About this file

This file comprises special contract provisions and compliance attachments from the Florida Department of Elder Affairs (DOEA), specifically Attachments BA and BB addressing non-construction program assurances and background screening requirements. Attachment BA contains federal assurances required of applicants receiving federal assistance, mandating compliance with various statutes including the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973, the Age Discrimination Act of 1975, environmental protection laws, historic preservation requirements, and the Single Audit Act Amendments of 1996. The document requires applicants to demonstrate legal authority, institutional capability, proper accounting systems, conflict of interest safeguards, timely project completion, merit system compliance for personnel, and adherence to labor standards including Davis-Bacon Act provisions for federally assisted construction.

Attachment BB establishes background screening requirements under Florida Statutes Chapters 430 and 435 for employers and employees providing services to elderly or disabled populations. The document defines "direct service providers" as individuals eighteen years or older with direct face-to-face contact and access to client personal information, and requires Level 2 background screening for such personnel. The attachment provides a comprehensive list of disqualifying criminal offenses including violent crimes, sexual misconduct, theft, fraud, drug offenses, and domestic violence. Employees may claim exceptions to screening requirements if they are attorneys in good standing with the Florida Bar, relatives of clients, or volunteers assisting fewer than twenty hours monthly without prior criminal records. Both employers and employees must complete notarized affidavits attesting to compliance with screening standards and commit to immediate notification of any arrests for disqualifying offenses during employment.
