SECTION C - STATEMENT OF WORK
C.1 GENERAL DESCRIPTION
The FBI is the Federal Government’s principal agency responsible for investigating violations of more than 260 Federal statutes. In pursuit of their duties, FBI personnel may be involved in high threat assignments where they face a variety of situations and needs. A multiple-award IDIQ for a variety of items will expedite the acquisition of needed items.
C.2 SCOPE
C.2.1 The scope of work under the Strategic Tactical Equipment Acquisition and Logistics (STEAL) program includes the total logistics support for the tactical equipment requirements of the FBI to include FBI locations CONUS and OCONUS. The primary purpose of the STEAL program is to provide support to the FBI for all special operational equipment, supplies, and related incidental services necessary to perform their missions. Various types of tactical equipment and related incidental services may be provided under the contracts including but not limited to: survival gear, tactical equipment, protective eyewear and vision enhancing equipment, escalation of force equipment, visit board search and seizure (VBSS), scuba gear, surface diving gear, thermal protection equipment, communication devices, compressors, hazardous material (HAZMAT), air purification devices, hyperbaric instrumentation, lifesaving equipment and other safety items.
C.2.2 The equipment covered by the acquisition consists of commercial items and commercially modified items (commercial items requiring minor modification to fit FBI applications). In general, the scope includes tactical equipment and related supplies and incidental services, including but not limited to:
(1) Survival Gear and Equipment Kits
(2) Tactical Equipment
(3) Personal Protection Equipment
(4) Protective Eyewear and Vision Enhancing Equipment
(5) Escalation of Force Equipment
(6) Visit Board Search and Seizure (VBSS)
(7) Scuba Gear and Miscellaneous Diving Equipment
(8) Thermal Protection Equipment
(9) Surface Supplied Diving Equipment
(10) Communication Devices (such as walkie-talkies, two-way radios, etc.)

(19) Mountain Climbing Equipment
C.2.3 Incidental services are standard commercial services that the contractor may be asked to perform in connection with supplying items under the scope of the contract. Such services engage the time and effort of the contractor to perform an identifiable task in addition to furnishing an end item supplied. Performing such services does not change the primary purpose of the contract from a supply to a service contract. What constitutes an incidental service is fact specific and will be a function of factors such as type of service, amount charged for the service, dollar amount charged for the supplies, existence of a close relationship between the service and the item supplied, and the time required to perform the service. Incidental services are usually requested at the same time the item of supply is ordered and will generally have a separate line item requesting the services.
Whether a service is “incidental” or not will be determined by the Contracting Officer (CO) prior to placing such order for the incidental service.
C.3 GENERAL REQUIREMENTS - PER FBI POLICY GUIDE: THE SELECTED ITEM(S) MUST MEET THE
BASIC REQUIREMENTS AS CONTAINED IN THIS DOCUMENT
C.3.1 All items must be, at a minimum, Trade Agreement Act (TAA) compliant, if applicable. See “Look up Trade Agreements Act-designated countries” on GSA.gov for a list of TAA compliant countries.

a) Contract Number
b) Period of Performance (ex: Base Year/Qtr. 1)
c) List of orders “ACCEPTED” during the month for each authorized buyer (include delivery order number & dollar value of order).
NOTE: “ACCEPTED” refers to an order that has been received during the month, regardless of if the order shipped. When an order has been received/accepted by the Contractor, the maximum, not to exceed, contract value is impacted.
d) Total dollar value of all accepted orders during the month (combined monthly figure).
e) Total dollar value of usage to date (current monthly figure combined with previous months) under the contract.
C.6.2 Information must be provided using Microsoft Excel.
C.6.3 If the monthly report is not provided within ten (10) calendar days of the end of month as required, a written explanation as to why the report is tardy shall be provided with the report.
C.6.4 See Section J Attachment 3 for monthly report

