Section Reference Question (Bolded) and Answer

1
PDF Documents
When trying to open a Portable Document Format (PDF) I am receiving an error message and am unable to access the PDF. How should I proceed?

Answer: It is recommended that users utilize Internet Explorer to view PDFs. Certain PDF forms cannot be opened in the Chrome or Firefox built in PDF viewers that are enabled by default. If using Chrome or Firefox it is recommended that the file is downloaded instead by clicking the download button in the upper right-hand corner of the browser after an error message is received. An alternative option is to disable the built in PDF viewers in Chrome or Firefox.

2
Quote Submission
Should I check that I have properly completed and attached all of the required documents with my submitted Quote?

Answer: Yes. Prior to the Quote Opening Deadline, a Vendor {Bidder} should review the documents comprising the submitted Quote to ensure that all of the required documents have been completed and attached. Oftentimes a Quote is deemed non-responsive because a Vendor {Bidder} fails to attach a required form or attaches a blank form. To review a submitted a Quote a Vendor {Bidder} should log into NJSTART and review each document attached to the Quote submission. Instructions on how to review a submitted Quote can be found in the Quick Reference Guide entitled How to Review a Submitted Quote which is available on the NJSTART Vendor Support Page under Vendor Reference Guides.

3
Exceptions
Will the State allow Vendors to take exception to any of the Standard Terms and Conditions?

Answer: As stated in Bid Solicitation Section 1.3.1.1, Exceptions to the NJ Standard Terms and Conditions (SSTC): Questions regarding the SSTC proposed exceptions to mandatory requirements, including the Special and Standard Terms and Conditions in Sections 5 and 9 of this Bid Solicitation must be posed during this Electronic Question and Answer period and shall contain the Vendors {Bidders} suggested changes and the reason(s) for the suggested changes. Additionally, as stated in Section 4.1, General: Quotes including Vendor {Bidder} proposed terms and conditions may be accepted, but Vendor {Bidder} proposed terms or conditions that conflict with those contained in the Bid Solicitation, as defined in Section 2.0 of this Bid Solicitation, or that diminish the States rights under any Blanket P.O. resulting from the Bid Solicitation, may render a Quote non-responsive.

4
Section 3, Category 2, Price Line 14 Boat/Marine Trailer and Trailer Lifts, Price Line 15 Marine Forklifts, Price Line 16 Boat Lifts.
In Category 2, what lifting capacities are required for lines 14, 15 & 16?

Answer: There are a number of factors that will determine which size and lifting capacity is required by the State. These include, but are not limited to, the Using Agency’s facility size and size limitations (height/width), and the size, type and weight of the marine craft or related marine items being lifted.

Since the State has a large number of marine craft and marine trailers in its fleet consisting of varying sizes, capacities and weights, the State is looking for a price list that contains all weight and lift capacities available for the brand bid for trailer lifts, marine forklifts and boat lifts. Vendors {Bidders} should submit Price Lists and/or catalogs that list all items (a brand’s entire product line if it meets the category) available for a particular brand. The Price Lists should include items of varying weights, sizes, lifting capacities, etc.

5
Category 2, Price Line 14 Boat/Marine Trailer and Trailer Lifts, Price Line 15 Marine Forklifts, Price Line 16 Boat Lifts

Section 3.7, Blanket P.O. Implementation (Ordering Process) Has a Statement of Work been created for machines listed on lines 14, 15 & 16 of Category 2?

Answer: No. These items will be purchased by Using Agencies on an as-needed basis. The Vendor {Contractor} will work with the Using Agencies on their specific needs (project requirements) after the Blanket P.O.s are awarded.

Bid Solicitation Section 3.7 (Blanket P.O. Implementation/Ordering Process) states, in pertinent part: “Blanket P.O. users shall make purchases from that Vendor {Contractor} whose Blanket P.O. terms and conditions are most advantageous, price and other factors considered. Blanket P.O. users shall initiate a Blanket P.O. purchase project by preparing clear and unambiguous project requirements, based solely upon their needs. At the time of auditing, Blanket P.O. users will be required to demonstrate that the establishment of the project requirements is free from any bias or inclination against or in favor of any Vendor {Contractor}. Using its project requirements, current price list (as published in the Attachments tab of the Blanket P.O. in NJSTART) and Blanket P.O. discount or markup, a Blanket P.O. user shall determine the final purchase price for each Blanket P.O. for a given price line item. The Blanket P.O. user must document all phases of its Blanket P.O. selection process for each purchase under any Blanket P.O. resulting from this Bid Solicitation. “

6
Section 3.0, Scope of Work
How can I bid, nothing is listed?

The categories and brands covered under this Bid Solicitation are listed in Section 3.0, Scope of Work. Categories 1 and 2 list specific brands required by the Using Agencies but Vendors {Bidders} may offer any brand that meets the requirements of the category. A Vendor {Bidder} may offer an exhaustive list of products offered by brand/manufacturer that meet the Category/Price Line description.

