VALLEY CAMP MINE FACILITIES

I. SPECIAL PROVISIONS

1.0 LOCATION / SITE DESCRIPTION

The project is located within Ohio County, West Virginia in Wheeling near the community of Valley Camp. The site was the previous location of the mining operations preparation plant. The only remaining facilities visible are an approximately 140’ tall by 80’ diameter concrete silo, the circular foundation and wall remains of another tank or silo, and a water pump structure and shaft. According to historic aerial photographs, it appears that the silo was constructed sometime between 1957 and 1966. The rest of the plant was demolished and removed between 1982 and 1997.

Directions to Site:

From Washington, Pa, take I-70 West to the Dallas Pike Exit. Turn right at the end of the exit ramp and go South on the Dallas Pike. At the bottom of the hill at the "T" intersection turn left on the National Road/ Rt.40, travel about a mile, Liberty Distribution building on the left. The access road to the vacant mine property is on the left beside a row of blue storage buildings. The locked access road is across a metal bridge.

GPS Coordinates for the Concrete Silo is:

40.063157°, -80.611199°

Approximate GPS Coordinates for Foundation Remains and Ruins is:

40.063294°, -80.610239°

Approximate GPS Coordinates for Pump Structure and Shaft is:

40.063865°, - 80.607638°

2.0 SCOPE OF WORK

The Work consists of furnishing all labor, plant, power, equipment, supplies, and performing all operations necessary for the completion of the project. The Contractor shall perform all operations necessary for:

• Mobilization and Demobilization

• Survey and Construction Layout

• Quality Control

• Site Preparation

• Gravel Road Rehabilitation

• Temporary Access Roads

• Structure Demolition

• Installation and Maintenance of Erosion and Sediment (E&S) Controls

• Repaving and Refinishing of Existing Paved Road, at the direction of the

Engineer.

• Revegetation

• Final Site Cleanup and Removal of E&S Controls

Specifically, the Contractor will be installing their E&S Controls, establishing access to the Equipment / Storage Area, clearing and grading the site as needed to provide space to Work, and any other applicable Site Preparation.

The Contractor is to install Gravel Rehabilitation to repair or reconstruct any existing graveled areas damaged during the Work by the Contractor to a quality consistent with these Specifications and to a quality at least what was present before the Work started, at the Contractor’s expense, except as otherwise specified or approved.

The existing bridge structure at the site is owned by the Ohio County Commission. The

Contractor shall have the option to utilize the existing bridge structure to the site or to install a temporary crossing for access. To utilize the existing bridge, the Contractor shall evaluate the structure based upon the size and weight of the proposed equipment to be used. This evaluation shall include the replacement cost of the structure in the case that it is damaged beyond repair during construction. If the structure is found to be adequate to provide access, then the Contractor shall reach a signed agreement with the Ohio

County Commission to utilize the bridge. The Contractor shall have in place a bond for the use of the bridge for a total of $1,500,000 or the replacement cost of the bridge from the evaluation, whichever is greater. This bond will act as a surety in the event that the bridge is damaged and the damages are not rectified by the Contractor.

If the Contractor decides to install a temporary crossing into the site, then they will be responsible for all design, permitting, and installation of that structure and the temporary access roads necessary to accommodate entry.

The Contractor shall demolish the existing concrete silo on the project site. This shall be accomplished by either blasting or by demolition equipment. If equipment is used, then demolition shall be completed from the top of the structure down.

The Contractor is to install a 2-inch type 1 hot mix asphalt wearing course to any existing paved areas that are damaged during work at the direction of the Engineer. The expectation is that, if the pavement is damaged, that the pavement would be, at a minimum, cleaned and prepped, have tack coat applied, and resurface areas as deemed necessary by the engineer. If damage protrudes into the base or aggregate layer of the existing asphalt, then a full depth repair will be necessary. This will be determined as directed by the Engineer. If nothing is damaged during the Work, then no replacements would be necessary.

