The Contractor will be assigned working areas or working right-of-way limits for use in the prosecution of work under this contract, subject to the SECTION 00 72 00, GENERAL CONDITIONS (CONTRACT CLAUSES) clause entitled "Operations and Storage Areas."

1.3 PROTECTION OF EXISTING FACILITIES AND WORKS

The Contractor shall be responsible for the protection of the work area from damage and upon completion of the work shall leave existing works in a condition equal to that which existed when the work started. Prior to work commencement, provide continuous color audio-video tape recording taken along the entire length of the project work sites, including staging areas, borrow sites, haul roads and access routes, to serve as a record of pre-construction conditions. All work, storage of materials, and construction plant shall be kept within the limits of the areas assigned. Prior to construction operations, the Contractor shall confer with the Contracting Officer's representative to determine the proximity of any possible under-ground obstructions, pipe or equipment which could be damaged as a result of construction operations.

Existing utility lines that are shown on the drawings or the locations are otherwise made known to the Contractor shall be protected from damage, and if damaged, shall be repaired by the Contractor at no additional expense to the Government. In the event that the Contractor damages any existing utility lines that are not shown or the locations of which have not been made known to the Contractor, the Contractor shall immediately notify the Contracting Officer. The Contracting Officer will review the information and discuss with the Contractor how to proceed. The Contractor will be responsible for the protection of structures from any structural damage during the construction operations. Waste or surplus materials shall not be allowed to accumulate in the construction areas.

1.3.1 Flood Protection Works

In all cases where materials in the existing flood protection works are used or connected with the construction of new work under this contract, the work shall be so planned and executed that the new work shall be completed to provide protection equivalent to the existing protection as the existing protection is weakened or removed. These operating restrictions shall be followed in order that the new work may be tied in, or connected promptly, by the Contractor, with the existing facilities so as to furnish a continuous service in an emergency. These ties or connections shall be made during periods of suspended construction operations and the Contractor shall leave incompleted pipe outlets and other structures in such conditions as to not interfere with the natural drainage from areas served by these pipes or structures.

1.4 DIVERSION AND CARE OF WATER

Full responsibility for the diversion and care of water from whatever source, including direct rainfall, surface runoff, groundwater, and sources outside of the construction area shall be borne by the Contractor until completion of work under this contract. The Contractor shall make the needed investigation and determination of existing and anticipated conditions concerning care of water. Plans for diversion and care of water during construction shall be submitted, within 10 calendar days after receipt of Notice to Proceed, for the approval of the Contracting Officer and shall show location, material and method for dewatering the work area and disposal of the water. The work area shall be unwatered and maintained in a "dry" condition to the extent practicable. Excavations and open pits shall be kept free of standing water due to rainfall, surface runoff, or groundwater. The groundwater elevation in areas to recieve impervious (clay) fill shall be maintained no higher than 2 feet below the ground surface prior to fill placement. Areas where new structures are to be located shall be kept dry until the concrete slabs and walls have been satisfactorily placed and cured in an approved manner.

Diversion of the water shall be accomplished without additional disturbance of in-place bank material beyond the limits necessary for placement of the structures. All temporary stream diversions and temporary stream crossings shall meet the requirements and design criteria of the Urban Storm Drainage Critera Manual published by the Urban Drainage Flood Control District (now known as Mile High Flood Control District).

1.4.1 Dewatering Permit

Dewatering excavations to surface waterways requires a Colorado Department of Public Health and Environment (CDPHE) Dewatering Permit. A Construction Dewatering Permit from CDPHE may be required but it is the responsibility of the Contractor to determine if a permit is required based on their means and methods.

To prevent project delays, it is recommended that the Contractor apply for a Construction Dewatering permit with the State of Colorado as soon as the Project is awarded. Approval of a Construction Dewatering Permit may take at least 30 days after the application is received. Application is to be made to the CDPHE with permit fees paid by the Contractor. Payment to the Contractor of the amounts based on the quantities of work as measured in accordance with the specified methods of measurement and the prices stipulated in the accepted proposal will constitute complete compensation for all work shown on the Drawings, provided in the specifications or other Contract Documents and all costs of accepting the general risks, liabilities and obligations expressed or implied. Payment under all items shall include, but not necessarily be limited to, compensation for furnishing all supervision, labor, equipment, and materials and services, as well as performing all work required to accomplish and complete the work specified under each item and all other work required.
