Technical question:
Question: Will the government consider providing historical data for unforeseen workloads as outlined in C-1.6.1, to enable us to provide more accurate pricing? If historical “unforeseen” workload data is not available, and unforeseen workloads require augmentation or overtime in order to meet program needs, how will the government compensate the contractor?
Answer: A slide presentation with historical information was given at the pre-proposal conference. Copies may be obtained via request from George.McKay@eu.navy.mil
Contract questions:
1. Question: If a new “Employee Agreement” is signed between the employees and the incumbent contractor prior to the start date of the contract, will a copy of the Agreement be made available? If not, will contractors be allowed to submit a request for equitable adjustment after award to revise their Final Pricing Offer?
Answer: No Equitable Adjustment will be allowed after award. The Government cannot offer advice on Spanish Labor Law. This is a firm-fixed price contract, and it is the offeror’s responsibility to research and obtain the information necessary in order to determine their offer price.
2. Question: In order to comply with applicable Spanish Labor Regulations, employees under the current contract have first right of refusal under the new contract. Could you provide the list and labor costs of all personnel currently working under the labor contract for the incumbent contractor?
Answer: It is the offeror’s responsibility to research and obtain the information necessary in order to determine their offer price. This is a performance based contract, therefore the Government does not dictate the number of personnel required.