Contractor is responsible for leaving the site and surrounding area in original condition or better. This includes picking up and disposing of any trash or litter the Work generates in accordance with these Specifications.

Contractor will IMMEDIATELY clean any mud off roadways that the State reasonably believes to be project related.

Contractor is responsible for engaging in soil disturbance only within the Limits of

Disturbance shown on the Plans.

The Contractor shall also be responsible for surveying, including establishing construction baseline, measuring and developing all completed quantities on the job, and the ordering, purchase and delivery of any and all materials required for construction or required for development of support areas. This includes those areas specified below, shown on the Plans, and any other areas as approved by the State. This work shall also include the preservation from damage for all vegetation, utilities, or any other object not being specifically removed according to the Specifications and Plans. Additionally, this work shall include stripping and stockpiling topsoil from the construction area, keeping it separated from other stockpiled soil, and using the topsoil for soil cover and revegetation at the end of the construction.

Site Bridge Access – There is an existing bridge structure that allows access to the site from U.S. Route 40. This bridge is currently owned by the Ohio County Commission. If the contractor utilizes the existing bridge structure for access to the site during construction, they shall be responsible for entering into an agreement with the County.

The contractor shall have a structural evaluation by a registered WV Professional

Engineer performed on the structure based upon the proposed equipment loads that will utilize the bridge during construction and shall be responsible for any damages that occur and will be handled between the contractor and the County. This evaluation shall include a complete replacement cost for the structure, including design, permitting, etc., and all other costs, if it is damaged during construction. The Contractor shall have in place a bond on the bridge for $1,500,000 or the complete replacement cost from the evaluation of the structure, whichever is greater. If damages occur to the structure that are not rectified by the Contractor, then the bond shall be used to repair or replace the structure to a so acceptable condition as determined and approved in writing by the county and

WVDEP AML. The Contractor will accept all responsibility for any damage(s) or defect(s) related to the use of this existing bridge structure. The WVDEP will accept no responsibility or liability for any damage(s) or defect(s) related to the use of this existing bridge structure.

Alternate Site Access- The plans indicate an alternative access location and if the contractor decides to utilize this area for access, they shall be responsible for all design, permitting, material, installation, etc. necessary to construct this access based upon the proposed crossing method and equipment. All access roads and structures associated with this access location shall be temporary and shall be removed immediately following construction. All disturbed areas shall be reclaimed and revegetated to a condition equal to or better than existing as approved by the engineer.

Site Demolition - This Work shall consist of complete demolition and removal of such buildings, mining related structures, equipment and materials, existing ruins and foundation structures and existing AML structures and systems, as are specifically designated on the Plans for removal or encountered during construction, except for the demolition of the concrete silo. Demolished concrete and cinder block structures and foundation ruins may be disposed in the concrete waste area. All demolished concrete will be crushed to a size less than 24-inches and all reinforcement not completely embedded in any piece of concrete will be removed and disposed of off-site. Any steel or burned (if authorized) wood remnants must be removed from the site. All on-site garbage (as well as all other debris of any type and quantity), mining equipment, and metal structures encountered shall be removed from the site to an off-site disposal area in accordance with these Specifications to a Landfill approved by the State to accept the applicable waste type. Certified disposal weight tickets shall be provided to the WVDEP.

The contractor is advised to perform a thorough site reconnaissance to quantify all garbage designated for removal prior to submitting a bid.

Gravel Drive Rehabilitation - The Gravel Drive Rehabilitation roads shall be covered with a layer of Class 1, 1-1/2” Crusher Run Aggregate to restore – as needed – the gravel road to “as good as” or “better” condition than existed prior to construction. In areas that will not support the stone due to soft conditions, stabilization fabric will be required. Any regrading or resurfacing necessary to restore existing roads or driveways used during construction to a condition that is equal to or better than the condition encountered before construction activities, including partial roadway section overlays and re-blending of transitions into existing gravel roadway stone placement. Gravel Drive Rehabilitation shall be utilized as specified, and as required or approved by the Engineer.

