About this file
This addendum to Formal Invitation to Bid #2258147098 is issued by the City of Portland, Oregon Procurement Services on behalf of Portland Public Schools and regional school districts (David Douglas, Parkrose, and Riverdale). The document modifies the scope of work and timeline for maintenance and rehabilitation services focused on vegetated stormwater management facilities located on school properties. The services include inspection, maintenance, and stewardship of bioswales, rain gardens, vegetated planters, and related green infrastructure at numerous school sites across the metropolitan area. The original proposal deadline of August 17, 2026 has been extended to August 31, 2026 at 4:00 PM local time. The addendum clarifies that the work scope emphasizes vegetation management, sediment and debris removal, erosion control, invasive species management, and mulch replacement rather than heavy structural repairs. Contractors are also expected to support environmental education and facilitate volunteer engagement opportunities with school communities. The contract includes a two-year warranty on all plantings, requiring 90 percent vegetation coverage with minimum 75 percent as the baseline threshold.
The addendum addresses thirty-two substantive inquiries received from potential bidders regarding scope clarification, pricing methodology, and operational logistics. Key clarifications include that specialized filters and structural hardware are excluded from scope; plant materials should be bid using a cost-plus model with markup on wholesale prices; mulch should be invoiced at wholesale prices; and all other materials and labor should be itemized separately using hourly rates. Contractors are permitted to establish inspection frequency based on site needs and may combine inspection and maintenance activities within single site visits. Sediment disposal must occur at sanitary waste facilities, not composting operations. The City will provide a prioritized inventory of facilities and will facilitate school district coordination regarding site access and working hours, though contractors are responsible for obtaining all required permits and compliance with individual school district policies. The contract budget is noted at $170,000, though the City indicated openness to awarding work to multiple contractors and indicated it would select bids offering the greatest value in terms of facilities maintained and knowledge transfer to school personnel.

Section 2: Inquiries Received
TECHNICAL QUESTIONS:
1. Section 1.2.4 lists heavy infrastructure items including underground stormwater vaults, oil/water separators, storm drainpipes, conveyance systems, manholes, and junction boxes. However, Section 1.2.5.4 defines structural maintenance as "resetting displaced grates/covers, minor concrete patching, soil stabilization for erosion repair, and replacement of damaged inlet screens where feasible." Can the City clarify if the contractor is responsible for the actual structural replacement or major repair of heavy infrastructure (e.g., cracked storm drainpipes, failing concrete vaults, or malfunctioning oil/water separators)?
2. If a facility requires heavy equipment or structural construction work that exceeds "minor concrete patching," is this work excluded from the base scope, or will it be handled via a separate work order/amendment?
Answer: The answers to questions 1-2 are as follows: These questions have been clarified through the edited Scope of work.
Please refer to the edited Scope of Work which includes modifications to section 1.2.4. to find the answers to these questions. In summary, the work is focused on vegetated stormwater facilities and not heavy-duty structural labor.
3. Will the City confirm that heavy industrial materials; specifically heavy metal drain hole covers, large iron grating, boulders and/or large-scale riprap erosion barriers, are excluded from the contractor's material sourcing scope?
4. If these heavy structural components are damaged and require replacement, will they be sourced and provided directly by the City for the contractor to install, or will the entire replacement operation be handled by City public works crews?
5. 1.2.5.5 This section requires "cleaning/replacing filter cartridges or media and maintaining oil/water separators." What specific brands, models, and types of proprietary treatment devices and filter cartridges are currently installed across the sites?
6. Does the City provide the specialized replacement filter cartridges/media, or is the contractor expected to source and purchase this mechanical infrastructure?
Answer: The answers to questions 3-6 are as follows: Please refer to the edited Scope of Work which will focus on vegetated stormwater facilities, i.e. vegetation control and removing “structural/mechanical” facilities from scope. Thus, these questions will be clarified through the edited Scope of work.
7. The contract requires the contractor to provide inspection, maintenance, https://www.instagram.com/PortlandGov/

Description automatically generated and repair to ensure "effective operation." However, the initial state of these bioswales and facilities is unknown and likely varies from site to site. Is the contractor expected to perform heavy "catch-up" rehabilitation work to bring neglected sites up to baseline compliance?
Answer: Initial assessment of facilities may be prudent to evaluate needs per school. Based on City inspection reports and experience, few facilities require significant rehabilitation.
However, it is possible that significant rehabilitation may be required on some facilities.
8. In the event that a facility or bioswale requires extensive initial repair, heavy sediment excavation, or total replanting, how should this be factored into the bid? Can an initial assessment and rehabilitation phase be invoiced separately on a time-and-materials basis?
