About this file
This document is a Justification for an Other Than Full and Open Competition (OTFAOC) prepared by the Defense Logistics Agency (DLA) Contracting Services Office in Philadelphia for a software licensing procurement.
The DLA Information Operations division requires brand-name specific ChemTracker software to support chemical tracking and management for the DLA Product Test Center, located in Battle Creek, Michigan. The requirement spans from July 1, 2026 through June 30, 2030, structured as a 12-month base year (FY26 funding) with three 12-month options. The estimated cost and total dollar amount are redacted in the document. The sole interested source identified is SciShield, located at 3 Center Plaza, Suite 501, Boston, MA 02108, with contact Lisa Fealy at l.fealy@scisure.com or (800) 939-7238. The justification for non-competitive procurement is based on the determination that only ChemTracker software can satisfy the government's requirements, as no competitor's functional replacement products exist in the current marketplace. Market research confirms that SciShield is the only vendor capable of providing ChemTracker licensing, supported by five years of historical procurement records showing only one offeror. The contracting officer will determine fair and reasonable pricing through price analysis techniques including comparison of proposed prices, competitive published price lists, and market research of similar items. The document indicates ongoing market surveillance will continue to identify future opportunities for competitive actions if product alternatives or ownership rights changes emerge.

JUSTIFICATION FOR AN OTHER THAN FULL AND OPEN

7. DETERMINATION OF FAIR AND REASONABLE COST:
As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to: 1) comparison of proposed prices received in response to the solicitation (FAR 15.404-l(b)(2)(i)); 2) comparison with competitive published price lists (FAR 15.404-l(a)(2)(iv)); and 3) comparison of proposed prices within prices obtained through market research of the same or similar items (FAR l 5.404- l(b)(2)(vi)) in order to obtain a fair and reasonable price. The contracting officer will determine prices fair and reasonable prior to award using price history, IGCE, and published price lists (if available).
8. MARKET RESEARCH:
Based on current market research, it has been determined that only ChemTracker software can fully satisfy the Government’s requirements. No competitor’s functional replacement products or services exist in the market currently meet the Government's needs. The Government will continue to conduct market research to determine if there are changes in the marketplace that would enable future competitive actions, e.g., if there are similar products and/or product support in the marketplace that provides the same functionality, if the original equipment manufacturer releases ownership rights of product, or if it is economically feasible to procure a new system.
Currently, the required ChemTracker software is the only product capable of meeting the Government’s needs. However, DLA continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and in the Government. DLA uses a variety of vendors, manufacturers, and contracts/orders to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition to the maximum extent practicable.
9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION:
Historical procurement records show only one offeror being able to provide ChemTracker licensing over the last 5 years.
