About this file

This is a Suspension and Debarment certification document for the State of Maine related to a contract opportunity for an Automatic Grease Lubricating System for 38 units. The document outlines federal compliance requirements under 49 CFR Part 29 and Executive Orders 12549 and 12689, establishing mandatory verification protocols that bidders must follow as a condition of bid submission.

Bidders must certify compliance with four specific eligibility criteria: that they are not currently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from covered transactions by any Federal Department or Agency; that they have not been convicted of fraud or criminal offenses related to public transactions or contracts within the preceding three-year period, including violations of antitrust statutes, embezzlement, theft, forgery, bribery, falsification of records, or receiving stolen property; that they are not presently indicted for or criminally or civilly charged with any such offenses; and that they have not had any public transactions terminated by default within the preceding three years. The certification must be signed and dated by an authorized representative and submitted with the bid or proposal. Bidders unable to certify to these statements must acknowledge this on the signature page and provide written explanation to the State of Maine. The document emphasizes that false certification constitutes a material misrepresentation of fact and may subject the bidder to federal remedies including suspension and debarment, and requires bidders to maintain compliance throughout the contract period and include equivalent compliance requirements in any subcontracted transactions.

SUSPENSION AND DEBARMENT

This contract is a covered transaction for purposes of 49 CFR Part 29, Executive orders 12549 & 12689, and 31 U.S.C 6101.. As such, the contractor is required to verify that none of the contractor, its principals, as defined at 49 CFR 29.995, or affiliates, as defined at 49 CFR 29.905, are excluded or disqualified as defined at 49 CFR 29.940 and 29.945.

By signing and submitting its bid or proposal and the certificate of eligibility, the bidder or proposer certifies as follows:

The certification in this clause is a material representation of fact relied upon by the bidder. If it is later determined that the bidder or proposer knowingly rendered an erroneous certification, in addition to remedies available to the bidder, the Federal Government may pursue available remedies, including but not limited to suspension and/or debarment. The bidder or proposer agrees to comply with the requirements of 49 CFR 29, Subpart C while this offer is valid and throughout the period of any contract that may arise from this offer. The bidder or proposer further agrees to include a provision requiring such compliance in its lower tier covered transactions.
