About this file

This document is a Questions and Answers (Q&A) file for the FBI's Strategic Tactical Equipment and Logistics (STEAL) solicitation (SHOP-PR-25-001071), a multiple-award Indefinite Delivery/Indefinite Quantity (IDIQ) contract for tactical equipment. The solicitation is set aside for small businesses and anticipates approximately 10 awards, with all FBI locations, offices, and LEGATS eligible to use the contract. Key details include a proposal submission deadline of June 10, 2025, at 11 PM CDT, a contract minimum of $1,000, and an estimated 3,000 items ordered monthly (80% via Government Purchase Card). Offerors must submit ceiling prices for a minimum of 90% of items on the Price Evaluation List (PEL) and include pricing for an Incidental Service Scenario, with no page limit for technical proposals and no Federal Firearms License (FFL) requirement.

The Q&A addresses various vendor inquiries, including past maintenance by Delray Industries, system modifications, pricing expectations, and technical requirements. Notably, the contract will have no added cost recovery fee and will be for internal use only. Vendors can provide alternate items that count toward the 90% PEL requirement, and past performance questionnaires are optional. The FBI seeks items that maintain similar form, function, and performance to specified products, with flexibility for minor commercial modifications. The solicitation allows vendors to contact Delray Industries for equipment condition details and provides clarification on requirements such as Buy American, Trade Agreement Act compliance, and technical expert qualifications.

QUESTIONS

Q. Do you know who has maintained the system since it was purchased in 2012? Are there records of services performed on this system?

Can you provide pictures of all components so Bauer can see if components have been changed / removed or repaired?

A. The past maintenance has been done by Delray Industries in Winchester, VA. Assume for the purpose of this contract that the trailer has not been modified.

Q.Do you have an idea of how many Delivery Orders and Frequency will be issued under the STEAL contract?
A.Orders will be competed as needs are identified and funded. This makes it hard to make a statement to frequency with any degree of certainty.

Q Please confirm if attachment 'Section_J_Attachment_1_PEL_V2.0.xlsx' will be updated.

0. Will quantities be provided or should offerors use the quantity of one for each item?

A. Please use the quantity of one (1) for each item.

Q. Currently, Tab 1 does not include columns for offerors to provide pricing for the Base Period (12 months) and each annual Option Period. Will the attachment be updated or should offerors add columns for each performance period?

A. Per L.3 of the solicitation; The prices for the PEL and Acceptable Alternates will be Ceiling Prices after contract award. It is the maximum unit price that the Government will pay during the base period and each applicable option period for items on the PEL.

Q. Could the FBI provide historical or estimated annual demand quantities (ADQs) for the items on attachment 'Section_J_Attachment_1_PEL_V2.0.xlsx'?

A. At this time I am unable to provide history on many of the items.

Q. We have identified few items on the PEL that are non-compliant due to country of origin. Please confirm if the PEL items need to be Buy American and TAA Compliant or if they will be removed from the PEL.

A. Per the solicitation section L.3:

a. Items in the PEL have been identified by NSN (if applicable), manufacturer, manufacturer's part number and material description. If any of the following occur, please contact the Contracting Officer in writing:

· The part number does not match, equal or represent the item description

· The part number has been discontinued

· The part number/product is no longer available from the manufacturer specified.

· The item is not compliant with Sourcing Restriction Requirements

Please advise which items are not compliant.

Q. Please confirm the contract minimum for orders. The minimum is listed as $1,000 on page 6 and “no minimum” on page 35 of the solicitation.

A. Page 6 states the minimum and maximum of the IDIQ contract. The FAR clause on page 35 specifically references each delivery order once the contract is warded.

Q. How many awards are intended for the STEAL contract?

A. The FBI anticipates making approximately 10 awards based on market research and responses from the previous RFI.

Q. How many FBI field offices will be involved in buying activities for STEAL? Can a list of offices/locations be provided?

A. All FBI locations, offices, and LEGATS will be using the contract.

Q. Are there any EDI requirements required for this contract?

A. Just those specified in the solicitation, which include email and the forms in Section J.

Q. NAPU & IPP: Are there direct system to system integrations (EDI, API?) or do suppliers upload items manually uploaded to the systems?

A. No. As stated in the solicitation, email will be used to send and receive requests.

Q. Could the FBI please consider including FAR 52.225-8 Duty-Free Entry in the clauses and provisions for STEAL, given the current market conditions?

A. Yes, the clause can be added to the contract and solicitation.

Q. Please confirm the FBI's Cost Recovery Rate / Fee Amount for STEAL. The cost the FBI will add to the contractor's price when quoted to the end user.

A. This contract will be for internal use only and no fee will be added.

Q. Please confirm if there is a page limit for the technical proposal volume.

A. There is no page limit.

Q. Please provide clarity on Attachment #2 Past performance Questionnaire. Is this attachment for informational purposes only?