Stabilization Fabric and Stone - Stabilization Fabric and Stabilization Stone shall be placed in areas that will not support the road construction due to soft conditions. The placement of stabilization fabric and stabilization stone shall be at the discretion of Engineer and approved prior.

Access Road Construction - Access roads constructed to gain access to, travel between, or otherwise required for equipment/vehicular site access shall be kept to a minimum and only constructed where necessary upon approval from the WVDEP, where applicable. If the

Contractor constructs such travel routes, they shall be reclaimed and revegetated according to Section 6 upon completion of the construction activities, as deemed necessary by the

WVDEP, with associated costs being incidental. Any additional access shall require the

Contractor to obtain written permission from the respective landowner. The existing access roads shall be maintained during construction (except when culvert, ditch and road construction are being performed), and shall be left in a condition equal to, or better than, the existing condition upon completion of construction.

Silo Demolition - The Contractor shall have a minimum of 5 years’ experience in large reinforced concrete structure demolition to be qualified for the demolition of the concrete silo. The contractor must provide proof of acceptable experience including but not limited to references with contact information, etc. The silo demolition may be completed by either mechanically dismantling the structure from the top down or by means of explosives. Contractor shall submit a demolition plan to the WVDEP for review and acceptance prior to beginning the demolition of the silo. Contractor shall follow all relative federal, state, and/or local regulations and safety requirements pertaining to the demolition of the structure. Any damage(s) or defect(s) related to construction activities associated with the silo demolition shall be the responsibility of the contractor. The

WVDEP will accept no responsibility or liability for any damage(s) or defect(s) related to construction activities associated with the silo demolition.

Asbestos Material Identification and Removal (if present) - This Work shall consist of a

Contractor-provided Competent Person – as defined by Title 29, Subtitle B, Chapter XVII, Part 1926 of the CFR Code – performing a thorough search of all existing structures on the project to ensure that there are no asbestos materials present. If any areas are suspected of containing asbestos, then an inspection would need to occur – at the Contractor’s expense – by a company possessing a valid, current Asbestos Contractor License in the State of West

Virginia. Each on-site representative of the company performing the asbestos survey or mitigation would need to be a Licensed Asbestos Contractor in the State of West Virginia.

If asbestos was found, an estimate for removal and proper disposal would need to be obtained by the Contractor and submitted for the Engineer’s approval. At that point, the

Contractor would be responsible to perform all notifications as required by all Federal and

State law – particularly NESHAP as outlined in Title 40, Chapter I, Subchapter C, Part 61, Subpart M of the CFR Code. No work would be allowed at the location of the asbestos until the removal process was completed. No asbestos mitigation or removal is anticipated for this Work – if the Contractor determines asbestos is present and subsequently receives a positive test for asbestos, a Change Order would be negotiated with the State for the proper mitigation to occur through the Contractor. All mitigation by the Contractor (or their Sub-

Contractor) would need to be in accordance with all Federal, State, and Local laws.

Materials and Equipment Storage - The Contractor shall obtain approval from the Engineer for proposed materials and equipment storage areas not designated prior to use. Refueling or fuel storage should not occur within 100ft of a wetland, water body, stream, or ditch leading into the same – see additional requirements for fuel storage in the “Spill

Containment Area” below. Areas utilized shall be restored to an “as good as” or “better” condition than existed prior to construction or shall otherwise be reclaimed as directed or approved by the Engineer.

Any additional access shall require the Contractor to obtain written permission from the

State. The existing access roads shall be maintained during construction. Any regrading, stone, fabric, equipment, and any other labor or materials necessary for the construction of the additional access roads shall be incidental to the cost of the work described herein.

Note that the State has the option of leaving stoned laydown areas, stabilized construction entrances, and roads intact permanently at the State’s discretion.
