About this file
This is a Justification and Approval document for Other Than Full and Open Competition for a sole-source acquisition. The U.S. Department of Health and Human Services (HHS), Centers for Disease Control and Prevention (CDC), Office of Acquisition Services is acquiring death record data services under a firm-fixed priced contract from 57 jurisdictions: the 50 states, the District of Columbia, New York City, American Samoa, Guam, Northern Mariana Islands, Puerto Rico, and the Virgin Islands.
The Government requires jurisdictions to maintain and operate information systems from which selected death record data will be extracted and transmitted to the National Center for Health Statistics (NCHS). The contractor must provide all personnel, materials, services, and facilities necessary to deliver this information. The acquisition is justified under Revolutionary FAR Overhaul 6.103-1 based on the principle that each jurisdiction is the only responsible source capable of providing death data for deaths occurring within that specific jurisdiction, as they control the intellectual property and technical data required. Pricing is set at $0.034 per record based on the 2024 closed data year, with additional user fees paid to jurisdictions for the previous calendar year (2025). The justification was approved on 2/19/2026 by Contracting Officer Sheena Delaine and Approving Official Sheena Delaine, pursuant to Revolutionary FAR Overhaul 6.304 and HHSAR 306.304.
