52.212-2 -- Evaluation -- Commercial Items.

As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:

Evaluation -- Commercial Items (Oct 2014)

(a) The Government intends to award as a sole source requirement [J&A shall be posted to FBO within the specified time required by FAR 13.501 (a)(iii)] but will evaluate an offer resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The evaluation method used will be Best Value IAW FAR Part 13.106. An award will be made to the proposal meeting or exceeding the acceptability standards for non-cost factors. Trade-offs are not permitted. The Government intends to evaluate and make award without discussions with the offeror (other than discussion conducted for the purpose of minor clarification[s]) unless discussions are determined to be necessary. The evaluation criteria are:

Technical Requirements:

The offeror must demonstrate compliance with ALL the Technical Requirements set forth in the Performance Work Statement (PWS) and its attachments. It is suggested that vendors respond to each numbered portion of the PWS or provide a statement of compliance to all parts set forth in the PWS. It is also required that the devices are to be ONENET certified by 01 Oct 2017, which is the PoP start date.

Past Performance:

The offeror is not required to submit past performance. All past performance will be evaluated through the Past Performance Information Retrieval System (PPIRS) and Contract Performance Assessment Reporting System (CPARS)

Price:

The offeror must submit a single monthly price for each Volume Band listed in the space provided for the unit price. In addition the offeror must provide an extended price for each Volume Band (e.g., Amount shown in the QTY (quantity) multiplied by the U/P (unit price) = Total). Offerors must then add all the extended prices for a proposal grand total. Unit prices must reflect flat rate Firm Fixed Pricing.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written quote or proposal received may result in a binding contract without further action by either party. If this is not acceptable, please state in the offer/quote submitted that this is not a binding quote; otherwise the Government may accept an offer, whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
