About this file

This document is a Special Terms and Conditions attachment from the California Department of Corrections and Rehabilitation (CDCR) that establishes mandatory requirements for all suppliers conducting business at CDCR facilities. The terms cover security protocols, facility access procedures, and behavioral expectations for supplier personnel entering institution grounds. Suppliers must comply with clothing restrictions prohibiting apparel that resembles inmate uniforms, including blue denim pants, blue chambray shirts, and orange/yellow/white/chartreuse jumpsuits. All supplier personnel require valid state-issued photo identification and may be subject to vehicle and person searches upon entry. Delivery drivers may need to obtain gate clearance a minimum of ten working days prior to facility access, which involves Department of Motor Vehicles checks, wants and warrants checks, and criminal history verification. Suppliers must adhere to all institutional security rules and procedures established by facility authorities and acknowledge that delays at security checkpoints are the responsibility of the supplier.

CDCR enforces a zero-tolerance Prison Rape Elimination Act (PREA) policy requiring suppliers and their staff to comply with 28 Code of Federal Regulations Part 115 standards. Suppliers are prohibited from assigning employees to CDCR facilities if those employees have engaged in sexual abuse, been convicted of sexual misconduct facilitated by force or coercion, or been civilly or administratively adjudicated for such conduct. Additional prohibitions include bringing firearms, weapons, explosives, drugs, or communicative devices such as cell phones or cameras onto institution grounds, and exchanging any gifts or unauthorized correspondence with inmates or wards. The facility maintains a no-hostage policy and enforces strict penalties for violations, including potential criminal prosecution. By submitting a bid response, suppliers must acknowledge receipt and understanding of all CDCR Special Terms and Conditions.
