This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued. NOTICE TO GOVERNMENT WHEN CONTRACTOR(S) DELAYS:
In the event the contractor(s) encounter difficulty in meeting performance requirements, or when there is an anticipated difficulty in complying with the delivery terms or completion dates, or whenever the contractor has knowledge that any actual or potential situation is delaying or threatens to delay the timely delivery/performance of this contract, the contractor must immediately notify the Field Administrative
Contracting Officers at UNICOR – Washington, DC with pertinent details. This information will not be construed as a waiver by the Government of the required delivery schedule, or the Governments rights to impose consideration against delinquencies or other remedies provided by this contract.
BEST COMMERCIAL CUSTOMER CATEGORY:
Contractor agrees that FPI is in the category of the most favored or best commercial customer category of the
Contractor and as such, the Contractor will:
During the contract period, the Contractor shall report to the Contracting Officer all price reductions offered to the category of customers that are considered by the Contractor to be their most favored or best commercial customer.
1. A price reduction shall apply to purchases under this contract if, after the award date, the Contractor-
i) Revises downward its commercial catalog, price list, schedule, etc., to its best commercial customers
(or category of customers) below the awarded price under this contract;
ii) Grants more favorable discounts or terms and conditions to its best commercial customers than those contained in this contract that would result in prices below the awarded price under this contract, an/or
iii) Grants special discounts to its best commercial customer (or category of customers) that would result in prices lower than the awarded price under this contract.
2. The Contractor shall offer the price reduction to FPI with the same effective date, and for the same time period, as extended to the commercial customer (or category of customers).
The Contractor may offer the Contracting Officer a voluntary price reduction at any time during the contract period.
The Contractor shall notify the Contracting Officer of any price reduction subject to this clause as soon as possible, but not later than 15 calendar days after its effective date.
CONTRACTOR’S RESPONSIBILITY: It is the responsibility of the Contractor to follow any Special
Security Requirements of the facility where the work is performed in the performance of the contract and to consider the effects of those security requirements in the pricing of the proposal.

(a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract.
(b) Before commencing work under this contract, the Contractor shall notify the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective-
(1) For such period as the laws of the State in which this contract is to be performed prescribe; or
(2) Until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer.
(c) The Contractor shall insert the substance of this clause, including this paragraph (c), in subcontracts under this contract that require work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract. The Contractor shall maintain a copy of all subcontractors' proofs of required insurance, and shall make copies available to the Contracting
Officer upon request.

(a) (In accordance with Standard FAR Contract Clause 52.228-5 entitled "Insurance - Work on a Government
Installation (JAN 1997) the Contractor shall procure and maintain, during the entire period of his performance under this contract, the following minimum insurance:

(1) General Liability Insurance
Bodily injury liability insurance, in the minimum limit of $500,000 per occurrence is required on the comprehensive form policy.
(2) Automobile Liability Insurance
This insurance is required on the comprehensive form policy and shall provide bodily injury liability and property damage liability covering the operation of all automobiles sued in connection with the performance of the contract. At least, the minimum limits of $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage shall be required.
(3) Workmen's Compensation and Employer's Liability Insurance
Employer's liability coverage is required in the minimum amount of $100,000 or as required by the state where the project is performed.
(b) Prior to the commencement of work hereunder, the Contractor shall furnish to the Contracting Officer a certificate or written statement of the above required insurance. The policies evidencing required insurance shall contain an endorsement to the effect that cancellation of any material change in the policies adversely affecting the interests of the Government in such insurance shall not be effective for such period as may be prescribed by the laws of the state in which this contract is to be performed and in no event less than thirty (30) days after written notice thereof to the Contracting Officer.

1.0 Background/ Introduction
1.1 Background
The Federal Prison Industries program (now operating under the trade name UNICOR) was established in 1934 by an Executive Order issued by President Franklin D. Roosevelt. On January 1, 1935, FPI officially began operations as a wholly owned corporation of the United States Government. More than eighty-seven years after its establishment, the program continues to operate at no cost to taxpayers and benefits communities across the Nation creating safer prisons and reducing inmate recidivism. The mission of Federal Prison Industries, Inc. (FPI) is to protect society and reduce crime by preparing inmates with job training and practical work skills for reentry success.