A. These, along with other methods stated in section M.4.2 will be used to assess past performance.

Q. Do the past performance questionnaires need to be submitted by the contracting oicer of the utilized reference?

A. No. there is no requirement for the questionnaire to be filled out by a contracting officer.

Q. Can the Government clarify whether proposals oering fewer than all listed items will be evaluated for award consideration, or is the ability to supply all items an evaluation factor?

A. There is no requirement for all items. Please see the solicitation;

M.4.3 Evaluation of Price Price Proposals will be evaluated based on the following:

1) Each proposal will be reviewed to determine if alternate items are acceptable and if Ceiling Prices were submitted for a minimum of 90% of the line items in the PEL or Acceptable Alternates and if pricing was submitted for the Incidental Service Scenario. An offeror that does not meet the 90% minimum of acceptable quoted PEL items or does not submit a price for the Incidental Service Scenario may have its proposal rejected.

Q. To better understand the competitive landscape, can the Government confirm whether possession of an active FFL at the time of proposal submission is a mandatory requirement, and whether this requirement is being used as an evaluation factor or eligibility criterion?

A. There is no requirement for an FFL.

Q. If yes, for either of the previous two questions, please provide information on the metrics for these factors.

A. Please see section M of the solicitation.

Q.Are vendors required to provide incidental services?
A.Yes. M.4.3 Evaluation of Price

Price Proposals will be evaluated based on the following:

1) Each proposal will be reviewed to determine if alternate items are acceptable and if Ceiling Prices were submitted for a minimum of 90% of the line items in the PEL or Acceptable Alternates and if pricing was submitted for the Incidental Service Scenario. An offeror that does not meet the 90% minimum of acceptable quoted PEL items or does not submit a price for the Incidental Service Scenario may have its proposal rejected.

Q.Do alternate items submitted under the Price Evaluation List count toward the 90% requirement if accepted?

Q.Can the government provide clarification or an example of the incidental service scenario for pricing?
A.The incidental service scenario is located on Attachment 1. The PEL is tab 1 and the service is the second tab.
Q.What specific qualifications or documentation are required to meet the 'technical expert with 3 years' experience' requirement?
A.Any documentation showing that the person being used as a technical expert has the required experience, including but not limited to references, resume, CV, etc.
Q.What is the threshold of modification allowed before a 'commercially modified item' becomes ineligible?
A.FAR 2.101- Minor modifications of a type not customarily available in the commercial marketplace made to meet Federal Government requirements. “Minor modifications” means modifications that do not significantly alter the nongovernmental function or essential physical characteristics of an item or component, or change the purpose of a process. Factors to be considered in determining whether a modification is minor include the value and size of the modification and the comparative value and size of the final product. Dollar values and percentages may be used as guideposts, but are not conclusive evidence that a modification is minor;
Q.Please define or provide examples of what constitutes an 'exigent circumstance' for site access under the 48-hour notification rule.
A.According to Miriam-Webster Dictionary, exigent is defined as “requiring immediate aid or action”. The FBI responds to many exigent needs and this part of the solicitation is to cover an unforeseen circumstance that may prevent the offeror from giving 48 hours notice.
Q.Could you please confirm if questions will still be accepted for this solicitation? The final contract document that was updated on May 8th still states that questions were due on March 26, 2025.

We would also like to confirm that the due date for the submission response is June 10, 2025, at 11pm CDT?

A. Please view the SF-30 that was posted on SAM.gov with the solicitation.

Q. If an offeror is planning on switching/subbing an item, what are the salient characteristics the FBI is looking for in that product?

A. The FBI is looking for the same form, function, and roughly the same performance. For example, if a requested item is a weapon mounted light with tail cap push button operation, then a similar item should have that same form and function. Performance metrics such as lumens and candela should roughly the same as the required product.

Q. Since this solicitation is set-aside for small businesses, per FAR 25.401(a)(1), TAA would not be applicable to this procurement. Will the TAA requirement be removed?

A. The provisions and clauses referring to TAA are not selected. The solicitation states C;.3.1 All items must be, at a minimum, Trade Agreement Act (TAA) compliant, if applicable. See “Look up Trade Agreements Act-designated countries” on GSA.gov for a list of TAA compliant countries.

It says “if applicable”. This is because there may be items requested through the contract that still may need to be TAA compliant due to their usage or approval.

Q. As Preference for Certain Domestic Commodities is a DFARS requirement for Department of Defense acquisitions, will this be removed?

A. Yes this reference will be removed.

Q. In reviewing the PEL, there are many items manufactured by Large Businesses, making the requirement of 52.219-33 problematic. FAR 19.505(4) indicates that a waiver may be obtained from the SBA, removing the requirement of 52.219-33. Will a waiver be obtained for this acquisition? If not, we request direction on how to address the large business manufacturers on the PEL.

