About this file

The document is a Statement of Work (SOW) for Laboratory Analysis of Industrial Hygiene Samples, dated 4-14-2025. The SOW appears to be associated with a pre-solicitation Request for Information (RFI) from Brookhaven Science Associates on behalf of Brookhaven National Labs. The opportunity is specifically seeking qualified small businesses, with a preference for women-owned small businesses, to perform laboratory analysis of industrial hygiene samples for the Department of Energy Office of Science.

The solicitation (SS_463300) requires interested parties to submit confirmation of their ability to meet the outlined requirements and provide their System for Award Management (SAM) Unique Entity Identifier (UEI) number via email to enagel@bnl.gov. While this is currently a Request for Information only, it suggests a potential future competitive procurement for industrial hygiene sample laboratory analysis services. The specific details of the required sample analysis, technical specifications, and evaluation criteria would likely be contained within the full SOW document, which was not fully provided in this excerpt.

Brookhaven Science Associates, LLC Scope or Work Laboratory Analysis of Industrial Hygiene Samples April 14, 2024

This Scope of Work is to provide Industrial Hygiene laboratory analytical services to Brookhaven Science Associates, LLC (BSA), operator and manager of Brookhaven National Laboratory (BNL), on an as-needed basis.

The Contractor and their analysis methodologies will adhere to the follow requirements and specifications:

a) Only the methodology requested by BSA will be used by the Contractor. No other methodology can be utilized or substituted without the express prior written approval of BSA. Substituted, modified, or equivalent methodologies with equivalent or better detection levels can be used only with the express prior written approval of BSA’s authorized representative(s).

b) The Contractor’s laboratory shall be accredited by the American Industrial Hygiene Association (AIHA). Any/all laboratory accreditation certificates shall be documented and submitted to the Authorized BSA representative(s). The Contractor’s laboratory shall participate in AIHA, National Voluntary Laboratory Accreditation Program (NVLAP), Environmental Microbiology Laboratory Accreditation Program (EMLAP) or other similar proficiency testing as applicable to the methodology. Preferred participation and maintain status in the AIHA PAT Program.

c) The Contractor will maintain accreditation per each analysis methodology specified in the “Sample Testing/Analysis Schedule” attached hereto as Attachment (A). Documentation provided to BSA will include a copy of Contractor's Certificate of Accreditation and summary of statistical results of analysis by the Contractor. If during the contract period, accreditation is withdrawn, the Contractor will notify BSA within One (1) business day of the loss of such accreditation.

d) The Contractor will notify the Authorized BSA representative(s) via email the day of receipt of sample(s) by the Contractor.

e) Day 1 of the turnaround time cycle will be calculated 24 hours after the Contractor receives sample. Example: Contractor receives sample(s) at noon on February 5, 2025, Day 1 will be calculated as February 6, 2025, at noon.

f) The standard turnaround time will be five (5) business days from the time of receipt of samples at the Contractor's location. For special circumstances (i.e. large number of samples (>50 to be analyzed), turnaround time will be agreed upon in writing between BSA and the Contractor laboratory prior to shipment of samples.

g) If, due to extenuating circumstances and identified on day of receipt, the requested turnaround time cannot be met the Contractor must immediately notify the authorized BSA representative. The authorized BSA representative may request the return of samples, request they be forwarded to another laboratory at no additional cost, or may agree to a different turnaround time.

h) Unless a different turnaround time is approved by the authorized BSA representative, the turnaround time for any sample shall not exceed fifteen (15) business days. Should the Contractor exceed the fifteen (15) business day turnaround time, the Contractor shall waive any charges to BSA for said sample(s).

i) If a five (5) day turnaround time is not met for receipt of results, but the results were delivered to BSA by the 15th day, the cost associated with the analysis will be 50% of the five (5) day turnaround pricing.

j) Should Contractor deliver the analysis report to BSA after requested turnaround time, BSA shall only be charged for the next turnaround timeframe, instead of what was requested. For example: If BSA requests a 24-hour turnaround, however, the Contractor delivers the associated report to BSA on the 2nd day, the Contractor may only charge BSA for the three (3) day turnaround time agreed to in the contract. If the Contractor delivers the report to BSA on the 4th day, the Contractor may only charge BSA for the standard five (5) day turnaround time, etc.

k) BSA shall not be charged for a turnaround time shorter than what was originally requested. For example: If BSA requests a turnaround time of five (5) days and the Contractor delivers report to BSA in 24-hours, BSA shall only be charged for the five (5) day turnaround time requested.

l) When a sample is requested to be tested for multiple analytes, then the charge applied for the sample cannot exceed the maximum scan method price (i.e. $250).

m) The Contractor will deliver the analysis report(s) via email, in pdf format, to the Authorized BSA representative(s) identified on the Chain of Custody on the day the analysis is completed. For large numbers of samples (>50), analysis must be conducted in “batches” and interim results received by BSA as soon as analysis of the batch is completed. In the event of an analysis report delay due to the inability for the Contractor laboratory to review/approve results, the contractor laboratory will notify the BSA representative on the Chain of Custody time of known delay.

n) The Contractor will email analysis results in a BSA-specified Microsoft Excel® file, or other CSV format, to the Authorized BSA representative(s) identified on the Chain of Custody on the day each analysis is completed.

o) The analysis report results will include the sample number used by BSA, chain of custody identifier used by BSA, date of sampling, analyte, date of analysis, concentration detected, units of measure, limit of quantification, limit of detection, and method of analysis.

p) BNL Limits of Detection for wipe samples are shown in the attached supplemental “BNL-Adopted Surface Wipe Criteria” document attached hereto as Attachment B.

q) The Contractor will perform Quality Assurance validation to verify that the correct sample identifier, sampling volume/area, methodology, analyte quantity/concentration, and calculations of analyte per unit of sampling volume are associated with each analysis performed.

r) The Quality Assurance validation shall verify that all information is correctly indicated on the printed and electronic analysis reports.

s) Quality Assurance validation shall be documented in the final report submitted to BSA.

t) Media will be provided to BSA on request without additional cost, inclusive of shipping for all analytes specified in Attachment A.

u) Pricing for additional analytes specified in the catalog provided by the analytical laboratory will be inclusive of media cost and shipped to BNL at no cost for standard turn around.

v) If BSA requests expedited media shipping, BSA will pay for the associated shipping cost.

w) Invoicing will correspond to Chain of Custody submissions and will list analyte description and approved methodology.

x) The contractor will include the BSA specific chain of custody number on each corresponding invoice.

Other:

1. Samples will be shipped from BNL via Federal Express or United Parcel Service to the Contractor. BSA will pay for the shipping of samples from BNL to the Contractor.

2. The Contractor may be asked to perform analysis on other types of samples using methods listed in the Contractor's catalog or as per BSA’s preferred requested methodology.

3. Contract parties may not pass along price increases from subcontract laboratories if the requested samples cannot be analyzed in-house with a contract specified methodology. Comment by Nagel, Eric: Has this been an issue in the past?

4. A pre-award inspection of the Contractor's laboratory facility may be performed by BSA Industrial Hygiene and Quality Assurance staff at the discretion of BSA or at any other time during the contract, with proper justification.