1.2 Objective
Federal Prison Industries (UNICOR) is seeking to enter into an agreement with private sector companies to provide lighting replacement components on 7th floor and installation at 400 1st St NW, Washington DC 20534 federal building.
1.3 Scope
The scope and purpose of this contract is to Provide necessary labor and material to install (35) 2x4 non-dim Lithonia model # 2ESL4 48L Mvolt EOHN LP835 LED fixtures or equivalent. Provide and install (10) Occupancy sensors and power packs for lighting control. Sensors model # are sensor switch CM-PDT-9 or equivalent and power pack is model #sensor switch PP-20 (or equivalent) and Install (8) 1 pole 20-amp switches for override of sensors. Support all light fixtures from building structure. All wiring shall be installed per NEC using MC cable. This requirement is for UNICOR – Central Office Building to sustain form-fit-function, safety and environmental standards, and overall maintenance.
Installation will include but not limited to:
• (35) 2x4 non -dim Lithonia model # 2ESL4 48L Mvolt EOHN LP835 LED fixtures or equivalent
• (10) Occupancy sensors and power packs for lighting controls
• Provide Sensors switch model #CM-PDT-9 and power pack sensor switch PP-20 or equivalent
• Install (8) 1 pole 20-amp override switch
• Support light fixture’s structure
• Install MC cable per NEC
• Clean up any debris created during this process.
• Replacement will be performed during normal working hours.
• A one-year warranty provided.
• Lock out and tag out units
• Start up and check the operation.
• Clean up any debris created during this process.
• Work maybe be performed on the weekend so not to interrupt daily functions.
1.4 Contractor Management
Contractor providing lighting fixtures and switch installation service under this contract will be directed by the COR David Smith.
1.5 Contract Performance
Statement of Work
1.5.1. Period of Performance – Best lead time and install time will be provided in proposal. Times will be used as an evaluation factor.
Estimated time frame: 60 days
1.5.2 Place of Performance
Delivery and installation will be accomplished at the Federal Prison Industries (UNICOR) – Central Office Bldg. located at 400 1st Street NW, Washington, DC 20534.
2.0 Contract Requirements
2.1 Access Hours
Normal working hours at UNICOR – Central Office are 6:00am – 2:30pm EST, Monday through Friday, off on Federal Holidays. Work hours may change based on the work/ project.
2.2 Federal Holidays
Contractor shall not be required to work on the following Federal holidays when the post will be closed.
When such holidays fall on a Saturday, the preceding Friday is considered a holiday. When such holidays fall on a Sunday, the following Monday is considered a holiday.

2.3 Worksite Appearance and Security
The Contractor shall maintain the worksite such that debris and trash is consistently removed and properly disposed. The Contractor shall ensure this is done by daily cleanups at the end of the workday. The Contractor shall ensure that the building’s exterior doors and windows are always clear of debris to allow access to the building interior.
2.4 Job Conditions
No illegal aliens are permitted on any federal property. All contractor and subcontractor employees working on a Government facility shall be a U.S. citizen and able to provide one forms of valid U.S.
identification as proof of citizenship (e.g., Certificate of Birth, passport, or driver’s license). There are no exceptions for this requirement.
2.5 Safety
Facility Operating Specialist will develop safety plan to review with contract employees. This plan shall discourage unsafe acts, foster accident prevention, and comply with safety regulations, the Occupational Safety and Health Act (OSHA), and UNICOR safety regulations.
2.5.1 Accident Prevention
The contractor shall follow Accident Prevention processes as prescribed in the Federal Acquisition Regulation (FAR) clause 52.236-13, Accident Prevention.
The contractor shall also follow Alternate I of FAR Clause 52.236-13. Where Alternate I of FAR Clause 52.236-13 is applicable, contractors will provide their written Accident Prevention Plan to the C5ISR Safety Center prior to beginning work. This plan shall include an analysis of the significant hazards to life, limb, and property inherent in the contract work performance and a plan for controlling these hazards.
2.5.2. Safety Standards
Contractors are responsible for the protection of their employees IAW 29 Code of Federal Regulations CFR 1910, 29 CFR 1925, and 29 CFR 1926.
The contractor and all associated sub-contractors shall comply with applicable federal, state, and local safety occupational health and environmental rules, laws, and regulations, as well as additional specific requirements invoked by contract.
Contractors will not expose Government employees, equipment, or facilities to hazards because of Contractor’s operations.
Contractors will apply Occupational Safety and Health Administration (OSHA) and other non-Department of Army regulatory or consensus safety and health standards to military unique equipment, systems, operations, or workplaces, in whole or in part, insofar as practicable.
Contractors shall immediately notify the COR of any accident, incident or exposure resulting in a fatality, lost-time occupational injury, illness, contamination of property, property damage or loss resulting from work performed under the contract.
2.6 Site Visit
2.6.1 Site visit will be on Monday March 10th starting at 8:00AM. One person from company providing proposal is permitted. Subs are not considered part of company. The person’s name, email address, and phone # attending site visit must be provided to David Smith at david.smith18@usdoj.gov no later than August 7th at
10:00AM EST.

3.0 Evaluation
Award will be issued on best value to the government. Evaluation factors are mandatory site visit, past performance, experience, technical evaluation, lead/install times, and price.
Site Visit - One person from proposal company must attend site visit to be considered for award. A sub. is not considered part of proposal company. 9 of 36
Past performance will be evaluated based on references from business management questionnaire, and CPARS.
Experience -Must have 5 years of experience. Must provide resume of key personnel. Experience will be rated – GO or NO-GO.
Technical Evaluation –lighting fixtures specifications, installation plan and specifications, and safety plan.
Lead/install times – provide best lead time, and best install time frame.

(d)Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1)The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2)The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract.
If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3)As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1)Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the
Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services.
