About this file
This document contains special contract provisions from the Area Agency on Aging of Palm Beach/Treasure Coast, Inc., establishing financial and compliance audit requirements, monitoring procedures, and civil rights compliance standards for state and local contract agreements. The attachment outlines mandatory audit protocols for both federally funded and state-funded programs, with audit triggers set at $500,000 in federal awards or state financial assistance during a provider's fiscal year. Providers must submit audit reporting packages within specified timeframes: within 30 days of receipt or 9 months after fiscal year end for federal audits, and within 45 days of delivery or 12 months after fiscal year end for state audits (9 months for nonprofit or for-profit organizations). All audit reports and management letters must be submitted to the Area Agency on Aging of Palm Beach/Treasure Coast, the Federal Audit Clearinghouse, and the Florida Auditor General's Office as applicable. Providers are required to maintain compliance records for six years from the audit report issuance date and provide access to audit working papers upon request.
The civil rights compliance requirements apply to all providers receiving federal or state funding and mandate nondiscriminatory service delivery across all demographics including race, sex, color, national origin, religion, age, and disability status. Providers must ensure physical accessibility for disabled individuals, provide bilingual services where significant non-English-speaking populations exist, designate civil rights coordinators for organizations with 15 or more employees, and establish grievance procedures compliant with Section 504 of the Rehabilitation Act of 1973. Additionally, providers with 50 or more employees and $50,000 or more in federal contracts must develop written affirmative action compliance programs. All providers must complete and submit Civil Rights Compliance Checklists documenting staff and client demographics, eligibility practices, accessibility measures, discrimination complaint history, and compliance with nondiscrimination policies and procedures.

8. Where there is a significant variation between the race, sex or ethnic composition of the clients and their availability in the population, the program/facility has the responsibility to determine the reasons for such variation and take whatever action may be necessary to correct any discrimination. Some legitimate disparities may exist when programs are sanctioned to serve target populations such as elderly or disabled persons, 45 CFR 80.3 (b) (6).
9. Do eligibility requirements unlawfully exclude persons in protected groups from the provision of services or employment? Evidence of such may be indicated in staff and client representation (Questions 3 and 4) and also through on-site record analysis of persons who applied but were denied services or employment, 45 CFR 80.3 (a) and 45 CFR 80.1 (b) (2).

c. Take remedial steps to eliminate any discrimination that has been identified.
