About this file

This document contains supplemental clauses for a Department of the Air Force federal contract acquisition.

The Ombudsman clause establishes a neutral ombudsman, Mr. Robert Surrey at AFICC OI AMC, Scott AFB, Illinois, to hear and facilitate resolution of concerns from offerors and potential offerors. Interested parties must first address concerns with the contracting officer before consulting the ombudsman. The ombudsman maintains strict confidentiality of concern sources and does not participate in proposal evaluation, source selection, or protest adjudication. Unresolved concerns may be escalated to the Department of the Air Force ombudsman at the Associate Deputy Assistant Secretary (Contracting) level in Washington, D.C. The ombudsman has no binding authority, and inquiries regarding solicitation copies, offer due dates, or technical requirements must be directed to the contracting officer, not the ombudsman.

The Elimination of Use of Class I Ozone Depleting Substances clause prohibits contractors from providing any service, product, specification, standard, or document that requires Class I ODS use in testing, operation, or maintenance. Prohibited substances include Halons (1011, 1202, 1211, 1301, and 2402), Chlorofluorocarbons (CFC-11 through CFC-217 and blends R-500, R-501, R-502, R-503), Carbon Tetrachloride, Methyl Chloroform, and Methyl Bromide. The Contractor Access to Department of the Air Force Installations clause requires contractors to obtain base identification and vehicle passes for all personnel making frequent visits or performing work on Air Force installations, submit written access requests listing employee names and dates, wear identification badges, manage credential returns upon employee departure, and provide after-hours emergency contact information in the Emergency Mass Notification System. Failure to comply may result in withholding of final payment.

Supplemental Clauses

Ombudsman

1. An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.

2. Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A- 76 competition performance decisions).

3. If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman, Mr. Robert Surrey, AFICC Ol AMC, 510 POW/MIA, Scott AFB, IL 62225-5022, 618-229-0267, fax 618-256-5724, email robert.surrey.1@us.af.mil. Concerns, issues, disagreements, and recommendations that cannot be resolved at the Center/MAJCOM/FLDCOM/DRU ombudsman level, may be brought by the interested party for further consideration to the Department of the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (571) 256-2395, facsimile number (571) 256-2431.

4. The ombudsman has no authority to render a decision that binds the agency.

5. Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the contracting officer.

ELIMINATION OF USE OF CLASS I OZONE DEPLETING SUBSTANCES (ODS)
