About this file
This is a State Buy America Requirements document issued by the Oregon Department of Transportation (ODOT) for the I-5 MP 189.5-192.2 NB & SB Pave Patching On-Call Region 2 Paving project. The document establishes mandatory domestic preference requirements under Oregon Revised Statutes (ORS) 279C.303, stipulating that all steel, iron, coatings for steel and iron, and manufactured products incorporated into the project must be produced in the United States. For iron and steel products, all manufacturing processes from initial melting through coating application must occur within the United States. For manufactured products, manufacture must occur domestically and U.S.-mined, produced, or manufactured components must comprise more than 55 percent of the total component cost. No de minimis exceptions are permitted, and strict compliance is required for all materials permanently incorporated into the project.
Contractors are required to submit a Certificate of Materials Origin on an ODOT-approved form prior to incorporating applicable materials into the project; materials without such certification will be deemed of foreign origin. The contractor bears full responsibility for compliance with ORS 279C.303 requirements, including compliance by all first-tier subcontractors, lower-tier subcontractors, service providers, and materials suppliers. This provision must be included in all subcontracts. The contract document does not specify pricing terms, funding sources, award dates, or contract duration, as these requirements apply to the broader paving project referenced in the work order title.