A. 52.219-33 will be removed.

Q. The example given after the requirement is "Technical Proposal SHOP-PR-25-001071 Jack's Supplies.xls", which is not in the same order as what was previously identified as required. Is the example incorrect, or are Offerors only required to include those three elements, no matter the order?

A. I’m not sure I understand this question. Both references to Jack’s Supplies are listed below and are both just examples of how the different volumes should be labeled.

During proposal evaluation, each volume will be reviewed separately so each volume shall be saved as a separate file and shall be named with offeror’s company name, volume name and the solicitation number, for example “Technical Proposal SHOP-PR-25-001071 Jack's Supplies.xls” to facilitate an efficient evaluation.

The pre-formatted spreadsheet(s) is the ONLY acceptable method of returning the Price Proposal(s). Request returned file(s) shall be renamed with offeror’s company name, volume name and the solicitation number, for example “Price Proposal SHOP-PR-25-001071 Jack's Supplies.xls”.

Q. The solicitation doesn't address the requirement for submission, only that the Offeror provide information regarding past performance contracts. Could the Government clarify if Past Performance Questionnaires are required, and if so, provide any requirements for submission?

A. A lack of past performance will not be held against an offeror. The questionnaires, if submitted, will be used as one of the tools to assess past performance in accordance with the tables and descriptions in the solicitation.

Q. It is understood per the previous Q&A issued on 5/14, that we should assume for the purpose of the contract that the trailer has not been modified. However, in discussions with the manufacturer, Bauer, they are unable to provide a five-year preventative maintenance cost estimate without conducting an evaluation on the current status of the system. Please advise on how the Offerors are to proceed with pricing this item.

A.Offerors are able to contact Delray Industries located in Winchester, Virginia for any questions in reference to the condition of the equipment.
Q.Can you please provide the serial numbers of the Bauer Compressors(TCOM-35XL-128164) in service to allow the manufacturer’s certified technicians to quote and estimate these items’ maintenance requirements?
A.The serial number is included. It is 128164.
Q.There are currently no instructions or specific requirements in Section L that explain how offerors are supposed to complete the Attachment 2 – Past Performance Questionnaire. Can any requirement for PPQs be removed from the proposal, while still requiring offerors to provide three past performance examples?
A.The instructions to submit the form are stated on the form itself and are copied below. If the question is the address, please submit to Brian Ames at bames@fbi.gov.

Upon completion of this form, please e-mail it directly to the Contracting Officer, {ADD CONTRACTING OFFICER’S NAME}, at {ADD CONTRACTING OFFICER’S EMAIL}; Contract Specialist, and {ADD CONTRACT SPECIALIST’S NAME}, {ADD CONTRACT SPECIALIST’S EMAIL}

Q.Are there any restrictions on using an FBI contract as a past performance example?
A.No. If it is applicable, an FBI contract may be used.
Q.The Nonmanufacturer Rule (FAR 52.219-33) is checked, which means that awardees (small businesses) are prohibited from providing the products of a large OEM. Is that the case? How will the Government interpret/administer this clause? Will small businesses be precluded from providing large OEM products or does the Government have a waiver or other mechanism in place to allow products from large OEMS to be purchased (which we believe will represent a significant piece of this contract)?
A.52.219-33 will be removed.
Q.Please provide further details around the number of estimated weekly and/or monthly delivery order RFQs the Government expects awardees to respond to? This information is critical to preparing and meeting the quote rate performance metric in Section G.3.6.
A.The FBI estimates approximately 3000 items ordered per month. Approximately 80% of these orders will be Government Purchase Card orders directly from Field Offices and Headquarters Units.
Q.Per Section G.3.6, contractors “shall have adequate personnel to respond to Delivery Order RFQs with the ability to expand in response to increased sales volume.” What is the Government’s understanding of what “adequate personnel” is? Providing industry with a better understanding of the contract operational tempo and workload (e.g., task order frequency, etc.) will help industry better prepare their resources and align their contract management teams to meet the FBI’s goals and expectations.
A.“Adequate personnel” refers to the ability of the offeror to respond to the needs of the contract. However the offeror plans to meet the needs of taking orders and filling them is up to the offeror. The FBI is not demanding a certain quantity of employees assigned, just that the offeror has the flexibility to meet the needs. Some parts of the year funding is more prevalent than others, and the FBI wants offerors to be able to meet the needs at any given time.
Q.Some of the items on the current Government provided pricing volume do not have a listed manufacture part number. This is crucial for some of these items as they there are items that may have color, sizing, configurations, and accessories that must be detailed to get valid pricing for this proposal. Can the Government provide that level of detail for those lines missing a MPN on this document?
