COG 8

Amendment 0004

A. The purpose of this amendment is to delete all references to Solicitation Provision M3.01

“EVALUATION OF OFFERS WHERE UNCOMMON ESCALATORS ARE USED (DLA

Energy JAN 1998),” and answer questions received in response to the solicitation.

B. All references to Solicitation Provision M3.01 “EVALUATION OF OFFERS WHERE UNCOMMON ESCALATORS ARE USED (DLA ENERGY JAN 1998) are hereby deleted from the solicitation. This includes references made in Amendment 0002. DLA Energy will not consider offers using any uncommon escalators for any line items under the solicitation.

C. The following responses are provided to questions received in response to Solicitation

SPE600-16-R-0221:

a. Question: Are the estimated quantities over a 4-year period or are they based on annually? Are the estimated quantities correct? For example CLIN #129 is for 816 gallons of diesel. Is this amount over 4-years or per year? This doesn't seem to fit with the two tank sizes which are 10,000 gallons and 120,000 gallons.

Answer: The estimated quantities listed in Attachment A, “Line Item Narratives - Schedule B,” are for the entire 4-year period. These quantities are estimates, and, to DLA Energy’s knowledge, the estimated quantities are accurate.

b. Question: For the mode of delivery, some items request “Tank Truck” and some request “Tank wagon.” Is there an expected gallon capacity between those two different modes? I view them as similar types of trucks having approximately a 4,500 gallon capacity but I want to be sure that is accurate.

Answer: Typically tank wagons are mandated to come equipped with a pump and a meter and have a capacity of 4,500 gallons or less. Tank trucks typically are not mandated to come equipped with a pump and a meter and have a capacity of 4,500 gallons or more.

c. Question: In Washington state there are 2 taxes that are % based fees but the system only allows for a CPG [Cost Per Gallon] value to be put in when describing taxes. Given that these aren't flat CPG values but would fluctuate with the market how should we enter these values in for bidding purposes?

Answer: Offerors should not include any percentage based taxes in the offer prices that they enter into OET. Offerors should state in the “Notes” section in OET if any percentage based taxes apply to that particular line item. In the “Notes” section, vendors should state the name of the percentage based tax and the percentage amount that applies.

d. Question: So same basic question about the Oregon load fee. It's $8 per load, how would we translate that to a CPG?

Answer: Any tax/fee that an offeror determines applies to its offer price, but which is not included in the drop down list of taxes within OET, should be listed in the “Notes” section for that line item in OET. List the name of the tax/fee and the amount.

Amendment 0004

e. Question: Given more information is pending from ordering activities [regarding tank information] will the deadline to submit be extended to allow participants sufficient time for preparations?

Answer: Amendment 0003 extended the deadline to submit offers to May 6, 2016, 3:00PM Eastern time. DLA Energy will issue a separate amendment to provide tank information for line items that do not contain complete tank information.

f. Question: After Amendment 2, question 12, if we are going to submit a different escalator than Platts, how would we submit that in the OET?

Answer: This amendment deletes all references to Solicitation Provision M3.01

“EVALUATION OF OFFERS WHERE UNCOMMON ESCALATORS ARE USED (DLA

ENERGY JAN 1998), including those included in Amendment 0002. DLA Energy will not consider offers using any uncommon escalators for any line items under the solicitation.

g. Question: The Washington State Tax is currently .445 per gallon. On July 1, 2016 it will go up to .494 per gallon. Which rate would we use for the bid?

Answer: Vendors should use the rate effective on July 1, 2016.

h. Question: On the Offer Entry Tool there are three options for the Gasohol FET FET Gasohol Eff 10/1/05 Federal Excise Tax Gasohol Eff Jan 05 Federal Excise Tax Gasohol Which one should we use?

Answer: Please use the Federal Excise Tax Gasohol.

i. Question: Do we only need to submit one OSP even if we are offering multiple bids per item?

Answer: Offerors must submit one completed and signed Offeror Submission Package (OSP) with each offer. To clarify, offerors can only submit one offer per line item.

j. Question: If we are going to propose an alternative escalator, would we list what that escalator is in the “Notes” section when we submit the bid in the OET?

Answer: See the answer to question (f) herein.

k. Question: When proposing an alternative escalator, should we be referencing the March 1st, 2016 date for that escalator?

Answer: See the answer to question (f) herein.

l. Question: A question regarding the percentage taxes in Washington. When we put the cents per gallon number in OET, since these taxes are based on the product dollar at the time of the order, do we just base it on our submitted price? It will still vary with each order as it done currently, correct?

Answer: See the answer to question (c) herein.
