts to modify their contracts post-award with their respective Optional Services content?
A: This is a repeat question. Please see the response to Question #2.

Bid Solicitation Section 5.4 - Ownership of Materials
Q: Subsection A, State Data. Follow-up question re Addendum 3, Q36/Q37: The only State Data provided to the Contractor for the services being requested would be search criteria, which are maintained and/or purged according to applicable regulatory, statutory, or contractual mandates and the Contractor’s related policies. Would the State modify the second sentence of this section to read as follows: “Unless already purged, or maintained in accordance with applicable regulatory, statutory, and/or contractual mandates and the Contractor’s related policies, State Data provided to Contractor shall be delivered or returned to the State of New Jersey upon thirty (30) days’ notice by the State or thirty (30) days after the expiration or termination of the Contract?”
A: The State does not accept this proposed modification. Terms and conditions on publicly bid procurements must be consistent for all potential Bidders, and cannot be based on a single vendor’s terms.
5
Bid Solicitation Section 5.4 - Ownership of Materials
Q: Subsection B, Work Product. Follow-up question to Addendum 3, Q38: There will be no Contractor-provided work product. The end users in the Using Agencies will request and receive the results of their online research. Given that there will be no Contractor-provided work product, and it is unlikely that other responsive offerings would include any work product, would the State modify the first sentence of this section to read as follows: “To the extent applicable,” at the beginning of the first sentence of this section?
A: The State does not accept this proposed modification. Terms and conditions on publicly bid procurements must be consistent for all potential Bidders, and cannot be based on a single vendor’s terms.
6
Bid Solicitation Section 5.4 - Ownership of Materials
Q: Subsection C, Contractor Intellectual Property; Commercial off the Shelf Software (COTS) and Customized Software. Follow-up question re Addendum 3, Q39: The Contractor is not licensing software or Contractor Intellectual Property to the State. The Contractors’ licensing grants access to the offered solution content and functionality for authorized users in the Using Agencies, and that Contractors’ offered products require acceptance of the Contractors’ licensing terms and conditions, which have been de-conflicted with the State’s terms. Given the nature of licensing, would the State modify this section to read as follows: “Contractor retains ownership of all Contractor Intellectual Property, and any modifications thereto and derivatives thereof, that the Contractor supplies to the State pursuant to the Contract, and grants the State a license to access the offered solution content and functionality for authorized users in the Using Agencies.”
A: The State does not accept this proposed modification. Terms and conditions on publicly bid procurements must be consistent for all potential Bidders, and cannot be based on a single vendor’s terms.
7
Bid Solicitation Section 5.4 - Ownership of Materials
Q: Subsection D, Third-Party IP. Follow-up question to Addendum 3, Q40: The Contractors’ terms and conditions regarding third-party intellectual property and related flow-downs, as included in Contractors’ de-conflicted terms and conditions, would govern access to and use of the offered products. Would the State modify this section such that Contractors’ terms and conditions regarding third-party intellectual property and related flow-downs govern access to and use of the offered products?
A: The State does not accept this proposed modification. Terms and conditions on publicly bid procurements must be consistent for all potential Bidders, and cannot be based on a single vendor’s terms.
8
Bid Solicitation Section 5.4 - Ownership of Materials
Q: Subsection E, Work Product, Follow-up question re Addendum 3, Q41: There is no work product in the requested online subscription services and thus, this section is inapplicable to the offerings. Given that there will be no Contractor-provided work product, and it is unlikely that other responsive offerings would include any work product, would the State modify the first sentence of this section by inserting “To the extent applicable,” at the beginning of the first sentence of this section?
A: The State does not accept this proposed modification. Terms and conditions on publicly bid procurements must be consistent for all potential Bidders, and cannot be based on a single vendor’s terms.
9
Bid Solicitation Section 5.4 - Ownership of Materials
Q: Follow-up question to Addendum 3, Q42, State IP: The State will not be providing any State Intellectual Property to the Contractor in the requested online subscription services; thus, this section is inapplicable to the offering. Given that the State will not be providing any State Intellectual Property to Contractor, would the State modify the first sentence of this section by inserting “To the extent applicable,” at the beginning of the first sentence of this section as this would keep the terms and conditions consistent for all Bidders?
A: The State does not accept this proposed modification. Terms and conditions on publicly bid procurements must be consistent for all potential Bidders, and cannot be based on a single vendor’s terms.
10
Bid Solicitation Attachment 6 - Search Requirements Checklist
Q: Follow-up question re Addendum 3: The heading on Attachment 6, Search Requirements Services Checklist, indicates that Bidders should indicate ‘yes/no’ based on whether they are able to provide the search requirement. More specifically, please clarify whether Bidders ‘yes/no’ responses should reflect whether the requirement is included in the Category 1 rates on the Price Sheet.
A: Please see the response to Question #2.
11
Advanced Pricing
Q: In order to offer the most advantageous per user pricing, would the state be open to allowing an unlimited per user price for major of the data category attributes alongside standalone pricing for a limited number of data category attributes? This would allow agencies who do not utilize these data categories to have a lower price per user across the tiers.
12
Separate Pricing
Q: Will the state be open for separate pricing for the data characteristics below? -Driving Violations -Social Media Comprehensive Report -Business Report -Real-Time Arrest & Incarcerations -Carfax -Credit Report.
