About this file

This document contains questions and answers regarding Solicitation SPE605-21-R-0228 issued by the Defense Logistics Agency Energy. The solicitation seeks annual fuel requirements for three products - Gasoline Midgrade Unleaded, Diesel Fuel Sulfur 10PPM, and Turbine Fuel Aviation JP8 - to support operations in Jordan and the Middle East over a three year period from date of award through November 2024. Bids must include pricing for all contract line items of a product to be considered for award, which will be made on an "all or nothing" basis to the lowest priced technically acceptable offeror per product. The only approved fuel source for Jordan is JoPetrol, whose prices on the base reference date will be used to determine differentials. Tax exemption and base access responsibilities remain with the contractor.

Question and Answer Period for DLA Solicitation

SPE605-21-R-0228

November 2, 2021 – November 9, 2021

1. Within the solicitation documents, there is a file entitled “Price Data Sheet”. This document shows and example of the pricing calculation as Base Reference Price + Jordanian Government Applicable Fees + Differential/Expenses = Total Offer Price. Please define “Jordanian Government Fees”. (This field is an “if applicable” field if any additional fees are included that a vendor think should be added).

2. The Jordanian Government Fees listed in “Price Data Sheet” document is an agree to rate between the US DoD / DoS and the Jordanian government or is this a fee that each contractor should negotiate with the Jordanian Government? (Correct. This field would be for any additional fees that a vendor may have agreed to with the Jordanian Government.

Again, it is only applicable if you feel that there should be included).

3. On page 147, item #12, there is a reference to the “Fuel Source Data Sheet” attached but there was not such document attached in the solicitation. Is this a document that you will provide under amendment or will this requirement be removed? (The Fuel Source Data Sheet is not necessary for this solicitation as the source will be JoPetrol. This will be removed later within an amendment. You COA will be sufficient).

4. Where in the proposal shall the Representations and Certifications fill in sections be placed?

(You can remove the pages from the solicitation, fill them out, and submit as an attachment).

5. Should we fill in the total prices in Section B CLIN numbers on the solicitation as well as the Price Data Sheet? (Yes. Not necessary, but I suggest that you complete it there. However, it must be submitted on the Price Data Sheet).

6. There will be one award for all CLINS or a multiple award? (There could be multiple awards under this solicitation. One for MUM, SFD, and JP8. This is on a “all or nothing” based on product. If you bid on MUM, for example, you will have to bid on all five (5) CLINS of MUM to be awarded a contract. Likewise, with SFD and JP8).

7. Is the contractor allowed to import product in support of this contract? (No. JoPetrol is the only source for fuel in the Country of Jordan).

8. As there are no 3rd party testing agencies operating within Jordan, can the contractor self-perform all QA testing for C level tests and utilize the refinery laboratory to provide the A and B level tests? (No. There are Quality Representatives that are located at the Customer’s Locations).

9. The volumes listed within the solicitation are estimated for annual consumption or for the entire contract period of performance? (The volumes are for a three (3) year period).

10. Please define the exact dates of the period of performance. (Date of award through November 30, 2024).

11. In the solicitation document, the first sentence on page 3 mentions an assessment of the financial capabilities. Please define what this assessment may include. (This assessment is done through the QAR and Quality department if they need to determine a vendor’s financial capabilities. This normally happens on a new location that a vendor has never made deliveries to).

12. Will the US Govt. assist with the necessary documentation to allow the contractor to process the tax exemption of the fuel being purchased and delivered for this contract requirement?

(No! This is the responsibility of the vendor. Please be advised that you will need to know what taxes are exempt. The U.S. and Jordan have a Status of Forces agreement that exempts the U.S. Government from all duties and taxes on products, property, materials, or equipment imported into or acquired in Jordan or on behalf of the United States Government).

13. Many of the delivery sites are either Jordanian military bases or joint military bases and will require assistance from DLA E / US DoD or DoS for access. Will the US govt. assist with the necessary base access for the bases that are to be delivered to under this contract requirement? (Yes! When you are submitted for vetting in JCCS, your company has cleared personnel that should be able to access bases).

14. Since clause 52.229-12 - TAX ON CERTAIN FOREIGN PROCUREMENTS NOTICE AND REPRESENTATIONS (FEB 2021) - is included in the solicitation by text, does that mean 2% of all invoices will be withheld for all foreign vendors who do not submit IRS form W-14 with their proposal? (The 2% tax depends on the laws in Jordan, and if your company is eligible for that tax. I do not know the tax laws in Jordan. Therefore, you will need to either contact the IRS, or your Legal Department would have knowledge of whether you are exempt/or eligible).

