SOLICITATION SSP50015R0002

JANITORIAL SERVICES FOR THE U.S. EMBASSY MADRID, SPAIN

QUESTIONS AND ANSWERS # 2

Question 1: What is the working schedule of the personnel currently providing services at the premises located at Calle Serrano, 75?

Answer 1: As stated in Exhibit A “All standard are to be delivered on regular Embassy working days and on American holidays, from 08:00 to 22:00, as directed by the COR.

Question 2: Does the employee listed as Supervisor under Section I.6 perform all his/her daily work-schedule at the Embassy?

Answer 2: The information provided under Section I.6 pertains exclusively to the services currently being rendered under this contract.

Question 3: Is any of the current personnel, such as the employee with a seniority of 1975, close to retirement?

Question 3: The necessary information for any potential offeror to comply with the “Right of First Refusal” in accordance with Spanish labor law is contained in Section I.6. Any other information cannot be disclosed as it is protected by the US Privacy Act and the Spanish Data Protection Law.

Question 4: How long has the current contractor (Planting, S.L.) been performing the janitorial services at the U.S. Embassy? Was the term of their current contract 5 years?

Answer 4: The current contract was awarded in 2010 for a base period of one-year plus four option years.

Question 5: Per the solicitation, the contractor is required to offer employment to the current janitorial staff. Please make available the terms and conditions of their employment, i.e. wage/salary, benefits, vacation, etc.

Answer 5: Terms and conditions of employment for current janitorial crew are in accordance with the Janitorial Union Agreement and the Spanish labor law. Potential Offerors should refer to the information provided under Section I.6 in order to comply with the Right of First Refusal of Employment as mandated by Spanish labor law.

Question 6: Does the Government expect or require that copies of licenses, permits, insurance certificates, etc. to be submitted with the proposal be translated into English?

Answer 6: Please see refer to Provision 52.214-34 – Submission of Offers in the English Language (Apr 1991) under Section L.2 of the solicitation.

Question 7: Usually, the shampooing of carpet and the vitrifying of all hard and synthetic floors need to be accomplished when people are not around to ascertain the best results. If the American holidays do not permit enough time for the contractor to perform these works, does the contractor have the option to perform these tasks on Saturdays and bring in extra personnel to perform them?

Answer 7: Upon request, the Contractor might be authorized to perform these tasks on Saturdays and with extra personnel. However, the Contractor will not be entitled nor authorized to additional compensation.

Question 8: Although we have it clear that, in accordance with Provision 52.215-34 Submission of offers in the English language the proposal should be in English, we wonder if some of the documents that form the proposal, such as the description of the cleaning products or the organization chart of the company.

Answer 8: The Provision 52.215-34 Submission of offers in the English language applies to all documents that form part of the proposal.

Question 9: Section L.5 - Financial Statement states that “If asked by the Contracting Officer, the offeror shall provide a current statement of its financial condition, certified by a third party, that includes …” Who would be an acceptable “third party” for the purpose of certifying the statement? Dois it need to be certified by an auditing company? Could it be an Spanish bank?

Answer 9: A third party means an independent party that has the capability to certify a financial statement that includes all the requirements listed under Section L.5.
