About this file

This is a Special Conditions document issued by an unnamed Florida county outlining amendments to the General Conditions for a potable water looping construction project on Jackson Road and US 41. The project involves the installation of approximately 3,500 feet of potable water lines in various sizes (6-inch, 8-inch, and 12-inch) to connect and loop portions of the county's potable water distribution system. The work is necessary to maintain water quality standards in areas requiring more than routine flushing. The county has established the contract to run for the duration of the project and requires contractors to meet specified minimum qualifications, scope requirements, and insurance provisions detailed in the solicitation documents.

The Special Conditions document establishes critical liability provisions related to environmental compliance obligations. The county has entered into a Consent Order with the Florida Department of Environmental Protection and a Stipulated Order with Suncoast Waterkeepers regarding the Bee Ridge Water Reclamation Facility, under which the county faces financial penalties for any unpermitted wastewater discharges. The contractor is responsible for immediately controlling, containing, and stopping any discharge of wastewater and must promptly repair any damage to county facilities while notifying the project manager upon discovery of such incidents. The contractor is liable for reimbursing the county for any penalties assessed under these orders attributable to the contractor's actions, with daily penalty rates ranging from $600 for discharges up to 5,000 gallons to $12,000 for discharges exceeding 100,000 gallons, scaled according to discharge volume.
