About this file
This is a Supplemental Conditions document for Hazard Mitigation Grant Program (HMGP) projects issued by the City of Fort Myers, Florida for the Dean Park Residential Elevation Project. The document establishes the regulatory and compliance framework applicable to all HMGP Grant projects under this solicitation, which seeks qualified respondents to provide site-specific residential elevation design and related services for participating properties. The project requires design services that incorporate historic preservation considerations and ensure compatibility with applicable local, state, and federal requirements, given the historic designation of the project area. No specific quantities, response dates, due dates, site visits, bidder meetings, award dates, or contract terms are identified in this supplemental conditions document.
The supplemental conditions establish that all applicable requirements of 2 C.F.R. Part 200 regarding Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards apply to the contract. Additionally, the Vietnam Era Veterans' Readjustment Assistance Act of 1974 (VEVRAA) requirements apply to contractors with federal contracts or subcontracts valued at $150,000 or more, requiring non-discriminatory treatment of protected veterans and affirmative steps toward their employment and advancement. Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act also applies, and contractors must certify compliance with these provisions upon submission of their response. The funding source is federal through the HMGP, which is a federal disaster mitigation grant program.

These terms and conditions apply to the HMGP Grant projects:
1. Federal Funding Compliance. All applicable requirements of 2 C.F.R. part 200, Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards, including the applicable contract provisions set forth in Appendix II to 2 C.F.R. part 200.
2. Vietnam Era Veterans’ Readjustment Assistance Act of 1974 (VEVRAA), as amended;
41 CFR Part 60-300. This Act requires employers with Federal contracts or subcontracts valued at $150,000 or more, and contracts or subcontracts for indefinite quantities (unless the contracting agency has reason to believe that the cost in any one year will be less than $150,000), to treat applicants and employees without discrimination because they are a disabled veteran, recently separated veteran, active duty wartime or campaign badge veteran, or Armed Forces service medal veteran ("protected veteran"). Covered Contractors must also take steps to employ and advance in employment qualified protected veterans. Contracts covered by VEVRAA are subject to the implementing regulations found at 41 CFR Part 60-300.
Exceptions:
• Those for less than $150,000;
• Those for indefinite quantities where the agency determines that the cost in any one year will not exceed $150,000;
• Those for work that is performed outside the U.S. and for which employment activity decisions were made outside the U.S.; and
• Those with state or local governments, except for the specific government entity that participates in work on or under the contract.
3. Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act. In addition to the federal provisions above Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act also applies to this solicitation.
By submitting a response, the Contractor certifies that they have reviewed, understand, and are in compliance with Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act.
