52.212-2 -- Evaluation -- Commercial Items.

As prescribed in 13.106-2(b), the Contracting Officer may insert a provision substantially as follows:

Evaluation -- Commercial Items (Oct 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The evaluation method used will be BEST VALUE. Trade-offs are not permitted. The evaluation criteria are:

Administration:

1. SAM registration with FAR Clause 52.212-3 completed

2. Submission FAR Provision 52.222-48 Exemption from Application of the Service Contract Labor Standards to Contracts for Maintenance, Calibration, or Repair of Certain Equipment -- Certification

3. Amendments (if applicable), signed and submitted

Technical Requirements:

The offeror must:

1. Provide Statement of Compliance with the Performance Work Statement (PWS) and its Attachment.

2. Submit KIP Certification of technicians or Statement that ONLY KIP certified technicians shall be used for the entirety of this requirement.

3. If company offers additional parts covered other than specified in PWS 2.1.2, must submit parts list

Price:

The offeror must:

1. Submit a single unit price for each CLIN listed in the space provided for the unit price for Attachment 3. The offeror may use Attachment 3 or submit their own version. Please note that is is required to have a unit price, total CLIN price, Total Base Year Price and Total Price with all Options.

2. If offeror has a commercial standard for allowance for sq ft that is more advantageous, please include the applicable B&W or Color allowance quantity with the CLINS.

3. Overages Unit Price shall be an evaluation factor for the Best Value of the requirement but shall not be included in the overall price total for either the base or all options total. Offeror has flexibility on submission for overages but must answer the questions.

Past Performance:

The offeror is NOT required to submit past performance. All past performance will be evaluated through the Federal Awardee Performance and Integrity Information System (FAPIIS), Past Performance Information Retrieval System-(PPIRS) and Contract Performance Assessment Reporting System (CPARS). If there is no information found on any of the above mentioned platforms, the contractor shall not be impacted negatively and shall have an “Acceptable” Past Performance Rating.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
