About this file
This is a draft request for proposal for an indefinite delivery, indefinite quantity contract to provide shipboard multifunction devices, single function devices, and specialty devices for various government agencies including the Navy, Military Sealift Command, and Coast Guard. The contract would have a potential seven-year ordering period to supply six classes of multifunction devices in both A3 and A4 paper sizes, a minimum of two classes of single function devices, and two classes of specialty devices. Related technical, analyst, maintenance, supply, and training services would also be within scope. Offerors must meet requirements outlined in the performance work statement and provide pricing by line item number. The solicitation includes standard terms for commercial item contracts covering areas like small business participation goals, regulatory flow-downs, and payment procedures. Evaluation will use a lowest price technically acceptable approach.

52.212-2 EVALUATION - COMMERCIAL ITEMS (OCT 2014) FAR
As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
The following factors shall be used to evaluate offers:
Price, Technical Capability, and Past Performance
Technical and past performance, when combined, will not be weighted. The LPTA source selection process will be utilized.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.
Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Price: The offeror must submit a single unit price for each CLIN listed in Attachment 2-CLIN List, in the space provided for the unit price.
In addition, the offeror must provide a total for each CLIN (Total Formula = Estimated Quantity for Evaluation Purposes Units X Unit Price).
Technical Requirements: Offerors shall submit one (1) original copy and one (1) redacted version. (The redacted version is used during the technical evaluation and, therefore, it should be without company logo, identifying marks, and names. Failure to provide a redacted copy may result in a nonresponsive determination. The Government will validate Offeror’s redacted company information but will not make changes to the Offeror’s provided redacted proposal either to add or delete redacted text/graphics/etc.).
One IDIQ contract will be issued to the offeror that has the LPTA proposal, subject to testing and approval. The offeror must demonstrate compliance with ALL the Technical Requirements set forth in the Performance Work Statement (PWS).
Past Performance: Offeror is required to submit information, on a single page, identifying federal, and/or state and/or local Government and/or private contracts performed within the past three years, which are similar in scope and complexity to the effort described in this solicitation. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror shall state none. Submit no more than three customer references for work performed that is relevant and similar in scope to this requirement. Include reference names, telephone numbers, email addresses, and a brief description of the work performed.
In addition, the contracting officer will review the System for Award Management (SAM),the Federal Awardee Performance and Integrity Information System (FAPIIS) repositories, and the Past Performance Information Retrieval System (PPIRS) in accordance with FAR 9.104-6(a), to determine contractor responsibility prior to making any award.
Past performance shall be used as an evaluation factor within the LPTA process, unless waived by the Procurement Contracting Officer, in accordance with FAR 15.101-2(b). Past performance shall be evaluated in accordance with FAR 15.305 and DFARS 215.305.
However, the comparative assessment in FAR 15.305(a)(2)(i) does not apply. Therefore, past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings below.
Acceptable: Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable: Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
PAGE 5 OF 45 PAGES
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
Evaluation Factors for Award
The evaluation method that will be utilized is LPTA in accordance with FAR 15.101-2. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. The Government intends to evaluate and make awards without discussions unless discussions are determined to be necessary. The evaluation criteria are as follows: Price, Technical Capability, and Past Performance.
One award will be made to the responsible offeror who meets all the technical factors, has acceptable past performance and results in the lowest price to the government.
A. Technical Factors
To be technically acceptable each offer must demonstrate it meets all the Technical Factors (including all subfactors) set forth in the attached PWS. This will be evaluated as “Acceptable” or “Unacceptable” basis. In order to receive an “Acceptable” rating the offer must clearly demonstrate the ability to provide and perform all services and technical requirements described in the PWS. An offer that is evaluated as “Unacceptable” for any requirement will not be considered for award.
B. Past Performance
A past performance review will be conducted to determine whether the Government has confidence that the offeror can successfully perform the requirements set forth in the PWS. In conducting its past performance assessment the Government may use both data provided by the offeror and data obtained from other federal Government sources. Data information has to be within the past 5 years of similar supplies and services. Past performance will be determined on an “acceptable” or “unacceptable” basis.
C. Price
To ensure fair price analysis, each offerors price for price analysis purposes will be determined by taking its grand total offer for base period, and all option periods. (See Part 3 Price under Format and Submittal above)
52.217-5 -- Evaluation of Options (Jul 1990)
Except when it is determined IAW FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
Note: DLAD Procurement Note L09 applies to this solicitation.
DLAD PROCUREMENT NOTE L09 REVERSE AUCTION (OCT 2016)
The Contracting Officer may utilize reverse auctioning to conduct price discussions. If the Contracting Officer does not conduct a reverse auction, award may be made on initial offers or following discussions. If the Contracting Officer decides to use line reverse auctioning to conduct price negotiations, the Contracting Officer will notify Offerors of this decision and the following applies:
(1) The contracting officer may use reverse auction as the pricing technique during discussions to receive the final offered prices from each offeror.
(2) During each round of reverse auction, the system displays the lowest offer price(s) unless the auction instructions are different. All offerors and authorized auction users see the displayed lowest price(s). This disclosure is anonymous and a generic identifier displays for the offeror. Generic identifiers include designators such as “offer A” or “lowest-priced offeror.” By submitting a proposal in response to the solicitation, offerors agree to participate in the reverse auction and that their prices may be disclosed, including to other offerors, during the reverse auction.
PAGE 6 OF 45 PAGES
(3) An offeror’s final auction price at the close of the reverse auction is considered its final price proposal revision. No price revisions will be accepted after the close of the reverse auction, unless the contracting officer decides that further discussions are needed and final price proposal revisions are again requested in accordance with Federal Acquisition Regulation (FAR) 15.307, or the contracting officer determines that it would be in the best interest of the Government to re-open the auction.
(4) The contracting officer identifies participants to the DLA commercial reverse auction service provider. To be eligible for award and participate, the offeror must agree with terms and conditions of the entire solicitation and the commercial reverse auction service.
The reverse auction pricing tool system administrator sends auction information in an email. The reverse auction system designates offers as "lead," meaning the current low price in that auction, or "not lead," meaning not the current low price in that auction. In the event of a tie offer, the reverse auction provider's system designates the first offer of that price as "lead" and the second or subsequent offer of that price as "not lead." If a tie offer is submitted and no evaluation factors other than price were identified in the solicitation or a low- price technically acceptable source selection is being used, the "Not Lead” offeror that submitted the tie offer must offer a changed price; otherwise its offer will be ineligible for award. If evaluation factors in addition to price were listed in the solicitation and a tradeoff source selection is being used, tie offers that are "Not Lead" will be considered and evaluated.
(5) Offerors unable to enter pricing through the commercial reverse auction service provider’s system during a reverse auction must notify the contracting officer or designated representative immediately. The contracting officer may, at their sole discretion, extend or re-open the reverse auction if the reason for the offeror’s inability to enter pricing is determined to be without fault on the part of the offeror and outside the offeror’s control.
(6) Training. The commercial reverse auction service provider or government representative conducts training for offerors. Offerors receive training through written material, the commercial reverse auction service provider’s website, or other means. Trainers name employees successfully completing the training as a “Trained Offeror.” Only trained offerors may engage in a reverse auction. The contracting officer reserves the right to remove the “trained offeror” title from anyone who fails to obey the solicitation or commercial reverse auction service provider terms and conditions.
