About this file

This is an Amendment of Solicitation/Modification of Contract (Standard Form 30) issued by the Defense Logistics Agency (DLA) Troop Support Subsistence Supply Chain located in Philadelphia, Pennsylvania. The amendment is numbered 0005 with an effective date of September 23, 2026, and pertains to solicitation SPE3S126R0011 dated July 22, 2026.

The amendment deletes the previous Procurement Note TS16-18 Economic Price Adjustment - Polymeric Traypack Ration (June 2017) and replaces it with an updated Economic Price Adjustment (EPA) Procurement Note effective September 2026. The new EPA language establishes mechanisms for price adjustments on polymeric traypack ration items based on fluctuating commodity costs for beef, turkey, ham, pork, chicken, and blueberries. The contractor must identify the "Dollar Portion Subject to EPA" for each item, representing only the product material costs subject to market volatility, while labor, overhead, G&A, transportation, and profit must be included in the firm fixed price portion. Price adjustments are calculated using established market price indicators from sources such as the USDA Weekly National Carlot Meat Report and monthly national turkey, chicken, and blueberry reports. Adjustments apply only to tier periods subsequent to Tier 1 with a $500 minimum threshold, and upward adjustments are capped at 100 percent of the original Dollar Portion Subject to EPA price. The EPA Index Chart identifies 16 unique traypack components with their corresponding economic indicators and price publication sources. The contracting officer may unilaterally add additional traypack items to the index as needed, and disputes regarding indicator substitutions shall be resolved through the contract's Disputes clause.

SECTION B - SUPPLIES OR SERVICES AND PRICES OR COSTS

This amendment is hereby issued to implement the following changes:

Procurement Note TS16-18 ECONOMIC PRICE ADJUSTMENT - POLYMERIC TRAYPACK RATION (JUN 2017), starting on page 10 and ending on page 14 of the solicitation, is deleted from the solicitation entirely.

The following Procurement Note is added to the solicitation:

ECONOMIC PRICE ADJUSTMENT - POLYMERIC TRAYPACK RATION PROCUREMENT NOTE, September 2026, Defense Logistics Agency, Troop Support

(a) Warranties. For the portion of the schedule that is covered by this EPA language, the Contractor warrants that the unit prices included in the Schedule do not include allowances for any portion of the contingency covered by this EPA language.

(b) Definitions. As used throughout this procurement note -

(1) “Base Unit Price” The Base Unit Price for the purpose of the adjustment calculations under this procurement note shall be the arithmetic average of the weekly or monthly prices of each applicable economic indicator only for the period specified under the “Base Unit Price” column in the EPA Index Chart shown in paragraph (c) immediately preceding either the solicitation closing date for proposals (if no discussions are held), the due date for final proposal revisions (if discussions are held) or the solicitation opening date (if sealed bidding is used).

(2) “Adjusting Unit Price” The Adjusting Unit Price for the purpose of the adjustment calculations under this procurement note shall be the arithmetic average of the weekly or monthly prices of each applicable economic indicator for the period specified under the “ADJ Unit Price” column in the EPA Index Chart shown in paragraph (c) immediately preceding the effective date of the tier period.

(3) “Dollar Portion Subject to EPA” : The Dollar Portion Subject to EPA is the cost of each item that is subject to adjustment in accordance with this procurement note. The vendor must input this dollar portion for each item under the “Dollar Portion Subject to EPA” column in the “Vendor EPA Price Fill-In” Chart located in Section L of the Solicitation. The Dollar Portion Subject to EPA is the element of cost for each item that is outside the control of the vendor. This is the only portion of the cost that will be subject to this EPA procurement note. The Dollar Portion Subject to EPA remains fixed throughout the life of the contract unless a Government authorized change is made to the contract which affects the Dollar Portion Subject to EPA.

(i) The Dollar Portion Subject to EPA is for product material costs such as beef, turkey, ham, pork, chicken, and blueberries because there is serious doubt concerning the stability of market conditions.

(ii) Product costs such as labor, overhead, General and Administrative (G&A), transportation, and profit can be included in the contract price, but must not be included in the Dollar Portion Subject to EPA. These costs

must only be included in the Firm Fixed Price portion of the Item price.

(iii) The United States Army Combat Capabilities Development Command (DEVCOM) Soldier Center who prepares the specifications has moved from Military Specifications to Performance Requirements. The Government no longer states the specific amount of meat, potatoes, gravy, etc. that goes into a tray pack item, only an overall amount with a protein and carbohydrate requirement. Meeting the protein requirement indicates that the Contractor has put in sufficient meat quantities in the tray/pouch to satisfy the requirement. Different Contractors will put in differing quantities of beef, turkey, ham, pork, chicken breast, etc. to meet the protein performance requirements. This is why specific weights or quantities cannot be specified in advance in this EPA as would be used in a Military Specification and the cost for the items subject to adjustment (“Dollar Portion Subject to EPA”) will be entered by the Contractor in the Vendor EPA Price Fill-In chart . The Government performs oversight to ensure that the performance requirements are met or exceeded.

These components are selected based on historical data and may not be included in every polymeric traypack ration. Refer elsewhere in the solicitation/contract for listing of the exact component makeup applicable to the contract.