SECTION G – CONTRACT ADMINISTRATION
G.1 JAR 2852.201-70 CONTRACTING OFFICER’S REPRESENTATIVE
(COR) (NOV 2020)
A. Mr./Ms. (Name) of (Organization), (Address), (Area Code & Telephone No.,), is hereby designated to act as Contracting Officer’s Representative (COR) under (contract #), for the period of (specify the performance period of the contract that the designation covers).
B. The COR is responsible, as applicable, for: receiving all deliverables, inspecting and accepting the supplies or services provided in accordance with the terms and conditions of this contract; Clarifying, directing, or redirecting the contract effort, including shifting work between work areas and locations, filling in details, or otherwise serving to accomplish the contractual statement of work to ensure the work is accomplished satisfactorily; evaluating performance of the contractor; and, certifying all invoices/vouchers for acceptance of the supplies or services furnished for payment.
C. The COR does not have the authority to issue direction that: constitutes a change of assignment or work outside the contract specification/work statement/scope of work.
Constitutes a change as defined in the clause entitled “Changes” or other similar contract term. (iii) Causes, in any manner, an increase or decrease in the contract price or the time required for contract performance; Causes, in any manner, any change in a term, condition, or specification or the work statement/scope of work of the contract; Causes, in any manner, any change or commitment that affects price, quality, quantity, delivery, or other term or condition of the contract or that, in any way, directs the contractor or its subcontractors to operate in conflict with the contract terms and conditions; Interferes with the contractor's right to perform under the terms and conditions of the contract;
Directs, supervises, or otherwise controls the actions of the Contractor's employees or a Subcontractor's employees.
(End of clause)
G.2 ORDERING
In accordance with FAR 16.506(a), Ordering, and the clause at FAR 52.216-18, Ordering, any supplies, and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule.
G.2.1 Requirements will be reviewed to ensure compliance with the scope of the contract(s). If a requirement is determined to be outside the scope of the contract(s), it will be rejected by the CO then an alternate means of satisfying the customers' requirement will be reviewed and provided as appropriate.
G.2.2 All requests for items will be reviewed for scope compliance by a designated representative of the National Acquisition Programs Unit (NAPU). An item must be approved by NAPU prior to requesting a contractor's pricing and delivery terms for an order. The determination by NAPU as to whether an item is in scope shall be considered final and cannot be appealed by any STEAL contractor.
G.2.3 Generally, the items procured are commercial products or modified commercial products that are identified by a manufacturer's part number or by commercial item descriptions. All items shall conform to the manufacturer's commercial specifications.
G.2.4 A price evaluation list (PEL) was identified. The PEL is considered a representative sample of the types of items that may be required by the FBI throughout the duration of the contract. The list illustrates the types of supplies that have been provided under the previous contracts, which the STEAL contractor will be required to furnish under the resultant contracts. The prices for the PEL and
Acceptable Alternates will be Ceiling Prices after contract award. It is the maximum unit price that the Government will pay during the base year and each applicable option year for items on the PEL.
During the post-award competition of delivery orders, the contractor may not submit a quote for a PEL item or Acceptable Alternate with a price that exceeds the applicable contractual Ceiling Price.
Contractors are encouraged, when competing for delivery orders, to provide a quote less than their ceiling price.
a. Superseded Part Number Items: If an item on the PEL is superseded during the contract term, the Contractor shall advise the Contracting Officer. If there is no change to the parts form, fit, function, configuration, application, or physical nature and is therefore an exact item of replacement, PEL pricing will remain applicable. If there is a change such that it is not an exact item replacement, the Contractor shall include complete information from the manufacturer concerning the replacement item as it relates to the form, fit, and function, configuration, application, or physical nature of the superseded item. The Contracting Officer will make the determination whether the superseded item represents a “new” item. If the determination by the Contracting Officer is that the superseded item is NOT an exact item of replacement, PEL pricing will not be applicable.
b. End of Life (EOL): If an item on the PEL has been classified as EOL by the manufacturer, the Contractor shall provide supporting documentation to the Contracting Officer. PEL pricing will not be applicable after the last production date.
G.2.5 Acceptable alternate items will be permitted under the resultant contract(s) when an item is identified by a manufacturer's brand name or part number unless the Government expressly states that an alternate is not permitted. To be acceptable the alternate must be equal to the requested item and approved by NAPU. For more information regarding submission of alternate items for evaluation, please see the “Ordering/Request for Quote Process Overview” section (G.3).
G.2.6 Additional tactical equipment and related supplies and incidental services, which were not identified on the PEL (Section J, Attachment 1) provided with the solicitation but are subsequently determined to be required by the authorized customers, may be added to the resultant STEAL:
a. NAPU will conduct a review of all customer requests to identify new/replacement items to be added to the STEAL contract and the Contracting Officer will make a scope determination for each item requested.
b. Once an item is approved for scope, a Request for Information (RFI) and/or Request for Quote (RFQ) will be sent to all STEAL contractors. STEAL contractors will price requested items and/or provide the required information on any alternate items to be considered for award.
c. NAPU will evaluate the pricing submitted by each Steal Contractor in order to determine prices fair & reasonable and will add the items to the tactical equipment catalog of historical prices.
d. Based on the instructions provided with the RFI and/or RFQ, the items added to the catalog of historical prices may also be added as a ceiling price and will serve as the ceiling price for the applicable period (base period and/or each respective option year period). Ceiling prices cannot be exceeded on future requirements during the applicable period (base period and/or each respective option year period).
G.3 ORDERING/ REQUEST FOR QUOTE PROCESS OVERVIEW
Competition process for all delivery orders
G.3.1 All orders over the micro-purchase threshold will be competed among all awardees pursuant to the fair opportunity requirements of FAR 16.505(b), except the Government reserves the right to direct orders to a particular source under urgent circumstances, to meet contractual minimums, or to provide economy and efficiency as a logical follow-on to an order already issued in accordance with FAR 16.505(b)(2).
Note: Orders under the micro-purchase threshold may be competed among all awardees. Orders under the micro-purchase threshold may also be auto-awarded based on historical pricing obtained from previously competed delivery orders, or based on the pricing submitted on the PEL and incorporated into the Contract upon award.
G.3.2 Approved customer Order Requests are loaded into a standardized RFQ spreadsheet and forwarded (via email) to all Contractors.
G.3.3 When an RFQ describes the Government's requirements for an item peculiar to one manufacturer (e.g., a particular brand-name, product, or a feature of a product that is peculiar to one manufacturer), offers of alternate items will be considered by the Government unless the RFQ expressly states that only the item peculiar to one manufacturer will be considered. A contractor proposing an alternate item shall furnish with its offer legible copies of all drawings, specifications, or other data necessary to clearly describe the characteristics and features of the alternate product being offered. Data submitted shall cover design, materials, performance, function, interchangeability, inspection and/or testing criteria, and other characteristics of the offered product. In addition, the offeror shall furnish drawings and other data covering the design, materials, etc. of the exact product cited in the RFQ along with a cross reference list comparing the features and capabilities of the alternate item offered to the exact item listed on the RFQ sufficient to enable the Government to determine whether the offeror's product is equal to the product cited in the RFQ.
Failure to provide a complete technical data package sufficient to establish that the alternate item is an acceptable substitute to the item requested shall be grounds to exclude the alternate item from consideration.
In the event that an offer for an alternate item is received in accordance with the terms of the contract, the Government will review the alternate item for acceptability. If the Government determines that the alternate item offered will meet its requirements, the Government may award based on the alternate item in lieu of the item originally requested, without further negotiations or amendments to the RFQ, if the alternate item offers the best value to the government based on the criteria stated in the relevant RFQ.
