About this file

This is a Special Terms and Conditions document for the Virginia Department of Forestry's Ewing Mountain – Fry Hill Project Area Invasive Species Treatment contract. The solicitation seeks a contractor with demonstrated experience in pre-harvest herbicide treatments for control of non-native invasive species on approximately 45 acres located in Wythe County, Virginia. Bidders must submit responses that include unit prices per area with cumulative totals for each item during the contract period. The document requires vendors to provide at least four references spanning the past five or more years of similar commercial or governmental work, with at least one project demonstrating experience with plant species specified in Attachment E. Contractors must maintain all required licensing throughout the contract term and immediately notify the purchasing agency of any license revocation. The bid acceptance period is sixty days, during which bids may be withdrawn or remain valid until award or solicitation cancellation.

Awards will be made to the lowest responsive and responsible bidder based on net prices, with the State reserving the right to reject any and all bids in whole or in part. The purchasing agency retains the right to cancel and terminate the contract without penalty upon sixty days written notice. Contractors must participate in the eVA eProcurement Program and provide electronic catalogs or Punch-Out Catalogs for awarded items. All contractors and subcontractors require prior written consent from the purchasing agency and must provide qualifications and experience documentation. Contractors must maintain herbicide labels and material safety data sheets on site during all treatments and for at least two years afterward, with Virginia Department of Forestry authorized to conduct inspections at any time. Contractors are responsible for repairing any damage to existing utilities, equipment, or finished surfaces resulting from contract performance and must indemnify the Commonwealth for claims arising from materials, goods, or services provided, excluding liability attributable to the Commonwealth's sole negligence.

The State reserves the right to reject any and all bids in whole or in part, to waive any informality, and to delete items prior to making an award.

B. CANCELLATION OF CONTRACT: The purchasing agency reserves the right to cancel and terminate any resulting contract, in part or in whole, without penalty, upon 60 days written notice to the contractor. Any contract cancellation notice shall not relieve the contractor of the obligation to deliver and/or perform on all outstanding orders issued prior to the effective date of cancellation.

C. eVA ORDERS AND CONTRACTS: The solicitation/contract will result in one (1) purchase order with the applicable eVA transaction fee assessed for each order.

Vendors desiring to provide goods and/or services to the Commonwealth shall participate in the eVA eProcurement Program and agree to comply with the following: If this solicitation is for a term contract, failure to provide an electronic catalog (price list) or Punch-Out Catalog for items awarded will be just cause for the Commonwealth to reject your bid/offer or terminate this contract for default. D. BID ACCEPTANCE PERIOD: Any bid in response to this solicitation shall be valid for sixty (60) days. At the end of the days the bid may be withdrawn at the written request of the bidder. The Contractor shall, however, remain fully liable and responsible for the work to be done by its subcontractor(s) and shall assure compliance with all requirements of the contract.