(d) The established market price that shall be used to adjust the Dollar Portion Subject to EPA is reflected in the Economic Indicators and Publications as listed in paragraph (c) of this Procurement Note.

An established market price is a price that is established in the course of ordinary and usual trade between buyers and sellers free to bargain and that can be substantiated by data from sources independent of the offeror(s); and the net price after applying any standard trade discounts offered by the Contractor. The established market price under this EPA language may reflect industry-wide and/or geographically based market price fluctuations for commodity groups or specific supplies.

(e) Adjustments.

(1) Contract Unit Price Adjustments shall be calculated as follows: (Round to four decimal places)

i. Compute the Adjusting Unit Price and the Base Unit Price.

ii. (Adjusting Unit Price - Base Unit Price)/Base Unit Price = Market Price Change (+ or -).

CONTINUATION SHEET REFERENCE NO. OF DOCUMENT BEING CONTINUED: PAGE 6 OF 7 PAGES

SECTION B - SUPPLIES OR SERVICES AND PRICES OR COSTS (CONTINUED)

iii. Market Price Change X Dollar Portion Subject to EPA = Price Adjustment (+ or -).

iv. Determine the Contract Unit Price Adjustment by computing the sum total of the price Adjustment of all items subject to EPA.

v. The tier unit price(s) for each tier will be the sum of the firm fixed price portion and the Dollar Portion

Subject to EPA. The adjusted unit price(s) for each tier shall be determined by increasing or decreasing (as appropriate) the Dollar Portion Subject to EPA by the Contract Unit Price Adjustment and adding that to the firm fixed price portion agreed to at the time of award for the tier period being adjusted.

(2) Price adjustments pursuant to this EPA language shall be made by contract modification showing the calculations used to derive the adjusted contract unit price.

(3) With respect to increases or decreases under this EPA language, no adjustment shall be made to the Tier 1 contract unit prices. One adjustment calculation shall be made for subsequent tiers to determine the unit prices applicable to the subsequent tier period(s).

(4) ) In the event any applicable market price indicator is not published for any week(s), that week will not be included in calculating the base unit price or the adjusting unit price as applicable. For instance, if within a 52 week period an indicator is not published 4 times, the average of the 48 published prices only will be calculated. When a range of prices is provided, for the purposes of the calculations the arithmetic average of the high and low number will be calculated to determine the indicator for that period.

(f) Payments: Payment for an adjustment under this EPA language shall be at the current contract price until an adjustment modification has been effected. The Government shall pay the Contractor, upon submission of proper invoices or vouchers, the unit price stipulated in the contract modification for the applicable tier period. The Contractor also represents by submitting its final invoice that the total amount billed under this contract reflects all increases or decreases required or authorized by this EPA language.

(g) Any pricing actions pursuant to the “CHANGES” clause or other provisions of the contract will be priced as though there were no provisions for economic price adjustment.

(h) No adjustment will be made under this EPA language unless the total change in the contract amount is $500.00 or more.

(i) Upward ceiling on economic price adjustment: The total increase of the Dollar Portion Subject to EPA for any item shall not exceed 100% of the original Dollar Portion Subject to EPA price, which is agreed to at time of award. There is no percentage limit on downward adjustments under this EPA language.

a. If an adjustment calculated in accordance with this procurement note will exceed the current contract ceiling price for any item, the contracting officer may increase the EPA ceiling for stated in paragraph (i) through bilateral modification. Any increases for specific items will be no higher than the price calculated in accordance with this procurement note, and will not exceed the ceiling stated in paragraph (i).

CONTINUATION SHEET REFERENCE NO. OF DOCUMENT BEING CONTINUED: PAGE 7 OF 7 PAGES

SECTION B - SUPPLIES OR SERVICES AND PRICES OR COSTS (CONTINUED)

(j) Revision of Economic Indicator or Publication: In the event that (i) any applicable Economic Indicator or Publication is discontinued or the Contracting officer determines that its method of derivation is altered substantially; or (ii) the Contracting Officer determines that a particular Economic Indicator or Publication consistently and substantially fails to reflect market conditions, the parties shall mutually agree upon an appropriate and comparable substitute and the contract shall be modified to reflect such substitute.

a. If the contractor believes that any Economic Indicator or Publication consistently and substantially fails to reflect market conditions for any tier period, the contractor must notify the Contracting Officer.

b. Any revision of the Economic Indicator or Publication made in accordance with this paragraph will be effective as of the date the modification is issued and will not apply retroactively.

(k) Disputes: If the parties fail to agree on an appropriate substitute market price indicator or implementation of other matters addressed by this Procurement Note then the matter shall be resolved in accordance with the Disputes clause of the contract.

(l) Authority to add additional traypack items to Polymeric Traypack Ration Procurement Note. Paragraph (c) of this EPA language identifies 16 unique components contained in the polymeric traypack ration. Due to customer requirements, the Contracting Officer may unilaterally add additional components to the polymeric traypack ration. The additional components will be added to paragraph (b) of this EPA language.

(p) Examination of records: The Contractor agrees that the Contracting Officer or designated representative shall have the right to examine the Contractor's books, records, documents, or other data the Contracting Officer deems necessary to verify Contractor adherence to the provisions of the Procurement Note.
