About this file

This is a Supplemental Conditions document for the Hazard Mitigation Grant Program (HMGP) issued by the Florida Division of Emergency Management in conjunction with the City of Fort Myers for the Downtown Stormwater Drainage Improvements project along First Street. The project seeks qualified professional engineering and environmental services firms to provide comprehensive design, permitting, and construction phase support for stormwater infrastructure improvements spanning approximately 1 mile of First Street from Edison Bridge westward toward Virginia Avenue. The selected contractor will be responsible for evaluating, designing, permitting, and supporting construction of upsized piping, culverts, drainage structures, and associated roadway restoration to increase stormwater system capacity and mitigate flooding from intense rainfall events and coastal influences, thereby protecting roadway infrastructure and maintaining emergency access in the downtown corridor.

The contract is subject to federal funding compliance requirements under 2 C.F.R. part 200, including uniform administrative requirements, cost principles, and audit requirements for federal awards. The project is funded through the Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant Program and Community Development Block Grant-Disaster Recovery (CDBG-DR) sources. Contractors with federal contracts or subcontracts valued at $150,000 or more are subject to the Vietnam Era Veterans' Readjustment Assistance Act of 1974 (VEVRAA) and must comply with 41 CFR Part 60-300, which prohibits discrimination against disabled veterans, recently separated veterans, active duty wartime or campaign badge veterans, and Armed Forces service medal veterans, and requires covered contractors to take affirmative steps to employ and advance qualified protected veterans. All contractors must also comply with Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act by certifying their review, understanding, and compliance with its provisions.

SUPPLEMENTAL CONDITIONS FOR HMGP

These terms and conditions apply to the HMGP Grant projects:

1. Federal Funding Compliance. All applicable requirements of 2 C.F.R. part 200, Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards, including the applicable contract provisions set forth in Appendix II to 2 C.F.R. part 200.

2. Vietnam Era Veterans’ Readjustment Assistance Act of 1974 (VEVRAA), as amended;

41 CFR Part 60-300. This Act requires employers with Federal contracts or subcontracts valued at $150,000 or more, and contracts or subcontracts for indefinite quantities (unless the contracting agency has reason to believe that the cost in any one year will be less than $150,000), to treat applicants and employees without discrimination because they are a disabled veteran, recently separated veteran, active duty wartime or campaign badge veteran, or Armed Forces service medal veteran ("protected veteran"). Covered Contractors must also take steps to employ and advance in employment qualified protected veterans. Contracts covered by VEVRAA are subject to the implementing regulations found at 41 CFR Part 60-300.

Exceptions:

• Those for less than $150,000;

• Those for indefinite quantities where the agency determines that the cost in any one year will not exceed $150,000;

• Those for work that is performed outside the U.S. and for which employment activity decisions were made outside the U.S.; and

• Those with state or local governments, except for the specific government entity that participates in work on or under the contract.

3. Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act. In addition to the federal provisions above Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act also applies to this solicitation.

By submitting a response, the Contractor certifies that they have reviewed, understand, and are in compliance with Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act.