Answer: Yes. This is advisable.
9. The text requires facilities to be properly planted, but does not provide an inventory of what is currently missing. To prevent unbalanced bidding, will the City place a contractual cap on the maximum quantity or dollar amount of plants and materials a contractor is required to provide per site, per year, under the base contract?
10. If a site requires vegetation replacement that exceeds this cap, will that work be handled through an additional, separate work order?
11. Will the City allow materials (such as plants, mulch, specialized filters, and structural hardware) to be invoiced separately on a Time-and-Materials (T&M) or cost-plus basis as they are needed?
12. If materials must be included in a flat or lump-sum bid, how does the City recommend contractors estimate these unknown quantities without a predetermined inventory or baseline assessment of the facilities?
Answer: The answer to questions 9-12 is as follows: For plant materials, use a cost-plus model, where a % markup is added to the wholesale price. The cost plus % for plant materials shall include all services related to pulling, sorting, loading, and delivery of the plant material. For materials, like mulch, use wholesale price (no markup allowed). Use hourly labor rates for pickup and installation. Please adjust the bid form as needed to better reflect an accurate quote from your firm.
Note: Specialized filters and structural hardware are not in scope. *
13. The contract mandates a two-year warranty guaranteeing that plantings "thrive," but the baseline density and current planting health of each facility are undefined. What is the standard baseline for vegetation density across these facilities? Are the swales considered https://www.instagram.com/PortlandGov/
PortlandORGov ogo, company name
Description automatically generated fully planted and established, or should the contractor anticipate doing initial “catch-up" planting work to bring them up to standard? -Is there a specific planting guide, layout map, or target plant count required per bioswale?
Answer: Vegetated facilities are expected to maintain at least 90% vegetated coverage which includes groundcover, herbaceous plants, and tree canopy. The minimum threshold for required planting is 75% coverage. The City can provide planting guidance as specified in the Stormwater Management Manual.
The City requires 90% success with replanting required to achieve 90% cover.
14. Does the City maintain an approved list of native plants and allowable tree/shrub/grass species for these specific stormwater facilities?
Answer: Yes, the City maintains a list of recommended species and placement considerations.
15. The text references coordinating with "the district and school facilities departments" to identify priority sites and access locked facilities, but does not provide an inventory of the properties. Can the City provide a definitive list of the specific schools, the exact number of bioswales/facilities per property, and their physical addresses?
Answer: Yes, the City has a database of stormwater management facilities at each school. Please see the attached list at the end of this addendumm
16. Will the City authorize a formal window for contractors to enter and view the bioswales prior to submitting the bid so we can accurately assess current site conditions?
Answer: Will require coordination with School Districts to provide/acknowledge access. This will also be highlighted in the scope of work.
17. Stormwater facilities experience their highest structural stress, sediment loading, and flow volumes during the rainy season. Conversely, heavy vegetation maintenance and irrigation typically occurs in the growing season. Does the City anticipate that the bulk of the heavy physical work on these bioswales (such as sediment clearing, erosion repair, and facility rehabilitation) will be winter-heavy work concentrated during the rainy season?
Answer: Initial maintenance to ensure functionality of facilities is expected to be completed during the Fall/Winter: clearing inlets/outlets; sediment/debris removal; vegetation evaluation. Planting should be completed when seasonally appropriate: before/after frost; and before extended dry and hot conditions.

18. Is the required "minimum" frequency strictly a baseline? If the contractor determines that a site requires more frequent inspections or preventative visits to ensure "effective operation" and protect plant life, does the contractor have the autonomy to authorize and execute those additional visits?
Answer: Contractor may determine frequency of maintenance and/ or as agreed in the scope of work.
19. Are inspections and actual maintenance work treated as entirely separate site visits?
Specifically, if an issue is identified during a quarterly or post-storm inspection, is the contractor expected to perform the repair immediately during that same visit, or does the inspection serve as a diagnostic tool to trigger a separate, billable maintenance work order?
Answer: Either/Or. When possible, routine maintenance may be conducted during an ‘inspection’.
This may up to the contractor on how they prefer to evaluate maintenance needs and maintenance implementation. Whatever the most cost effective for implementation.
20. Section 3.1 outlines an intensive documentation process requiring detailed logs and photographic evidence of the work performed. Contractors need to understand if this reporting ties directly into the monthly payment cycle, similar to commercial irrigation or public works maintenance contracts.
