About this file

This Request for Proposals (RFP) is issued by the Massachusetts Trial Court, Office of Court Management, Facilities Management & Capital Planning (FMCP), and solicits preventive maintenance, inspection, operational testing, load-bank testing, repair, and emergency services for standby generators, automatic transfer switches (ATS), and uninterruptible power supply (UPS) systems across Trial Court facilities statewide. The solicitation is structured as five independent regional award opportunities, with bidders permitted to submit proposals for one or more complete regions without partial-facility bidding within a region. The RFP encompasses 35 Trial Court facilities distributed across five geographic regions, with detailed equipment inventories provided in Attachment A. The procurement was posted on September 14, 2026, with a question submission deadline of September 24, 2026, and a bid due date of September 30, 2026, at 12:00 PM. Pre-bid site visits will be scheduled individually with facilities, and the anticipated notice of award is October 2, 2026. The initial contract term runs from November 1, 2026, through June 30, 2029 (32 months), with two optional one-year renewal periods extending through June 30, 2031.

Bidders must submit facility-specific preventive-maintenance pricing for each of five pricing periods, unit pricing for load-bank tests, ATS and UPS maintenance, technician labor rates (regular, overtime, Saturday, Sunday, and holiday), and parts and materials pricing, with all costs evaluated against fixed quantities established by FMCP to determine the lowest responsible and eligible bidder per region. A 5% bid deposit is required for the greatest possible bid amount per region. Bidders must demonstrate at least five years of experience maintaining comparable commercial or institutional standby power systems, possess factory-trained technicians for supported manufacturers, maintain 24-hour emergency dispatch capability, hold all required licenses and certifications, and provide three comparable references. Minimum insurance requirements include $1,000,000 commercial general liability per occurrence, $1,000,000 automobile liability, statutory workers' compensation, and $2,000,000 umbrella coverage. No guaranteed minimum volume of repair calls or additional services is offered; however, scheduled preventive-maintenance services are firm obligations. The contract includes prevailing-wage requirements consistent with Massachusetts Department of Labor Standards determinations.

1. Contract and Award Structure

1.1 Regional Awards

• Region 1, Region 2, Region 3, Region 4, and Region 5 are separate bid and award units.

• A Bidder may bid on any number of regions but must bid every listed facility and all required services within each selected region.

• The Trial Court may award multiple regions to one Bidder when that Bidder is the lowest responsible and eligible bidder for each region and demonstrates capacity for simultaneous performance.

• The Trial Court may make no award for a region, reject a nonresponsive bid, or reject a Bidder determined not responsible or not eligible.

• Facilities and equipment may be added, removed, relocated, or replaced through an authorized contract amendment or other written mechanism permitted by the contract.

1.2 Term

The initial contract term is thirty-two (32) months, beginning November 1, 2026, and ending June 30, 2029. The

Trial Court may exercise two additional one-year renewal options: July 1, 2029 through June 30, 2030, and July

1, 2030 through June 30, 2031. Each renewal is subject to satisfactory performance, available funding, authorized pricing, and required approvals.

1.3 No Guaranteed Volume

The Trial Court does not guarantee any minimum quantity of repair calls, parts, load-bank tests beyond the scheduled requirements, or additional services. Preventive-maintenance services identified as required are firm obligations; all other work must be authorized in writing.

2. Applicable Requirements and Contractor Qualifications

2.1 Codes and Standards

Work shall comply with all applicable laws, regulations, permits, manufacturer instructions, and the editions of codes and standards adopted or otherwise applicable to the facility and equipment at the time the work is performed. Requirements include, as applicable:
