About this file

This is an Amendment to Solicitation/Modification of Contract (Standard Form 30) for a Defense Logistics Agency (DLA) IDIQ contract.

The amendment extends the solicitation closing date from April 13, 2026 at 3:00 PM EST to April 17, 2026 at 3:00 PM EST for solicitation SP8000-26-R-0006. The contract is issued by DCSO Columbus Division-1 in Columbus, Ohio, and involves the procurement of nickel niobium alloy material. The pricing structure is Firm Fixed Price (FFP), the only pricing option available for this acquisition. The estimated total volume is 1,446,114.27 pounds, though the government is only obligated to purchase the guaranteed minimum and individually specified orders issued against the IDIQ. Contractors must deliver material within 12 months of receiving a delivery order. The amendment addresses 12 vendor questions and clarifications, including confirmation that final alloy production (melting/refining) must occur in the United States or its outlying areas per DFARS 252.225-7008, though foreign-sourced raw materials are permissible. Only the Trade Agreements Act (TAA) clause applies, not the Buy American Act. DFARS 252.204-7019 applies as the material is not COTS, and assessments must be submitted before award. The solicitation encourages all responsible offerors, both foreign and domestic, to submit proposals. This is a First Time Buy requirement with no pre-approved suppliers currently identified.

SP8000-26-R-0006 0002

SP8000-26-R-0006 amendment 0002 is issued to accomplish the following: Extend the solicitation closing date and time and respond to vendor questions.

A. Solicitation closing date is extended from 13 APRIL 2026 at 3:00 PM Eastern Standard Time to 17 APRIL 2026 at 3:00 PM Eastern Standard Time.

B. DLA received the following vendor questions, which are listed with answers below:

Question 1:

The SOW states that "The contractor’s production facilities must be within the CONUS for all lots of material the contractor intends to supply the government." Section (16) of the Solicitation states "all responsible offerors (both foreign and domestic) who can provide the material are encouraged to submit a proposal."

Please confirm that offerors and their suppliers can have production facilities outside of the CONUS.

Answer:

Per the solicitation, award will be made in accordance with DFARS 252.225-7008, which requires that the nickel niobium provided under this contract be “melted or produced in the United States or its outlying areas. However, in the event that either insufficient DFARS-compliant material or no DFARS-compliant material is available, the Government may consider and award the contract to an offeror of foreign material.

Question 2:

Under the 52.212-5 clause, both the BAA (52.225-1) and TAA (52.225-5) are marked as applicable. However, the TAA is a waiver to the BAA. Also, 52.225-1 appears inconsistent with the Solicitation's instruction for "all responsible offerors (both foreign and domestic) who can provide the material are encouraged to submit a proposal."

Please confirm that the BAA clause (52.225-1) is not applicable to this procurement and only the TAA is.

Answer:

TTA is the correct one.

Question 3:

Please confirm that the provision at 252.204-7019 does not apply to this procurement because NiNb is a COTS product.

Answer:

Material is not COTS, DFARS 252.204-7019 applies.

Question 4:

If 252.204-7019 does apply, please confirm that the successful offeror can submit an assessment after award.

Answer:

Before award in accordance with DFARS 252.204-7019(b)

Question 5:

Please confirm if vendor can use a vessel with flag different from U.S. flag if there is no US-flagged vessel available at commercially reasonable rates.

Answer:

In accordance with DFARS 252.247-7023(d)(1) and (2), if the Contractor or a subcontractor sufficiently explains that U.S.-flag vessels are not available at a fair and reasonable rate for commercial vessels of the United States or U.S.-flag vessels are otherwise not available, they may request a waiver at the delivery order, rather than IDIQ, level.

Question 6:

What other pricing options are available then firm fixed price? Is the firm fixed price non negotiable? How will the DLA compensate for the floating price of Nickel on the LME world market?

Answer:

Firm Fixed Price i(FFP)s the only Pricing Terms available for this acquisition.

Question 7:

At what point will the DLA declare the total volume to buy? Our pricing is volume sensitive, and this will cascade down the supply chain to our suppliers.

Answer:

We can only estimate the total amount. DLA estimates a total of 1,446,114.27 pounds. The Government will only be obligated to satisfy the guaranteed minimum and the individually specified orders issued against the IDIQ.

Question 8:

What is the typical delivery schedule for each year? For example, in year 1 the estimated quantity is 16,132.28 Lbs; when exactly would delivery occur? Year 2 the estimated quantity is 401,997.25; could this be delivered all at one time or would this deliver in even quarterly increments?

Answer:

The contractor must take no longer than 12 months to deliver material once a delivery order is issued. Please also see SOW Section II - I. Delivery for information on proposed material delivery schedules and other delivery-related requirements.

SP8000-26-R-0006 0002

Question 9:

Please confirm that the requirement stating “production facilities must be within CONUS” refers to final alloy production (melting/refining) and not the origin of raw materials (niobium or nickel feedstock). Additionally, please confirm whether foreign-sourced raw materials are acceptable if final processing and testing are completed within the United States.

Answer:

Yes, as per DFARS 252-225-7008. Any specialty metal delivered under this contract shall be melted or produced in the United States or its outlying areas. To confirm, using a foreign source for feedstock is permissible so long as the nickel niobium to be provided under this contract is “melted or produced in the United States or its outlying areas.

Question 10:

Are there any pre-approved or historically utilized CONUS-based producers of Nickel Niobium Alloy for this program?

Answer:

No, this is a First Time Buy requirement and there are no approved sources of supply.

Question 11:

Are there any restrictions on the country of origin for niobium or nickel feedstock used in production?

Answer:

Pursuant to DFARS 252.225-7008, using a foreign source for feedstock is permissible so long as the nickel niobium to be provided under this contract is “melted or produced in the United States or its outlying areas.

Question 12:

What is the expected lead time from award to first delivery under this IDIQ?

Answer:

The contractor must take no longer than 12 months to deliver material once a delivery order is issued. See SOW Section II - I. Delivery.

All other terms and conditions from solicitation SP8000-26-R-0006 remain unchanged.
