About this file
This is a Justification for Sole Source Procurement document submitted by the National Institute for Occupational Safety and Health (NIOSH), Health Effects Laboratory Division (HELD), under the Centers for Disease Control and Prevention (CDC).
The procurement seeks calibration services for pipettes and balances at the HELD facility in Morgantown, West Virginia. The proposed sole source vendor is Pipette Repair Service, Inc., located in Midlothian, Virginia. The requirement is not on a GSA Schedule. The justification cites FAR 13.106-1(b)(1) and establishes that only one source is reasonably available based on the Government's specific requirements. The Program Office conducted market research and identified two alternative vendors—Unity Lab Services and Transcat—but determined that Pipette Repair Service was the only vendor meeting all technical, compliance, and cost requirements. Key requirements include on-site service capability at the Morgantown location, ability to repair and calibrate multiple pipette brands, ISO 17025 certification, provision of calibration certificates and reports for each serviced unit, and a one-year warranty. Transcat was rejected due to inability to provide on-site service and higher pricing, while Unity Lab Services did not demonstrate equivalent overall value and alignment with all specified requirements. The justification has been certified by the CIO Project Officer (Ava Winn), Branch Chief (John D. Noti), and Management and Program Analyst (Yvette Bostic), with digital signatures dated March 31 and April 1, 2026. The Contracting Officer certification section remains incomplete in the document.

JUSTIFICATION FOR SOLE SOURCE PROCUREMENT (OPEN
MARKET OR GSA) UNDER $250,000
Sole source acquisitions may be used on a limited basis and only when the Contracting Officer’s Representative (COR)/Program Official has provided sufficient justification and the Contracting Officer has determined that the circumstances warrant such action. The content for a justification must contain detailed facts and rationale to justify the sole source acquisition. Soliciting from a single source must be done in accordance with FAR 13.106-1(b) or 8.405-6. At a minimum, the following information must be included:
Identification of Program Office, Contracting Activity, and Proposed Requirement, Justification and Program Office Certification:
A. Program Office:

1095 Willowdale Road Morgantown WV 26505
B. Contracting Activity:

2. Proposed Vendor and Estimated Procurement Amount (if available):
a. Proposed Vendor: Pipette Repair Service, Inc.

b. Estimated Procurement Amount:
3. Is the requirement on GSA Schedule? Yes No
If yes, provide schedule number:
Rev. 5/14/19
Rev. 10/15/18
D. Justification:
1. The justification for this non-competitive action is:
In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”
Urgency Exclusive licensing agreements/Proprietary data Brand name required Industrial mobilization
Other (e.g., compatibility, space issues, continuity, etc.)
In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”
Urgency Only One Source Logical Follow Up Brand name required
2. Other facts supporting sole source procurement:
a. What can this product/service do that other products/services cannot do?
The services provided by the vendors that responded to our request for a quote were compared against our list of requirements and specifications; the service must be performed on-site, the vendor must be able to repair and calibrate most major brands and types of pipettes, vendor must be ISO 17025 certified, and when required the vendor must provide a certificate and/or calibration report for each pipette serviced, as well as a one year warranty. Pipette Repair Service is the only vendor that met all the requirements
b. What other products/services were considered and why did they not meet the need?
Other vendors identified through market research included Unity Lab Services and Transcat. While both vendors were capable of providing pipette and balance calibration services, they did not fully meet the Government’s requirements.
Transcat, for example, was unable to meet the requirement for on-site service at the Morgantown location and therefore could not satisfy a key performance requirement.
Additionally, their pricing was higher (e.g., higher per pipette and balance service costs), making them a less cost-effective option.
Unity Lab Services was considered capable; however, it did not demonstrate the same overall value and alignment with all specified requirements when compared to Pipette Repair Service.
All vendors were evaluated against the established criteria, including on-site service capability, ability to service multiple pipette brands, ISO 17025 certification, provision of calibration certificates/reports, and warranty requirements. Pipette Repair Service was the only vendor that met all technical, compliance, and cost requirements, and therefore was determined to be the only vendor capable of fully satisfying the Government’s needs
3. Program Office efforts to seek potential offerors:
Conducted internet search of vendors who conduct pipette calibration and maintenance. No other vendor was identified who provided all the requirements of the procurement.