15. Are Jordanian companies eligible for the exemption that can be requested by submitting IRS form W-14? (Again, this is a question that I will have to bring to my finance/legal department. As far as I know, Jordanian companies may be exempt to these requirements. However, I know that RJAF will charge a fee on Jet Fuel (JP8) that Jordanian companies are not exempt from. Please confer with your company’s legal department for guidance).

16. Can you confirm contractors can bid on a single CLIN only? Can you confirm each CLIN will be evaluated separately and could be awarded separately? (This solicitation requires that if you bid on MUM, you will have to provide a price for all 5 CLINS of MUM under the solicitation. This works the same way with SFD and JP8. For example, a vendor cannot bid on 2 out of 5 CLINS of SFD and be awarded the contract; that vendor must bid on all 5 CLINS of SFD to be considered for a contract award. The awards will be done based on product on an all or none basis. Therefore, you cannot just bid on 2 MUM products and 3 SFD products, or just 1 of the 2 JP8 CLINS. You will be evaluated based on the lowest price technically acceptable for each product (MUM - 5 CLINS, SFD - 5 CLINS, JP8 - 2 CLINS). If a vendor bids $4.01 on SFD (for all 5 SFD CLINS) and it is the lowest offered price, that vendor will be awarded the contract as the LPTA for SFD and will be award the contract based on being technically acceptable through Quality and the lowest price technically acceptable (LPTA)).

17. What is the location of the Northern Irrigation Site? (Aqaba, Jordan)

18. Do you have a list of approved lads in Jordan? (Please be more specific with LADS in Jordan)

19. Do you need a list of individual driver names included in the proposal that we intend to use to deliver to the customer? (Yes)

20. Do you need a list of vehicle identification numbers included in the proposal for the fuel trucks we intend to use to deliver to the customer? (Yes)

21. Is an alternative supply chain needed as we are using Jo Petrol as a reference price? (No alternate supply chain needed JoPetrol is the only provider for fuel in Jordan).

22. Do we need to include a fuel source data sheet as I did not see one included in the attachments? (No. N/A Prices are based on JoPetrol prices from the base reference date).

23. For CLIN’s 1,3,4,5,6, and 8 can you be more specific on the fittings needed at the customers site to couple our fuel trucks to their tanks? (Currently the vendor is using a 3" camlock fitting to offload receipt trucks. However, when a vendor is awarded a contract, they will be informed by the Customer if the requirement for offload has been changed or updated).

24. Will DLA award CLINS individually or is it all or nothing? (CLINS will be awarded on a “product” all or none basis. If you bid on MUM, you will have to bid on all five (5) CLINS.

Likewise, for SFD and JP8).

25. Will the DLA help with Tax exemption letters from the Jordanian government upon award?

(No, that is done internally by your company).

26. Will the DLA provide us with a letter to the Jordan Government confirming the award of contract in order to obtain the tax exemption? (No, that would come from JoPetrol and your company informing the Government that an award for delivery was awarded to a vendor).

27. Will the government be providing a Letter of Authorization (LOA) for EXPAT to obtain CAC cards on the grounds on the Jordan Fuel contract? (No)

28. If the contractors are not provided LOA will DLA support contractors on gaining base access?

I.E. letter in support of the U.S and coalition Forces. (No! Base access is granted through JCCS of contractors that were submitted for vetting through your company).

29. Should we fill in the total prices in Section B CLIN numbers on the solicitation as well as the Price Data Sheet? (Yes. It is not necessary, but I suggest that you complete it there. You will still have to sign Section B and return it. However, it must be submitted on the Price Data Sheet).

30. On the document entitled “Price Data Sheet”. This document shows and example of the pricing calculation as Base Reference Price + Jordanian Government Applicable Fees + Differential/Expenses = Total Offer Price. What are “Jordanian Government Fees”? (This field is an “if applicable”. Some vendors think that there should be additional fees/taxes included within their prices. THIS FIELD IS TOTALLY OPTIONAL AND NOT REQURIED. IF A

VENDOR THINKS THAT THERE ARE ADDITIONAL FEES/TAXES THAT SHOULD BE INCLUDED

WITHIN THE PRICES OFFERED, THEY HAVE AN OPTION TO DO SO. DLA IS NOT ADVISING

OR SAYING THAT THERE ARE ADDITIONAL FEES. WE ARE JUST PROVIDING THIS FIELD AS

AN OPTIONAL FIELD IF APPLICABLE).
