About this file

This document comprises the State of Colorado Purchase Order Terms and Conditions combined with a Trane U.S. Inc. service proposal for commission air handlers maintenance and repair work. The Colorado procurement framework establishes the legal and operational parameters governing the purchase order, while the Trane proposal (Proposal ID: 1440421) provides specific service offerings for qualified equipment. The proposal was valid for 30 days from September 19, 2012, and required written acceptance by the customer within this timeframe. The services are to be performed during normal Trane business hours, with outside-hours work billed separately at overtime or emergency rates. The agreement is subject to credit approval by Trane, and any disputes regarding service acceptance will be governed by the terms in effect at the time of service delivery.

The total service price is $442,300 USD, with applicable taxes included in this amount. Trane warrants materials for 12 months from equipment start-up or replacement and labor for 90 days from completion, excluding wear and tear, corrosion, customer maintenance failures, and modifications by non-Trane parties. Payment is due upon receipt of invoice, with service charges applied to accounts outstanding beyond 30 days at the lesser of the maximum allowable legal interest rate or 1.5 percent monthly. Trane maintains commercial general liability insurance of $2,000,000 per occurrence and automobile liability of $2,000,000 combined single limit, with workers' compensation at statutory limits. The agreement is governed by the laws of the state where services are performed and may not be assigned without written consent from Trane. Colorado's purchase order terms supersede any conflicting vendor terms and require compliance with federal and state employment, safety, tax, and cyber security requirements.
