About this file

This is a self-certification representation form issued by the Indian Health Service (IHS) under the Buy Indian Act for Indian Economic Enterprise (IEE) eligibility.

The form requires offerors to self-certify their status as an Indian Economic Enterprise with Indian Ownership in response to Sources Sought Notices, Requests for Information (RFI), or Solicitations. Offerors must meet the definition outlined in HHSAR 326.601 at three critical junctures: when submitting an offer, at the time of contract award, and throughout the entire contract performance period. Any contractor that loses eligibility during these periods must immediately notify the Contracting Officer in writing. Contracting Officers may request documentation of eligibility before awarding set-aside or sole-source contracts, and awards are subject to protest if the successful offeror's eligibility is questioned. Successful offerors must also maintain registration with the System of Award Management (SAM). The form serves as a template with fields for the solicitation/sources sought/RFI number, project title, date, federally recognized tribal entity name, business name, the 51% IEE firm owner's name, certifying signature, printed name, and Unique Entity Identifier (UEI) number. False or misleading information submitted in offers is subject to penalties under 18 U.S.C. 1001, and false claims during contract performance are punishable under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