21. What is the specific timeline and cycle for invoicing (e.g., monthly, quarterly, or upon completion of specific milestone tasks)?
22. Are the detailed logs, photos, and scope descriptions required under Section 3.1 to be submitted as a prerequisite for invoice approval?
23. Regarding material procurement under Section 4: If material invoicing cannot include a standard percentage markup, will the City confirm that the contractor can legally include and bill for the labor hours required for the purchasing, transport, and staging/delivery of those materials to the individual bioswale sites?
24. The contract specifies a strict two-year plant establishment warranty. However, municipal maintenance contracts can expire, change hands, or be terminated before a two-year biological cycle is complete.
25. If the contractor installs plantings during the contract term, but the overall contract ends or is awarded to a different vendor before the two-year plant warranty period concludes, does the contractor's warranty liability terminate with the contract?
26. Once maintenance stewardship is turned over to the City, a school district, or a succeeding contractor, is the original contractor relieved of all ongoing plant replacement and material cost obligations?
PortlandORGov ogo, company name
Description automatically generated
Answer: The answer to questions 20-26 is as follows: Yes – the School Districts are ultimately responsible for ongoing maintenance of facilities outside the scope of this contract and any warranty periods. Additionally, all parties are subject to the terms and conditions of the signed contract. Terms of termination, obligation, warranty, and liability will be outlined within the signed agreement.
27. Does the City have a minimum number of stormwater management facilities associated with each school district that must be maintained within the project?
Answer: At a minimum, every vegetated stormwater management facility listed in the City provided prioritized inventory is inspected and evaluated for maintenance needs. Maintenance is performed where most needed.
28. Does the City have a list of stormwater management facilities associated with each school district?
Answer: yes please see the list at the end of this addendum.
29. Maintenance and repair costs could vary significantly between facilities.
Maintenance/repair/replanting costs at a single facility could run into five-figures. How could a contractor reasonably bid on work that is so undefined and unknown (unknowns include: number of facilities, minimum number of facilities that must be included, needs at each facility (for example, whether a catch basin needs to be cleaned out, is functioning, has functioning connections, etc.)
Answer: City will review bids that provide the greatest value for dollar in terms of stormwater management facilities (SMFs) of vegetated SMFs maintained and the transfer of knowledge to school personnel responsible for operating and long-term maintenance of SMFs. ITB’s are awarded on lowest bid.
30. Plant replacement and ensuring healthy vegetation in green infrastructure systems will take time as plants need to grow and establish and face many obstacles. Given the timeframe of the work – how will the City define “healthy vegetation” in stormwater management facilities that have to be replanted?
Answer: Per our SWMM standards and Operations & Maintenance Plans specific to privately owned and maintained vegetated SMFs. Any new planting should have a two-year warranty period.
31. In the bid schedule, I see debris and sediment removal listed, which I take as our hourly rate, but I don’t see a separate line item for disposal. Disposal at the facility is charged by actual weights – Are we expected to have a specific markup on that cost?
PortlandORGov ogo, company name
Description automatically generated
Answer: – Include a disposal line item (cost per unit and estimated units). Disposal of sediment from vegetated facilities may be disposed in sanitary waste/garbage under permission of school district. Sediment may not be discarded to compost facilities. Feel free to adjust the bid form to better reflect your firm’s quote.
32. Furthermore, for structure maintenance, there are often materials that need to be included for this – Is this also to only be an hourly rate?
33. And on that same train of thought – Same thing with the treatment devices and replacement – There is an hourly rate for labor, but any time treatment devices are cleaned or replaced, there will be disposal and material costs associated with the work.
Answer: Will be providing the edited Scope of Work, where focus will be on the vegetated facilities only. Will be non-applicable under modified scope.
PROGRAM QUESTIONS:
34. The bid reads to us as two separate disciplines having been combined into one. A vegetation stewardship and B - civil utility construction. Will the City consider separating these into two distinct bidding schedules or clarifying the exact boundary of the contractor's structural liability?
Answer: Will be providing the edited Scope of Work, where focus will be on the vegetated facilities only. Will be non-applicable under modified scope.
35. To accurately forecast payroll costs, scheduling constraints, and crew efficiency, contractors must understand when they are legally and contractually allowed on school grounds to perform heavy maintenance, noise-producing work, or inspections. What are the permitted working hours for contractors on school properties? Is work restricted to after-school hours, weekends, or academic calendar breaks (e.g., summer, winter, and spring breaks)?
Answer: Will need to coordinate with school staff on this question. The scope of work will highlight this access and partnership.