For example, for Category 1, Group 4 (Price Lines 7 and 8), Center Console Vessels, a Vendor {Bidder} offering the Boston Whaler brand may offer a price list that includes all center console models listed in its Montauk and Dauntless product line under Price Line 7 and all options and accessories compatible with the Montauk and Dauntless models under Price Line 8.

In another example, for Category 2, Price Line 17 – Marine Electronics, a Vendor {Bidder} bidding the Raymarine brand can offer a price list that contains Raymarine’s entire product line for marine cameras, radar, VHF radios, chart plotters, and auto pilots and all other related marine electronic equipment parts and accessories associated with the above mentioned Raymarine products.

7
Section 3.0, Scope of Work
We are interested in quoting on 19DPP00372 which is the subsurface I represent VideoRay who makes ROVs, Klein Marine who makes side scan sonar, Kongsberg who makes sector scan sonar and multibeam sonars, Teledyne Blueview who makes multibeam sonars, Hemisphere who makes DGPS and RTK solutions, Pelican cases and also companies who make underwater connectors.

At this point I do not have any questions because there is no specific requirement listing in this solicitation.

Note: This question has been paraphrased in the interest of readability and clarity.

The State is asking for Vendors {Bidders} to submit Quotes for the entire product line for the brand bid. Vendors {Bidders} may offer pricing for any brand that meets the requirements of the category.

For example, in the case of VideoRay brand for Category 2, Price Line 19 - Subsurface Detection Equipment, your firm would complete the required fields on the State-Supplied Price Sheet for Price Line 19, and submit the brand manufacturers price list, which may contain VideoRay’s entire product line of underwater remote operated vehicles and all related options and accessories.

Using Agencies will determine the purchase price of the Unit and any related options and accessories by applying the discount or markup bid on the State-Supplied Price Sheet (which will be awarded as part of the Blanket P.O.) to the pricing contained in the brand manufacturers price list.

As stated in Bid Solicitation Section 3.7, “Using its project requirements, current price list (as published in the Attachments tab of the Blanket P.O. in NJSTART) and Blanket P.O. discount or markup, a Blanket P.O. user shall determine the final purchase price for each Blanket P.O. for a given price line item.”

8
Section 3.0, Scope of Work;

Section 4.4.5.2 State-Supplied Price Sheet Instructions On the website, there are many NIGP Code Categories in the RFQ. When I review the hard copy, it is reduced to vary narrow and non-specific Groups and Line Items. Are we able to quote the type of items noted on the website NIGP Codes, like Water Rescue PPE, PFD's, Water Rescue Equipment, etc.?

Note: This question has been paraphrased in the interest of readability and clarity.

The NIGP Codes listed in the “Items” tab in NJSTART were used to promulgate a Vendors {Bidders} list. These Vendors {Bidders} were notified electronically of the Bid Solicitation 19DPP00372 for Marine Craft and Related Products and Services.

All categories covered under Bid Solicitation 19DPP00372 are listed in Section 3.0, Scope of Work. No other categories will be considered as part of this Bid Solicitation and a Vendor {Bidder} must not base its Quote offerings on the specific NIGP commodity codes listed in the Items tab in NJSTART. Rather, Vendors {Bidders} must bid using the State-Supplied Price Sheet. A Vendors {Bidders} Quote will solely be based on the descriptions contained in the Bid Solicitation and State-Supplied Price Sheet. Please refer to Bid Solicitation Section 4.4.5 for further information.

The following statement has been added to Bid Solicitation Section 3.0:

“Items covered under an existing Blanket P.O. shall not be offered and will not be made part of any Blanket P.O. awarded as a result of this Bid Solicitation. This includes, but is not limited to:

T0106 – Law Enforcement Firearms, Equipment and Supplies; and T0790 - Firefighter Protective Clothing and Equipment.”

Please see revisions to the Bid Solicitation titled “T0969 19DPP00372 Revised Bid Solicitation 12.1.20.”

If not, in Group 3, Line 6: Are we able to submit Water Rescue PPE (Personal Protective Equipment - Dry Suits, PFD's, Boots, Gloves, etc.? ) since it is crucial and compatible with Swift Water Rescue Boat Operations.
