About this file
This is a Sole-Source Determination and Justification document submitted by the Oregon Department of Education's Contract Officer Karen K. Harrison on December 2, 2024, authorizing a sole-source contract with OregonASK (a program of the Oregon Association for the Education of Young Children) to provide Out-of-School Time (OST) coordination services. The contract supports Year One and Year Two activities of the Department's five-year Healthy Schools Grant funded by the U.S. Department of Health and Human Services, Centers for Disease Control and Prevention. OregonASK will serve as the designated lead for OST activities, including providing a minimum of three professional development opportunities, technical assistance, communication disbursement statewide, attendance at Oregon Healthy Schools trainings and meetings, and monthly evaluation reports. The contract has a maximum total value of $75,000 ($15,000 annually) and will operate for five years, expiring on June 29, 2029.
The sole-source justification is based on OregonASK's unique position as Oregon's statewide Out-of-School Time Network and its established role as a represented member of the Oregon Healthy Schools Team. The Oregon Department of Education determined that OregonASK is the only organization in Oregon capable of providing statewide reach to OST programs and families, and that awarding this contract will not substantially diminish competition as the acquisition requires compatible services from an organization with existing established relationships and infrastructure. The contract was authorized under Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275, with the approval of Julia Alpernas, the Designated Procurement Officer, and signatures from Jennifer Young (School Wellness Policy Coordinator) and Dustin Melton (Director, Child Nutrition Programs).

1. Authority to enter into a Sole-Source Contract: OAR 125-246-0170(2)(c)(H) Sole Source Justification pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275, the Oregon Department of Education finds a Sole Source Contract is necessary to efficiently acquire services for work that will contribute to Agency’s Year One (1) and Year Two (2) of the five (5) year Healthy Schools Grant on the current five-year U.S.
Department of Health and Human Services, Centers for Disease Control and Prevention (“CDC”) award: School-Based Interventions to Promote Equity and Improve Health, Academic Achievement, and Well-Being of Students.
2. Estimated Total Value of Contract: maximum $75,000 ($15,000/year)
3. Subject of Contract: Services Contractor will assist School Districts to meet the requirements of ORS 329.496 and be the designated lead for Out-of-School Time (“OST”) Activities (trainings, technical assistance, communications, data collection and reporting).
4. Background:
Agency was awarded a five (5) year Healthy Schools cooperative agreement through the Center for Disease Control and Prevention (CDC). Coordination with out-of-school time and after-school programs is a priority within the grant. The work focuses on planning, promotion, and implementation of professional development, technical assistance, and communications with school district program providers specifically focused on nutrition, physical activity and managing students with chronic health conditions using the Whole School, Whole Community, Whole Child (WSCC) framework.
OregonASK is a program of the Oregon Association for the Education of Young Children (ORAEYC).
OregonASK is the statewide organization representing Out-of-School Time (OST) programs and is a critical partner in the work of the family and community engagement components of the WSCC framework.
ORAEYC through the OregonASK program will provide its members, and educators statewide, and Agency the following:

The duration of the Contract is limited to five (5) years and will expire on June 29, 2029.
5. Findings:
Pursuant to ORS 279B.075:
OregonASK is the statewide Out-of-School Network for Oregon and part of the National Out-of-School Time network. OregonASK has been involved in school health issues and is a partner in the Oregon Healthy Schools work and a represented member on the Oregon Healthy Schools Team. OregonASK is unique in that it is the statewide Out-of-School Time (OST) Network for Oregon and serves families and OST programs across the state, with no other group of this nature having the reach in Oregon.
A. Market Research Overall Finding.
The Contracting Officer makes the following determinations:
Pursuant to ORS 279B.075(2)(a): - It is unlikely that such a Sole Source contract will substantially diminish competition as the efficient utilization of existing goods requires the acquisition of compatible goods or services. OregonASK is the only OST Network in Oregon.
The resulting contract will be in the amount of $75,000.00 ($15,000/year) and will be issued according to authority of OAR 125-247-0275 with reasonable effort made to ensure competition.