36. The bid preparation documents request an hourly rate for additional or as-needed services. Is the requested hourly rate to be billed per worker on-site (man-hours), or is it billed as a flat company/crew hour regardless of the number of laborers present?
PortlandORGov ogo, company name
Description automatically generated
Answer: Billing in man hours seem appropriate and as agreed in project budget review in the actual contract.
37. Does the City anticipate awarding only 1 bid for the entire $170,000, or does the City anticipate potentially awarding multiple bids for less budget?
Answer: Yes, to keep our administrative costs down, and the City is open to the primary contractor, awarding work to more than one sub.
38. Regarding coordination with School Districts – in the likely scenario that school districts are unable to “identify priority sites” how shall Contractors prioritize sites?
Answer: Prioritized by the City, BES Stormwater Facility Inspection (SFI) team. The City can provide a prioritized inventory.
39. Has the City taken into account what can be extremely long contracting time frames in determining the schedule associated with the Invitation to Bid?
Answer: City acknowledges appropriate maintenance windows and will address it when setting deliverable deadlines in the contract.
40. The Invitation for Bids references “less resources school districts particularly those in East
Portland.” How does the City define less resourced, particularly given PPS budget struggles?
Answer: City will provide prioritized inventory that considers both the school district/schools’ need for contractual work and the condition/need for maintenance of individual SMFs at those districts/schools.
41. Related to the question above – it appears that Riverdale School District would not be a priority. Would the City expect the Contractor to work on ANY Riverdale School District properties?
Answer: If the SMF condition indicated the maintenance need is high and the benefit of transferring SMF maintenance knowledge to a school district/school is high, we’d anticipate that Riverdale School District properties would be included.
42. Is there a scenario where a Contractor submits a bid to work on a specific suite of stormwater management facilities at specific schools? Essentially to define the sites of work within the proposal?
Answer: Yes, that is the intent.
COMPLIANCE QUESTIONS:

Description automatically
43. Beyond standard corporate business licenses, general commercial liability insurance, and water bureau hydrant permits, working across multiple school properties often triggers specialized regional or district-level compliance costs.
44. What specific municipal, environmental, or right-of-way permits and licenses does the City anticipate will be required to execute this contract?
Answer: There are no additional licenses anticipated at this time, but in the event that unanticipated licensing requirements arise those will be discussed with the contractor.
Contractors will be responsible for securing all required permits and licenses.
45. Because the work takes place on active school district properties, are contractors required to secure a specific performance/payment bond to work with school districts?
Answer: Yes, in partnerships with schools and their staff.
46. Will contractor staff be required to undergo formal criminal background checks (such as FBI/fingerprint clearances), obtain specialized school district identification badges, or pay for district security/custodial staff to be present on the premises?
47. The ITB requests that the contractor organize, facilitate, and supervise community volunteer events involving students, parents, and school staff for tasks like trash removal, mulching, planting, and invasive species removal. In the event that a student, parent, or community volunteer is injured while participating in an environmental stewardship event on school property under vendor supervision, who carries the primary liability; the City, the School District, or the Contractor?
Answer: For this Project, the City does not require the Contractor or its personnel to undergo formal criminal background checks, fingerprinting, or similar screening as a condition of performing the Services.
Notwithstanding the foregoing, the Contractor will need to, at its sole cost and expense, procure and maintain all insurance coverage required by the Contract. Such coverage shall include, at a minimum, Commercial General Liability, Automobile Liability, Workers' Compensation, and Sexual Abuse and Molestation Liability insurance, with coverage limits and terms to be established by the City and incorporated into the final Contract executed with the successful bidder.
48. Does the School District provide standard liability waivers for participating students and parents, or is the contractor expected to draft, secure, and manage these legal releases?
Answer: In general, yes. Individual schools and school districts may establish requirements that are separate from, or in addition to, those imposed by the City of Portland, including, but not https://www.instagram.com/PortlandGov/
PortlandORGov ogo, company name
Description automatically generated limited to, insurance requirements, permits, approvals, waivers, or other conditions applicable to activities conducted on school property.
The Contractor shall be solely responsible for identifying, obtaining, and complying with all such school or school district-specific requirements. The Contractor shall secure any required approvals, permits, waivers, agreements, or other authorizations directly from the applicable school or school district upon initiating a partnership and prior to the commencement of project planning, implementation, or any activities conducted at the school site.
49. If a contractor must host these events outside of regular operational hours, will the City or District cover the cost of keeping school facilities?
Answer: Need to include these costs into a bid budget. Per “outside or regular school hours: will need to coordinate with school staff, i.e. on the access, hours, etc.
