Justification for Single Source Awards IAW FAR 13.106-1
For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C241-25-AP-4107
1. Contracting Activity: Department of Veterans Affairs, VISN 1, Station 523, Facilities
Management Service, VA Medical Center (VAMC) Brockton, 940 Belmont St, Brockton, MA 02301.The proposed procurement, Request for Proposal (RFP) 36C24125R0103, 523A5-18-371 Building 4 Elevator Replacement Construction Period Services (CPS).
2. Brief Description of Supplies/ Services required and the intended use/Estimated
Amount: The VAMC Brockton is initiating the construction for the 523A5-18-371 Building
4 Elevator Replacement project. This sole source justification is to contract to William
Pevear Architects, Inc. (WPA) who serves as the Architect/Engineer (A/E) Designer of
Record to provide CPS for the project. These services were previously awarded to the A/E
Designer of Record but were descoped due to the expiration of funds. The proposed action is to provide follow on CPS during the construction phase of the project.
CPS are to include, but are not limited to, review and approval of construction submittals, samples, shop drawings, schedules, phasing plans; response to Requests for Information
(RFI); change order review and recommendations; preparation of cost estimates to Requests for Proposal (RFP); cost/time/impact estimates and recommendations relevant to apparent construction plan deviations; site visits as required and/or requested by the VA Contracting
Officer and Project Engineer for inspection of ongoing construction including final tests and inspections; documentation of all necessary site visits to the VA Contracting Officer and
Project Engineer; verification and preparation of as-built drawings from contractor supplied marked up prints.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: WPA is the A/E Designer of Record and was previously awarded the design and CPS for this project but was descoped due to expired funding. Awarding this project to another A/E firm would add significant risk to the facility due to a loss of technical familiarity with the project. Specifically, the technical review for familiarity of and changes to conditions, hazardous materials, industrial hygiene, and the commissioning review.
The proposed sole source contractor has worked very closely with the technical and functional resources at the Brockton VA and gained significant knowledge of the requirements to facilitate the previously completed design. The exposure to the VA and design work will be crucial as the construction project is completed. WPA has intimate knowledge of the design due to their execution of the design under a previous contract. If https://www.acquisition.gov/?q=/browse/far/13

Effective Date: 11/15/2024 Page 2 of 2 another vendor is selected, additional risk would be incurred as the new contractor’s staff may not fully understand the intent and context of the requirements included in this design.
Furthermore, another source would require a steep learning curve while gaining familiarity with the design itself.
Additionally, the A/E designer of record needs to be retained for CPS for warranty and liability issues. CPS is a continuation of the design and procuring a different A/E for these services will relieve WPA of their responsibilities and could forfeit VA’s total liability for faulty design and selection. WPA is liable for making any corrections to the design if problems occur during construction.
4. Description of market research conducted and results or statement why it was not conducted: The project’s design was produced by WPA (A/E designer of record). CPS was provided within their initial project proposal which included Concept, Design, and CPS.
WPA is therefore best positioned to provide these services without additional delay and performance risk associated with engaging a different contractor.
